Juliet Shield(hereafter"Applicant")has appiied to t[�e Pitkin County Board of County 1 � Commissioners(hereafter"Board'�to considet an extension of vested real property rights pursuantto SecGon 4-140-30. 2. The Applicants were granted General Submission approva]by Boazd ResolutionNo.91- . 34 and 1041 Hazard Review and Scenic Overlay Review approval by Resolution No.PZ-91-17. 3. The subject property is located east of Aspen,and is more specifically described in i . ' Exhibit"A". � 4. The Board considered t[ie request at its regulazly scheduled meetings of January 10 and j September I 1,1996,at which fime evidence and testimony was presented with respect to this � application. , ; . 5. The Board deternuned that the proposed development meets the criteria established in I Section 4-146.30 of the Land Use Code,and,therefore,found the extension to be appropriate. NOW,THEREFORE,BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant a three year extension of the vested righYs for Juliet � Shield,subject to compliance with the following co�ditions of approval and the conditions of Planning Commission Resolution No.PZ-91-17 and Board of County Commissioners Resolution No.91-34,except as amended below. �� _. _ i �a.k�, i �` s � �, .. i• • .;:'�: - . , . The applicant shall comply with the following standazds for development on slopes of greater than 15%: ` �, � : A. Adequate mechanical support shall be provided for cut slopes. �.-;; B. Adding water which may decrease slope stability shall be avoided. '. C. Adding weight to the top of the slope shall be avoided. D. Disturbed slopes must be contoured so that they can be revegetated. B. Steepening of existing slopes sha[1 be avoided. ' F. Confine cuts,fills,grading and excavation to the minimum area needed for construction. ; ;. . 2. The appficant shail comply with the following landscaping and wildfire defensible space mitigation standards: A. Brush,debris,and non-ornamental vegetation shall be removed within a minimum 10 foot perimeter around the struchue. B. Vegetation shaii be reduced to break up the vertiaal and horizonta]continuity of the � fuels a minimum of a 30 foot perimeter azound the structure. C. Spacing between clumps of brush and vegetarion within the 30 foot perimeters shall be a minimum of two times the height of fhe fueL Maximum diameter of the . clumps shall not exceed 10 feet. Al]measurements shall be from the edges of the ' crowns of the fuel. D. All branches from trees and brush within the 30 foot perimeter shall be pruned to a I height of 10 feet above the ground and ladder fuels from around trees and brush shal]be removed. � E. Tree crown separarion within the 30 foot perimeters shall have a minimum of 10 � , feet between the edges of the crowns. � F. Atl branches which extend over the roof eaves shali be trimmed and all branches within I S feet of the chimneys shall be removed. G. The density of fuels within a 100 foot perimeter of the structure shall be reduced. H. Alt deadfall within the 100 foot perimeter shall be removed. , L The applicant shall be responsible for the continued maintenance of the defensible � space vegetation requirements. � 3. The applicant shall comply with the following additional wildfire mirigation standards: A. Roof construction shall be Class A,non-combustible material with no flat roofs. B. Vents shall be screened with corrosive resistant wire mesh with mesh'/,inch • maximun. C. � Roofs and gutters shall be kept cleaz of debris. D. Yards shall be kept clear of all litter,slash,and flammable debris. �' E. All flaznmable materials shall be stored on a parallel contour a minimum of 15 feet away from any shucture. � F. Swimming pools shall be accessible to Fire Department vehicles. - �� I. Fences shall be kept clear of brush and debris. ��,�. J. Wood fences shall not connect to the structure. K. Any outbuildings or additional structures shall adhere to the same standards as shuctures. �z: L. Fuel tanks shall be installed underground with an approved container. !' '" ' M. Propane tanks shall be installed according to NFPA 48 standazds and on a contour ':r.�`: away from the structure with standard defensible space vegetation mitigation around , , any above-ground tank. Any wood enclosure around the tank shall be consWcted _ • with materials approved for 2 hour fire-resistive construction on the exterior side of . the walls. � � N. Each siructure shall have a minimum of one 10 pound approved ABC fire : extingwsher placed in a visible and accessibie tocation. � O. Addresses shall be cleazly mazked with 2 inch non-combustible letters and sha[I be visible and installed on a non-combustible post. P. Utility lines shall be buried. . 4. Once the location and design of the residence is determined,a detailed mckfall anatysis ` . should be performed by a qualified professional geologist or engineer. The analysis shall be reviewed and approved by the Colorado Geological Survey prior to issuance of a building permit. The Community Development Department shall review and approve the mitigation plan prior to issuance of any building permits,and the applicant shall comply with any specific mitigation measures recommended by this analysis. ;�= _ 5. A site specific drainage pian prepazed by a qualified civil engineer shll be approved by the County Engineer Qrior to issuance of a building permit. 6. A driveway permit shall be reviewed and approved by the County Engineer prior to issuance of a buitding permit. � 7. The applicant shali meet the requirements of Section 10.301 of the 1988 Uniform Fire Code. i 8. The driveway shali not be heated by energy obtained from depletable sources as defined by the Aspen/Pitkin Energy Conservation Code adopted January 10,1996. 9. No development,inciuding grading and vegetation removal or disturbance,shall occur outside of the approved building envelope,except for utility and driveway extension and maintenance,and as may be necessary to implement the wildfire mitigation measures required elsewhere in this document.
