RECITALS .

1. William J.Terman(hereafter"Applicsint")has applied w the Pitkin County$oazd of

County Cornmissioners(hereafter`Boazd")ro coRSider an extension of vested real properry -
rights pursuant to 5ection 4140-30.
2. The Appiicanrs were grac►ced Generai Submission approval by Board Resolution No.90-
165 and l041 Hazard Review and Scenic Overlay Review approval by Resolution No.PZ-90-40.
3. The subject property is locaced on the south side of Wrights Road,and is described as ait

; those parts of Lots 11,12 and 13,Btock i,Red Mountain Sabdivision.
4. The Board considered rhe request at its reguiazly scheduled meedng of January 10,1996,
� at which time evidence and testimony was presented with respect to this application.
" 5. The Boazd determined that the proposad development meets the criteria established in
Section 4-140.30 of the Land Use Code,and,therefore,found the extension to be appropriate.
NOW,TTiEREFORE,BE IT RESOLVED by the Pitkin County Boazd of Counry
Commissioners that it does hereby grant an eztension to the vesting period for the Terman '
propecty until August 7,1997,subject to compiiance with the following conditions of approva[
and the conditions of approval as noted in Planning Commission Resolution No.PZ-90-40 and

1. The applicant shall comp(y with the fotiowing standards for development on slopes of
greater than 3090:
A. Adequate mechanical suppore shall be provided for cut stopes:
B. Addina water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided.
D. Disturbed slopes must be contoure sot that they can be revegetated. _
E. Steepening of exisring slopes shall be avoided. •
F. Co�ne cuts,fills,grading and excavation to the minimum area needed for �
consizucdon.
2. The applicant shail comply with the following landsc�ping and wild£u�e defensible space
mitigation standards:
A. Brush,debris,and non-ornamental vegetarion shall be removed within a minimum
10 foot peritneter around the structute.
- B. Vegetation shail be reduced to break up the vertical and horizontal continuity of the
fuels a minimum of 80 feet on the downtrill side of the residence and up to 50 feet
on the sides and ups1ope side of the residence.
C. Spacing between cl¢mps of brush and ve�etation within the perimeter noted above
shall be a minimum of two times the height of the fuel. Maximum diameter of the �
ctumps shall aot exceed i0 feec. All measurements shall be from the edges of the
. crowns of the fuel.
D. All branches from trees and brush within the perimeter noted above shall be pruned
to a height of 10 feet above the ground and ladder fuels ftom azound trees and bmsh
shall be removed.
E. Tree crown sepazauon within the perimeter noted above shall have a minimum of 10
. feet between the edges of the cmwns.
F. All branches which extend over the roof eaves shall be trimmed and all branches
within I S feet of the chimneys shall be removed.
; C:. Tha density of fuels within a 1Q0 foot perimeter of the struciure shall be reduced.
H. All deadfail within the 100 foot perimeter shall be removed.
L The applicant shall be respo¢sible for the conunued maincenance of the defensible
space vegetation requirements. .
3. The applicant shall comply with the following additional wildfire miti�ation standards:
A. Roof construction shall be Class A,non-combusuble material with no flat roofs.
B. Vents shall be screened with cotrosive resistant wire mesh with mesh'/a inch `
maximun. "
C. Roofs and gutten shall be kept clear of debris. �

4. The applican[shalt compiy with the following Structiu�al Design and Consuuction Options:
A. Projecuons(Heat Traps):
1) Projections at the roof line(which include but are no[limited to eaves, ��
cornices,so�ts and roofs over open decks)shall be sheathed with i
materials approved.for t hour fire-resistive construction.
2) For projections below the roof line(which include but aze not limited to
exterior balconies,decks,porches,cantilevered floor projections,and bay
windows)the open space between grade and the underside of projections
below the roof line shall be enclosed by solid,verrical wails.These walls +
shall be constructed with mazerials approved for 1 hour fire-resistive 3•
construction on the exterior side of the wall and shatl extend from the top .,° '
of grade to the underside of the floor decking or walls of the projection.

Land Management Dapamnent for review and approval. Land Management may require
financial securiry to ensure that the landscaping is successfully completed within one yeaz
after compleaon of c�nstruction of the residence.
. 8. No developmenG includin;�adin;and vegetation removal or disturbance,shal3 occur
outside of the approved buiIdin;envelope,except for utility and driveway extension sutd
maintenance,and as may be necessary to implement the wildfire miti;auan measures
required elsewhere in this dacumen[.

provisions of the Pitkin County Iand Use Code in effect at tho time of this appmval,except
