TH1RD READINC ON APRIL 30 1996--Gary Esary asked that[he Boarcl refer to his agenda item
summary with regard to this matter. lie proceeded with his presentation as outlined in this memorandum.
A copy of this memorandum is attached hereto and made a part of this record as F.XHIBIT"B" Y
Esary noted that the deadline for payment by the rental car companies was April 16th. All five companies .
submitted checks for$59,000,but two ofcompanies submitted checks with cooditions that limited their
ability to deliver[he checks to the escrow agent. One of those conditions cleared as of yesterday,but there '
is one company that haz not cleared the condi[ions to deposit their check. Airport staft's recommendation
. is to pass the Ordinance approving the license and use agreements at this time,but to establish additional
conditions for each of the companies as follows:
• With respect ro[he Budget agreement,a condition that Budget be given an additional period of time
(hvo or three days at a muaimum)to enable them to ciear the canditions on the escrow agreemeni and
let that check be cashed.
• With respect to Eagle Rent-a-Car,that cnndition was going to be su�ested,but it is his understanding
that since last night,Eagle has in fact,agreed to clear the escrow. This leaves one condition
_ outstanding tfiat is compliance with the disclosure requirements with respeet to inter-locking
ownership. •
. With respect to the other three companies,the conditions would be ro make sure that the conditions on
Eagle and Budge[clear because the bid is predicated on there being five on-airport operators. If in �:
fact,Budget does not clear its escrow and staff winds op recommending to the Board that they will
forward only four operators. There will have ro be new bids because all the bids they have received
have been based on five opera[ors. Staff's recommendation is to give Budget an extension of hvo
more days.
Commissioner Ireland requested information on how much revenue is lost on rental cars that dodt pay
their parking tickets.
Esary responded that it is his understanding that when people get notices from the City of Aspen through
the rental car companies,that they owe for a ticket that the response is quite good. Also,some of the
companies have established a policy that if the ticket is not paid by the individual person that they wind up
paying it themselves and trying to collect it throuoh a credit card transaction or some other way.
Commissioner Ireland requested some numbers on that so that he can provide some reassurance to the
public.
A discussion ensued with repard to this issue and whe[her or not enforcement Ianguage should be added[o
the agreements.

is time to get on with it. If they don't get their agreements or get the Board to extend their cuaent
agreements then what they bid on,is a mute point. �:

Further discussion ensued with regard to whether or no[a provision shou(d be put in the contracts that the
rental car companies will be responsible for paying unpaid parking tickets nnd collect from the renters.
Commissioncr lrcland moved an nmendment to this to provide n provision in tl�e contract that the .
car companies will be primarily liable for paying parking tickets under tlie agreement. That there
wili be t6e ability to waive that responsibility on a finding by the Airport Direcror that a good faith
effort�vas made by the car company to collect the parking tickcts from the renter of the car. - •
My Boyd suggested that if thcre is a changc,that thc rcntal car companies bc notified of such a
change because it could change their bid.
Commissioner Lamont seconded the motion. Tlie motion passed unanimously.

Ely said there was one change From first reading and thaY was to specifically call out that the use of this
would include purposes for water utilities and that language haz been included in[he amended easement
agreement.

Doug Smith,a resident of the W/I Ranch,requested that the Board give a high priority ro the
pedestrian/bicycle path irail through the Woody Creek area because of the safety factor.
Mr.Smith was advised thai the Bnard will check with Tom Newland to see what priorities are being looked
at and if at ail possible,try to expedite construction of this hail.
Teresa Olson,a resident of Lazy Glen Trailer Park,appeared before the Board to appeal to the mora[orium
, on buildine permits that prevents her from upgrading her home in the park. She noted that the
homeowners'association have approved her plans for an addition to her home.
Cindy Houben,Community Development Director,reminded the commissioners that the Board of County
Commissioners has a policy now that they would not allow any new building permits in Lazy Glen,until
sucli time that the rezoning has been completed.
Ms.Olson was advised that the Lary O Traiter Park is a matter scheduled on the agenda tonight and that
would be the appropria[e juncturo for her to comment.
There being no further comment, Chairman True closed the public comment section of the meeting.

