HOUSING UNIT

RECITALS
1. Shelley Burke(hereafter"ApplicanY')has applied to the Pitkin County Board of ;:
County Commissioners (hereafter `Board") for Special Review approval and a GMQS
Exemption to fully deed restrict an illegal"bandiP'dwelling unit to comply with affordable
.� hot�sing guidelines.

2. The Burke property is located on 2262 Snowmass Creek Road, more specifically
described in Exhibit"A,"attached. It is zoned RS-30 and contains approximately 70
i acres. �

� 3. The Btvke parcel contains a 3,200 square Foot primary residence,a 680 square foot
' bazn/tack room and a 1,488 square foot employee caretaker dwelling unit which was
constructed in 1993.
4. The Board of County Commissioners granted 1041 approval for the two bedroom
employee dwelling unit on the Burke property pursuant to Resolution No. 93-46. The
employee dwelling was approved as a two bedroom unit to house not more than four
� occupa��ts.
5. The building pemiit tl�at was issued for the unit approved one two-story single
family residence witli an upper and lower level floor pl�t The main level contained a ,
bedroom,batiuoom,kitchen, living room and dining room. The lower level contained a •
bedroom, bathroom and a family/rec room which contained a bar si�ilc. Approved plans
indicated an interior staircase fi•om the main level to the lower level.
Subsequent to die issuance of a Certificate of Occupancy for the unit,a 220 electric line and �
stove was added,and 188 square feet of (non-habitable)storage space was converted to
(habitable) office space on the lower level. These improvements were made without �~'
pennits. Interior access to the lower bedroom was not constructed as it had been depicted �

6. Having reviewed the application at a regalarly scheduled public meeting on May
- 28,1996,the Planning Commission recommended approval of the application to the �?" �
Board of County Commissioners. -
7. The Board considered the request at its regularly scheduled meeting of September r

25,1996,at which tinte evidence and testimony were presented with respect to this '
app[ication.

8. The Board finds tUat there will be an overall commuuity benefit resulting from tlie E.
. addition of a fully deed restricted category w�it on this property,and tl�at the request is
' generally in compliance witll applicable sections of the Land Use Code. ,
. NOW, THEREFORE, B� IT R�SOLVED by the Pitkin County Boazd of t°`
County Commissioners that it does hereby grant approval of the Burke GMQS
Exemption and Specia[Review for an affordable housing unit subject to compliance witl�
the followiiig conditions:
� 1. The Applicant shall adhere to all material representations made in tha application
� and in tl�e public meetings.
2. Within 30 days of the Board approval,the flpplica�it shall file a Category 3 price,
income and occupancy deed�estriction for die bandit unit widz the Housing Office,
and revise the deed restriction for the voluntary employee dwelling unit to reflect
that occupancy of tUat unit sUall be limited to two employees(rather than four,
originally contemplated for a two bedroom unit}.The voluntary employee dweiling ,
unit shall be fully deed restricted commensurate witU tl�e Category 3 rental rates, ' •
income and occupuicy guidelines identified in the Housing guidelinas in effect at
the time of deed restriction. Current floor plazis for both units shall be submitted to •
the Housing Office upon filing of the deed i�estrictions.
3.. Within 30 days of the Board approval,the applicant shall apply for required permits
to address the foltowing building and elech�ic Code violations:The change in ase �-
fi•om storage(non habitable space)to o�ce(habitable ase);the installation of 220 `; ��
elech•ic for the stove;atld tl�e separation of one unit into two units,(which requires

proper fire separation). The kitchen in the bandit unit shall also be reviewed and/or ,,^ �
inspected to ensure that it meets the m'vumum requirements for a kitchen as defined ,_�,
in the Housing Authority Guidelines. All deficiencies identified by tl�e Building
Inspector and Housing Office shali be conected within 90 days of the inspection. '��':
4. All material representations made in the application and in public meetings shall be
adhered to.
