RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY COLORADO GRANTING APPROVAL TO PHYLLIS '
AND GRAFTON SMITH TO CONSTRUCT A FULLY DEED RESTRICTED ~�
EMPLOYEE DWELLING UNIT WITHIN THE MAIN RESIDENCE ON THE :.;;

RESOLUTION NO.96�$
Recitals
1. Phyllis and Grafton Smith(hereafter"Applicant")have applied to Pitkin County to . ,
amend the Housing Commitment for the Silverbrick Growth Management Quota .
System(GMQS)application.
2. The property is legatty described as shown on Fachibit"A"attached.
3. The Applicant had previously committed to pay a cash-in-lieu fee for one Category
One Employee Dwelli�g Unit and now requests approval to construct the unit rather
than pay a cash-in-lieu fee.
4. The Aspen/Pitkin County Housing Boazd has expressed a preference for the
' construction of on-site housing over the collection of cash-in-lieu fees.
5. 'The Pitkin Counry Planning and Zoning Commission reviewed this application at
• their regular meeting on May 28,1996,and recommended approvat of this application
subjectto conditions.
b. The Boazd reviewed this application at a Public Heazing on July 31,1996,at which
time evidence and testimony was presented with respect to this application
NOW THEILEFORE BE IT RESOLVED by the Board that it hereby approves an
. amendment to the Silverbrick GMQS application subject to the following conditions: .
1. The Applicant shall adhere to all commitments and representations made with regard
to this application.
2. T'he Affordable Housing unit shall be]ocated within the principal dweLling and be
. included within the allowed Floor Area Ratio approved for this site so that visual
impacts are minimized.
3. The applicant shali comply with the following recommendations of the Housing
Office:
• The unit shall be a totally private unit;i.e.,have a privaYe entrance.
! • This unit shail be fully deed resiricted to Category]. The deed restriction
would need to be recorded before building permit approval.
• The kitchen shall cotttain at least a four-bumer stove with oven,standard size
sink and contain at least a 6-cubic foot refrigerator,per the definition of a