Tom Smith,representing the applicant,proceeded tvith his presenta�ion by giving the hisrory and the
background associated with Ntie owners purchase of tl�e mobile home park. He said[he reason they are
here tonigfit is that the residents want to controi d�eir own fate and own their lots individually and have the
benefits of individual property otivners associated with that. Also,he thinks Ihat�vill also provide some
incentives for upgrades of the park and on-voing improvements and maintenance of the park.
In[erms of the infrastructure,Smith said there are problems with it in terms of 1he infrastructure due to the
age of che parl:,and there are some limitations on their ability to achieve compliance with certain standards
of U�e mobile home code because of the existing conditions.

With respect to additiona!development,they are not proposing additional development as far as tBis �
application. Although in attempting ro address the concems about the infrastructure,at some point it
becomes apparent that they are dealing with substantial costs to upgrede the infrastrucmre in the park i.e,.
$400,000 to hook up to the Basait water system and approximately$600,000 for sewer connection not
including tap fees. 'i'herefore,they need to look at the potential for funding this and there may be no '�
solution but ta iook at the greenhouse parcel,which is curcently under lease for a future use of that
property.
Wiih respect to the septic system,Smith said there have been occasional exceeds of t6e Iimitations of the
discharge permit,(during spring runof�but it is not an ongoing problem. There are some probiems with
meeting the design standards for the state because it is an older faciiity,but as long as they meet efFluent
limitations,it is not an enforcemen[issue. He snid they would request that the condi[ions of approval not
specify that they have to come up with a solution to connect to the Basalt Water Sanitation District. .
However,they have no problem investigating this as ao option. �
With respect to the flood plain,they recognize that there will be some need to address the berms. He said
raising the homes is of serious concem to the residents of the park because of d�e practical consideration
involved and the cost involved.
A resident of the park explained that the cost associated with raising a hame would be approximately
$1,000.
Commissioner Ireland asked Smith what they propose for fieight?
Tom Smith responded that they have come up with some preliminary numbers of design standards to
address this issue. Wl�at they propose is a 14 foot height for flat roofl f 8 feet for peak roof. Setbacks of 10
fee[for side and a rear setback of 20 feet FAR Gmi[ation of 35 of the square footage of the lot with no
below grade construction.
Commissioner Ireland suggested to the applicants ihat they might look into forming a special district to _
fund their ittfrashucture improvements.
Smith continued 6y stating[ha[with rospect to the deed restriction,they dn have enforceable restrictions
for ownership and occupancy in the covenants of the association and will eoforce those as interests in the
azsociatian tum over by sale. W ith respect to the old house,they are willing to iook at whether it makes
sense to put a deed restriction on that now. He noted that one of the suggestions that have been made is,
given the small size of some of the lots,is including an ability for adjacent lot owners to purchase adjacent
lots upon voluntary sale, T6at would provide them with the opportunity for more attractive lots and lots
that aze more conforming in terms of the County Code.
It was[he consensus of commission members that if this is structured propuly it could work.
Commissioner ireland noted that with respect ro Aspen Viltage,the Board conditioned that parts of the
covenanis run tivith the BOCC bein�the beneficiaries so[hey would have the ability as well to enforce the
County type issues,which are the height,butk and roommate limitation.
Smi[h said the conditions of approval,as recommended by the Planning Office,are acceptable,but he
would suggest a couple of amendments. He said they are requesting a waiver of the application fees in
order to help them ou[�vith the cost of the applicatiort.
Chairtnan True opened the hearing to public comment. He nored that there was one comment brought up �.

One of the residents,who is in the audience;brought up that she attempted to get a building permit for an -
expansion of her unit. Artd because of the moratorium she is unab{e to go fonvard with her addition. He

noted[hat Ms.Olson said the homeowners association had approved her addition. He questioned Smith as �
to whether or not he has a position on that issue. ' 1
A representative of the homeowners association said Ntat she thinks this situation was slightly ;
misrepresented because they did not receive approval for Nie addition from the homeowners association
because the addition esceeds what they would penniC
A discussion ensued as to whether or not the moratorium should be lifted.

It was agreed that staff will be asked to come to a work session to explain the code challenges and also
explore opportunities of�vhether Board of Adjustment variances can be sought in the in[erim while the -r
subdivision applications are proceeding,and what other reviews may be possible under the nonconfonning
sectioas of the code. - "

Smith rcferred to Condition No.4. He requestcd an amendment at the cnd of the second line that •

Authority.

