OF THE BOARD OF COUNTY COMMISSZONERS �;,
OF PITKIN COUNTY, COLORADO, �
SETTING TNITIAL AIRPORT FEES AND CHARGES FOR 1996 ���''�:.�, ,

1. WHEREAS, Pitkin County, a Colorado home-rule county, is the �,'.
owner, sponsor and operator of the Aspen/Pitkin County Airport � "'
(Sardy Field) , located in the vicinity of Aspen, Colorado, and has ::�::�;ti.:�•
the authority to set, charge, collect and enforce rents, fees, and i ,.'-
charges for the occupancy and use of the Airport, pursuant to,
inter alia, Sections 41-4-101 et seq., 30-11-107, 30-15-401 and 30-
35-201 and 202, I973 C.R.S., as amended, Che Pitkin County Home
� Rule Charter, as amended, and the Pitkin County Code, Title IV, � ;.
� Airport Regulations, as amended.
2. WHEREAS, the Airport financial and rate-setting policies are ,.
set out in Resolution #87-56A. The County's annual Aixport rate
setting method and process are set out in the Proposed Lease and `?
Use Permits for both Signatory and Non-Signatory Airlines. �tx.
! 3. WHEREAS, the County set Airport fees and charges for 1996 by
� enacting Resolution No_ 95-220.
4. WHEREAS, the Aspen Airshow is a non-profit, regularly F
scheduled, annual event sponsored by the Board of County �
Commissioners in conjunction and cooperation with Aspen Base
� Operations {p,gp) . �:.�,;�

� 5. WHEREAS, Resolution No. 95-220 enacted general aviation �
. ; landing fees, and the County now finds it deairable to exempt from
the landing £ee aircraft participating in or supporting the annual
� Aspen Airshow.
{ 6. WHEREAS, the County also finds it desirable to exempt from the
fuel flowage fee all all aircraft participating in and supporting
l the annual Aspen Airshow. ,
7. WHEREAS, the annual Aspen Airshow is scheduled for June 30,
1996, and if these fees are not exempted in an Emergency Amendment
to Resolution No. 95-220, costs associated with bringing aircraft
to Aspen for participation in the Airshow will increase
significantly, said costs charged by the County to participants
then being recharged by Airshow participants back to the County for , '
payment.
S. WfiEREAS, this Emergency Amendment to Resolution No. 95-220 is
specifically made for "Aspen Airshow 1996", and further amendment
as required will be followed in due course at regularly scheduled �
public hearing; 1

THEREFORE, $E ST RESOLVED BY THE SOARD OF COUNTX COMMTS3IONERS OF r'i����kl'
PITRIN COUI3TY, COLORADO: �

Section 1. Section 3. of Resolution No. 95-220 is hereby rescinded '� 1J
in its entirety and rewritten as follows: ;.�.-�.
"4-1 There is hereby imposed on, and shall be paid by, all �
Signatory and Non-signatory scheduled FAR Part 121 air
carriers and Signatory and Non-signatory scheduled FAR part
135 (air taxi and/or commuter) operators authorized to serve
Pitkin County and using the airport, a rate or charge on a11
arrivals of aircraft, from which such carrier or operator `�?" �
' shall derive revenue, equal to sixty-five cents ($.6S) per one (� ` '
thousand (1,000) pounds of maximum allowable gross landing ;.' :
weight; and in addition there is hereby imposed on, and sha11 + .
be paid by, all non-scheduled FAR Part 135 (air taxi, charter,
and/or commuter) operators and all FAR Part 91 operators (but
excluding operators of year-round locally based aircraft with �
maximum gross landing weights of 12,500 pounds or less,
operators of aircraft participating in or supporting the °
annual Aspen Airshow} using the airport, a rate or charge on
all arrivals of aircraft equal to one dollar and thirty-five �
cents ($1.35) per one thousand (1,000) pounds of maximum
allowable gross landing weight;" �
Section 2. Section 4, of Resolution No. 95- 20 is hereby rescinded
in it's entirety and rewritten as follows:
� "4. The fuel flowage £ee collected by ABO on behalf of the
� County is hereby reduced to $.10 per gallon. All aircraft �,
participating in or supporting the annual Aspen Airshow �
are exempt from a11 fuel flowage fees."
Section 3.
That Aspen Base Operation, in conjunction with the Airshow, provide
� in writing, a listing of those aircraft - by aircraft registration
number and type aircraft - that are participating in or supporting
f the annual Aspen Airshow that have been exempted from fuel Elowage j
� fees and landing fees as specified above.
Section 4.
That a copy of this Emergency Resolution shall be kept for public
inspection to the time of the public Hearing hereon during regular
business hours in the office of the Director of Aviation, .
Aspen/Pitkin County Airport, 0233 East Airport Road, Suite A, -
Aspen, Colorado 81611.
Section 5.
That a public Hearing on this Resolution shall be duly-noticed and �
