APPROVAL OF THE ELAM CONSTRUCTION,INCORPORATED :�`•'�
ASPHALT/HOT MIX CONCRETE PLANT IN ORDER TO ALLOW FOR � .•.;� ,

1. By Resolution No. 88-47, the Baard of County Commissioners of Pitkin County, ,
Colorado, granted a special review use permit to Elam Construction,Incorporated for the
•� Elam Sand and Gravel Pit and Asphalt/Hot Mix/Concrete plant pursuant to Section 3-
� 210.10(formerly Section 3-6)of the Pitkin County Land LTse Code.
�
2. Pazagraph 4.of Resolution No.88-47,Hours of Operation,set the operational hours
for the facilities to commence no eazlier than 7:00 a.m.and cease no Iater than 7:00 p.m.
3. Pitkin County has conYracted with Elam Construction,Incorporated for reconstruction _
of 5,000 lineaz feet of the runway at the Pitkin County Aicport. Elam is scheduled to
' begin the project on August S,1996.
4. Due to the necessity of keeping the Airport opentional during the reconstrucYion of
the runway at the Pitkin County Airport,and for the benefit of public safety and welfare,
� the construction project wiIl be conducted on an ove�night basis, commencing after the
regular operating hours of the Pitkin County Airport.
5. The Colorado Department of Transportation(CDO'1�will be contracting with Elam
Construction for repaving of State Highway 82. The CDOT contract specifications cail
for the paving to occur during off peak traffic hours.
6. In order for Elam Construction,Incorporated to perform the duties of its contracts with
Pitkin County and CDOT,its operntional hours must be modified for a specific temporary
; period of time.

7. Elam Construciion, Incorporated has requested that its Speciai Use Permit be
temporaziiy amended to allow for a maximum of thirty-two nighttime operations between
August 5, 1996,and September 19, 1996,during which operational hours will be from �
8:00 p.m,unti16:00 a.m.as well as flie normat daytime hours.
TTiEREFORE,BE IT RESOLVED,that the Board of Counry Commissioners of
Pitkin County,Colorado,hereby amends Elam Construction,Incorporated's Special Use

Permit granted by resolution No. 88-47,and authorizes the one time use of the Elam
_ Asphalt/Hot Mix Plant facility for nighttime operations under the foilowing conditions:
1. For the period beginning August 5, 1996,and ending September 19,1996,there may
be a maximu�n of thirty-two nighttime operations at the Eiam Asphalt/Hot Miz Plant in
which operational hours may be extended to include 5:00 p.m,unu16:00 a.m.as wel(as -
nomtal daytime operating hoars.
� 2. This approval shall be limited to a maximum of 40 truck loads per night.
3. A traffic control pIan shall be submitted to the County Engineer which will include �
suitable methods for providing warnings, information, and signage (including lighted
warning signs)to persons using County roads and bike trails in tlie vicinity of the truck
activity area.
4. Elam, in conjuncfion with the Airport and CDOT, shail implament a public
information/notification p(an utilizing at least public service announcements,newspaper
notices,and neighborhood newsletters to alert affected residents and other travelers of
potential delays and hazards.
� 5. There shall be no gravel extraction,crushing,processing,nor stockpiling during the
extended nighltime hours.
6. The applicant must comply with all noise and air quality standards at the piant.
1 7. Trucks shatl not use "Jake" brakes duting nighttime operations except in an
emergency situation.
8, The portable asphalt plant must have an emissions permit issued by the State Air
; Pollution Control Division. This pennit must be visible on the plant stack.

! 9. The applicant shall provide verification that the 5tate has been nodfied of the
movement of the partab[e plant.
10. This authorization is in the interest of public safety and welfare and is not intended
to set any precedent for fuRher amendments or modifications to the Special Use Permit
for any future projects of Elam Construction,Incorporated.