Ellen Sassano explained that the Flood AJministrator has recommended that flood insurance be
obtained by all homeowners. She suggested that iY could be changed to sny,with some type of timing
mechanism,that flood insurance be obtained by al 1 homeowners. l

We are writing in opposition to HB 1109 as amended by Sen.Blockensderfer on Aprii
23rd. Any revenue loss to counties due to exempiion of business personal property must '
be backfilled by state genenl funds. Not to do so and to shift this responsibility to �:t'
counties is an unfair burden to local government and creates an especially critical �
situation for"poor"counties. Lost revenae is not easily replaced and the Bill would �
greatly impact many counties'ability to provide services. �
We strongly agree with the position of Colorado Counties,Inc.,that encourages the g
legistature to support a broad examination of Colorado's state and local govemment .
finance mechanisms and that the issues addressed by HB 1109 be postponed until this can E ,�
be done by the Legislature,business community and local govemments.
We urge you to please vote no on HB 1109.

ACCESS: The property is accessed from Red Mountain Road on a private road easement through
Lot 5. The applicant proposes to access the garage%aretaker unit on a new driveway frorn the
private road. Extending a driveway to the accessory structure from the existing driveway to the
residence would require removai of some of ihe existing trees. �:
SITE/PROJECT INFORMATION: The 1975 subdivision approval provided a 250d square foot '
"building site". The existing primary residence is located in the approved building site. The �•

related accessory buildings were located. The Board found the reZOning necessary to
"insure the continuance,upgrading and improvement of this vitai low and moderate
income housirt�resource..." The portion of the property containing the Lazy Glen
Greenhouse was not rezoned to SR and continues to be zoned AFR-10. The 1.9 acre
Greenhouse/Nursery parcel is leased out by the Homeowners Association and •
contains a nursery and landscaping business and a single family residence which has
been converted to 2-4 apartments. The nursery is an approved Special Review Use.
• Pursuant to Resolution No.83-55,the BOCC approved the expansion of the pazk co
allow for the addition of seven new mobile home rental spaces and the relocation of
two existing trailers. The expansion area was rezoned to PMH and was therefore "

Sewaee Treatment-The Association is in the process of master planning improvements %

for their wastewater treatment facility. The existing sewage lagoon has exceeded State
Department of Health effluent limitations several times. The facility is deficient with
respect to compliance with design criteria established by the State. Compliance with the
State Design Guidelines is not mandatory as long as the facility maintains compliance
with the discharge permit. The applicant's engineer recommends that the foliowing
improvements be made to bring the facility into compliance with the design criteria: '

According to the State Health Department,the facility is operating at above 80%of its
design capacity. The terms of Lazy Glen's discharge permit stipulate that,"the permittee
is required to initiate engineering and financial planning for expansion of the domestic i.�.'
wastewater treatment plant works whenever throughput and treatment reaches 80 percent ;.r.�
of desi�n capacity." As an alternative to owning and operating their own plant,the
Environmental Health Department and the State Depar[m�:nt of Health recommend that .
Lazy Glen connect ro the Basalt Sanitation District as soon as it is economically feasible � .
[o do so. The$asalt Sanitation Dis[rict is not opposed to the connection. Lazy Glen is
not currently in their district,but does not have to be contiguous ro the District to connect.
The biggest obstacle is the cost of the main line extens;�n,as there is no contiguous
development between the end of the existing main and;_:zy G1en. In the event that
Holland Hills and/or the proposed golf course were to connect to the District,the line ,
�vould be closer to Lazy Glen,but there would still be a gap. A preliminary estimate i,•
prepared by[he applicant's engineer indicates a cost of approximately$592,032 to '
connect to the District. While no referral comments were received from the Town of
Basalt,an informal discussion with the Town Planner indicated that the Town would not �
� be opposed to the connection.as they have some concem about the water quality f
implications of the sewage lagoon,given its proximity to the River and high groundwater '
tables. They also acknowledge that from a regional standpoint,the State and local �
Govemments are discouraging the proliferation of individual package plants. Staff "
recommends that the applicant pursue cormection to the Basalt Sanitation District,and � `
provide a work-pfan at Detailed Submission which outlines a projec[ed time-line for
connection and in[erim measures for addressi�g deficiencies in the system.
Roads-The Park roads do not comply with design standards established in the Mobile
Home Park regulations for right-of-way width,drivin� .,urface width or cul-de sac radius. �
As this is an existing development,it would be diffict .to widen the streets without
encroaching on existing off-street parking areas,storage areas and trailers. As the roads �
are apparently functioning in their current configuration �nd the fire District has not ,
indicated any difficulty with street width,Staff recomme„ds that no improvements be
required at this time.If and when roads are reconstructed,they should be done in such a
manner as to provide proper drainage of on-site runoff,and brought into comptiance with
County road standards to the extent possible. One interim solution to draina�e may be to
slightly raise the elevation of the roads so that water will drain away from the paved '
surface and shoulder. '
As CDOT proposes to 4-lane the Highway at some time in the future,and add accel,decel
lanes and a widened entry to the park,any future development should be placed so as not

