1. The Boazd of County Commissioners has been made awaze,through work sessions and '
public meetings relating to the Mollie Gibson Park, that there may not cunently be sufficient '
storage space to accommodate contaminated soil(meaning soil containing more than 1000 ppm
]ead) within Operabie Unit 1("OUl")of the Smuggler Mountain Superfund Site;
2. There is a possibility that in excess of 35,000 cubic yazds of contaminated soil couid,in
the future,be required to be stored in connection with existing instiivtional controls relating to . �
residential development within OUl; �

. 3. The Board wishes to provide some assurance to property owners within the Site that the
County is going to continue to work with them in connection with exploring sites for storage of
contaminated soiis.
NOW THEREFORE, 6e it resolved tl�at the Pitkin County Board of County ;_.
Commissioners, of Pitkin County Cotorado, authorizes County Staff to explore altemative "
disposal sites for the benefit of residents within OUI of the Smuggler Mountain Superfund Site, �,
including exploration of the fo]lowing:
. 1. Expansion of existing storage at the Pitkin County Land£1L
. 2. Storage on the Smuggler Mine property.
� 3. Storage at other sites within the Roaring Fork Valley.
' 4. Storage at other sites which would require modification to the existing Consent
Decree, including investigation of the means to obtain modification of the Consent
Decree.
Nothing in this resolution shall be construed as a commitment by the County to subsidize the
costs of removal andlor stprage of soils from the Superfund Site nor does it change any existing ,
commihnents the County had with respect to storage or removai of soils.
