1.David Parker,hereinafter,"ApplicanY',has applied to the Board of Counry '
Commissioners of Pitkin County,Colorado,hereinafter,"Board",for approvai of a 1041
Hazard Review pursuant to the Pitkin Caunty Land Use Code. -
2. The subject property is located between Dorais Way and the Crystal River and is more
specifically described in Exhibit A,attached.
' 3. The Planning and Zoning Commission reviewed this application on 5eptember 17,
1996,and directed staff to forward a recommendation of approval to the Board.
4. T'he$oard heard this application at a regulazly scheduled meeting on December 4,
� 1996,at wi�ich time evidence and testimony was presented with respect to this
application.
5. The Boazd determined that the proposed activity meets the applicable criteria
� established in Yhe Land Use Code,provided the condi6ons listed in this resolution are
; . adhered to.
� NOW,THEREFORE,BE TT RESOLVED by the Board of County Commissioners
of Pitkin County,Colorado,that it does hereby grant approvat of the Pazker 1041 Hazard
Review subject to the following conditions:
" 1. The applicant shall adhere to all material representations made in the application and.

� 2. Prior to building permit application,Uie app[icant shall record a 24"x36"mylaz 1041
! Hazard Review Site Plan which meets the approval of the Community Development
Department and the County Attorney. The site plan sha11 include the foliowing 1041
� Hazard Review Waming, Disclaimer and Acknowledgment: "1041 Environmental
Hazard Areas exist that might affect the property,any improvements,and the use and
occupancy thereoP'.
The site plan shall also be submitted in a digitai format for integration into the County
GIS sysfem.

3. 'The proposed driveway shail meet Pitkin County standards For access drives. Tlie ' ��.'�
applicant shall obtain an access permit from tlie County Engineer prior to
cammencement of construciion of the driveway. Any retaining structures associated
with the driveway shoutd be indicated;showing proposed height,length,and building
- material. A driveway envalope shall be designated on the site plan. The driveway
cannot exceed 30" above naturai grade within required setback areas without a '�..�
variance from the Board of Adjustment.
4. Building foundations shall be reviewed and certified by a Colorado registered
? professional engineer. Foundation plans shall be submitted at flte time of building
permit application.
5. Adequate mechanica(support shall be provide for cut slopes.
6. Adding water which may decrease slope stability shal!be avoided.
. 7. Adding weight to the top of the slope shall be avoided.
8. Disturbed slopes shall be conYOUred so they can be reve�etated.
9. Steepening of existing slopes shall be avoided. f
10. Confine cuts, filis, grading and excavatian to the minimum area needed for
' construction.
; � 11. The home should be designed to prevent the accumulation of radan gas.

, j 12.The applicant shall submit a drainage and erosion control plan which meets the
approval of the County Engineer, prior to the issuance of a building permit. In
� addition to addressing permanent drainage and erosion control measures, the plan
j shall include temporary erosion control measures for construction to prevent soil and
sediment from impacting the Crystal River.
13.The buitding site sha11 be revegetated with native vegetation to limit water �
consumption and additional runof�'within one growing season of project completion. '
All drainage from roofs and paved areas shall be detained on site.
14.No development,including grading or landscaping or vegetation removal shall occur
outside of the approved building envelope except as may be necessary to implement `
the wildfire mitigation measures and the extension of the access driveway. Tlus
includes landscaping,well,and septic systems. �,

T'he envelope extends into the set6ack areas on the north and south and east. These -
portions of the envelope cannot be used for above ground structures.
15.Prior to issuance of a buiiding permit,the appiicant shall provide documentation of an
adequate domestic water supply. Quantity and quality of said supply shalt meet the
approval of the Environmental Health Department. Any wells must meet
environmental setback requirements and be within the apQroved building envelope.
16.The septic system for the development shalt meet the approvai of the Environmental
Health Department. The applicant shall obtain such approval prior to the issuance of
a building permit. The sewage disposal system must be located witl�in the building
envelope and meet all environmental setback requirements.
17.Outside illumination shall compty with County lightin�standards in effect at the time
of building permit issuance.
18.The applicant shall obtain a fireplace/wood stove penmit with the Environmental
,
Hea(th Department prior to the issuance of a building pemrit.
� 19.'The applicant shall implement the following measures to mitigate impacts to wi[dlife:
a.The homesite shall be on the toQ of the bank.There shail be no construction
within the riparian azea.
b.Native vegetation outside the building envelope shail be maintained.
c.No horse grazing shall be allowed within the riparian or lower bench area.
� ' d.Any fencing shall be 42",4 strand or less with a IZ"kickspace between the top
� two strands. Any rail fencing shall be the round or solid rail type,42",3 rail or less
with at least 18" between two of the rails. Current fencing shall be brought into
compliance.
e.Any horse hay shail be fenced with 8'mesh game proof fencing. ;
f.There shall be a one dog Iimit with a kennel restriction. The kennel shal{ be
canstructed before a certifieate of occupancy is issued.
g.All irash shall be in approved bear proof gazbage wntainers.

h. Except as required by the wildfire mitigation standazds, dead trees shall be :;•
retained as habitat for cavity nesting birds,birds of prey,and smatl mammals �.
20.The applicant shall compiy with the foilowing wildfire mitigation measures:
� a. The area azound the structure shall incorporate landscaping with wildfire ,
defensible space considerations as follows:
(NOT'E: Actual vegetation manipulation to meet these conditions may not be
necessary where the natural vegetation pattems have already fulfiiled these
conditions.)
1)AII brush loeated downhill from the structures shall be tl�inned for a distance
of 30 feet from the buiiding envelope edge. $rush, debris, and non-ornamental
vegetation shall be removed within a ininimum 10 foot perimeter around the
remaining sides of structures. In this 10 foot perimeter vegetation shall be maintained
at 6 inches or less.
2)Vegetation shall be reduced to break up the vertical and horizontat continuity
� of the fuels a minimum 3Q foot perimeter azound a structure built on flat ground. (For
greater slopes ref.CSFS Safety Zone chart,Page 13,Wildfire Guidelines For Rural
; Homeowners.)

defensible space vegetaYion requirements.

7)Each structure shall have a minimum of one 10 pound ABC fire extinguisher

be visible and instatled on a non-combustible post.
9)The driveway shall be a minimum of 12 feet wide with minimum inside turning .
radius of 33 feet.The maximum grade should be limited to 12%.
10)The main access road should incorporate tumouts every 400 feet.
20.Any utility extensions shail be underground in Yhe road.