dry hydrants. This distance is accepcable to the Fire Protection District. The applicants :�
. have already placed addresses on the trailers,as requested by the Fire District.The Fire
Chief indicates that one of the four dry hydrants(there are two on the duck pond and two �
on the River)is not in workin�order. Staff recommends tha[the applicants work with
the Fire District and provide a status report at Detailed Submission as to whether the
hydrant must be replaced or if the existing working hydrants are adequate.Staff also #�
recommends that covenants restrict on-street parking to ensure fire access,and prohibit
landscaping and parking in the emergency access from the greenhouse area.
Trails-There is a fenced off walkway between Lots 25 and 26 that provides access to[he
River for Park residents. Staff recommends that an easemen[for this access be delineated
on the Plat. If no fishing easement exists on the River where it traverses the property, � 8
Staff recommends that the applicant provide a public easement through the River.
Affordable Housine- In accordance with the basic documents of the Association,
homes and lots must be owner-occupied by employees in the Roaring Fork Valley.
Resolution No.83-55 approved the expansion of the Pazk to include seven additional
mobile home rental spaces in 1983. The approval was subject to PMH Rezoning which :�'
required the deed restric[ion of those units to low and moderate employee housing �
guidelines. The intent of the MHP Zone District is to provide income and price
restricted,affordable detached housing. In order to ensure that the Park continues to �
provide low and moderate income housing,and to comply with the intent of the District, ;.;
Staff recommends that all of the units be deed restricted. Comments from the Housing �;;

aparcments. The nursery is an approved 5pecial Review Use. The preliminary pJat ;,

"Parcel A," As little information has been provided with respect to this parcel,Staff
recommends that it not be subdivided off at this time,and that it be identified as art area

standards established as part of this subdivision approval.
Planned Unit Devetonment
Section 3-270.30 of the Land TJse Code states that PUD procedures may be used to vary
the Mobile Home Park Standards for pre-existing mobile home parks to the extent that
health and safety standards of the Code are not compromised.
• Fifty-four of ihe one hundred lots do not meet the minimum lot size requirement of
5,000 square feet. As this is an existing development,Staff recommends that the
applicant vary the lot size requirement through the PUD process,and that at Detailed
Submission the applicant specify proposed lot size variati ,in addition to any other
variations[hat are rec•�ested.
• In the event that lot o.:ners wish to build single family resic._.iees or prefabricated
homes on their lots in the future,Staff recommends that the applicant pro�•ide

Thank you for your referral memorandum dated September 7 2, 1995 requestina our
comments on the referenced project. The appiicant seeks to use a 30.9 acre property for a -
100 lot mobile home park, located approximately three miles east of Basait,Colorado. The `,;_
proposed water supply will be from two wells,whose permit numbers are not stated in the �
submittal.
Pursuant to Section 30-28-136(1)(hl(D,C.R.S.,the State Engineer's Office offers the
foliowing opinion for your consideration regarding material injury to decreed water rights and
the adequacy of the proposed water supply of the subject development:
1. Our records show that our office issued two permits, 17306-F and 11307-F, on
November 1 O, 1966 to the mobile home park for two wells that were constructed in
October 1966. We presume that these are the wells referred to in the submittal.The
wells are producing ground water which is tributary to the Roaring Fork River and
Colorado River systems,which are over-appropriated at this location. There is another
existing well, permit no. 40382-F, recorded to Lazy Glen,Inc., and the 8asalt Water
Conservancy�District pursuant the decree granted by the Division 5 Water Court in
Case No. 83CW139. If the wells are operated pursuant to the conditions of the •
permits and the diversions from the wells and the consumptive use are limited to the
historic amounts, and if the wells are operated pursuant to a Water Court approved
augmentation plan, then injury to other water rights will not likely to occur.
2. We are unable to comment on the adequacy of the water supply without an ,.
engineering or geotechnical study documenting the physical availability of ground _
water for the proposed uses. As outlined in the statutes, Section 30-28-133(3)(d),

The Aspen/Pitkin Environmental Health Department has reviewed the
details of the Lazy Glen Mobile Home Park application under the
authority of the Pitkin Countv Land Use Code and has the '
following comments relative to the water system, the sewage I�
disposal system, and air quality. .
' ADEOUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the poliey of the County to insure the availability of a weter supply of adequate quatity, quentity,
pressure e�d deperdebility for fire procecxion and support of a proposed Lard use prior to approval of the
use. The County shell require land uses to hook up to existing publ5e syste� if service is aveiteble."
The Lazy Glen Mobile Home Park is serviced by two wells. The
quality of the drinking water is monitored by the Colorado
Department of Public Aealth and Environment on a monthly basis.
Although this Department has not been notified of any unsafe
levels of bacteria, the proximity of the wells to the duck pond
has raised concern.
As noted in the application, low water pressure has been '
experienced by some of the homes that are serviced off the same
line. At times, the entire water system has to be shut down to
isolate leaks and service repairs.
This Department is not comfortable recommending approval of the
rezoning unless a commitment is made by the Lazy Glen Homeowner's
Association to fully upgrade the water system and look into the
feasibility of individual connections at each house. Another
alternative to provide reliable and safe water would be to hook
into the Basalt Water System. The County Mobile Home Park
Standards and County policy require use of a public water supply
if it is available. Continuing to provide water from two
individual wells instead of a public water system does not meet .

This Department is very concerned about the continued use and .
operation of the aerated sewage lagoon facility which services �
Lazy Glen Mobile Home Park. Due to high seasonal runoff this '
spring, the lagoon's dike broke and disch--ged the effluent from •
the lagoon into the Roaring Fork River. i
Aside from several design deficiencies which the State Health
Department has cited, the wastewater treatment facility is
located in a floodplain which does not meet current County Land �
Use Codes or the County's Individual Sewage Disposal System ��
Regulation. It would seem environmentally unsound to repair such
a disposal system.
' This Department encourages the applicant's investigation into
servicing the mobiie home park's sewage disposal needs by tying
into the Basalt Sanitation District.
A condition of approval for this application is

Wastewater Treatment Svstem
1. The facility which is an aerated sewage lagoon does �
not meet the State's Desiqn Criteria. A minimum of three
cells are required, and only one exists. �
- • 2. A minimum of 2-3 �eet of berm is required above the
water line. Although the Herm has been added, Dwain said
that it was not engineer-designed, so it cannot be
considered as flood proof.
3. Lazy Glen cuzrently has a permit for discharge to �^`
surface water, but not a permit for discharge to ground
. water. The Homeowner's Association will have to
either apply for a permit to discharge to ground water
(which is costly) , or line the sewage lagoon (also
costly).
4. The flow measuring equipment needs to be calibrated
so that the amount of leakage can be determined.
5. The facility is approaching design capacity. The
capacity used for hydraulic loading was at 91$ and
for organic loading was 76� (March 1995 report) .
Once a level of 80� has been reached, the "permittee
is required to initiate engineering and financial
plarining for expansion." (see attached 7.etter).
6. The state's sampling of e£fluent has found that
the fecal coliform count has exceeded the permit limits
several times.

for the last 6 months have been satisfactory.

I have reviewed the information submitted and would like to forward the following
comments to you:
impacts an Floodplain: The application accuratefy reflects the situation at the Lazy Glen
Mobile Home Park. Attached for your review is a copy of a map of the park which shows
the approximate lacation of the 100-year floodplain.
Although the applicant may be able to improve the flood protection ievee so that it
, conforms with FEMA construction standards, it will be difficult to convince a iocai
government, such as Pitkin County, to take on maintenance of the levee once the
improvements are in place. Instead of going through ihe added expense of improving a
levee that the county may not.choose to maintain, perhaps the foilowing conditions couid
be placed on the deveiopment approval:
1? Structures on all lots located within the 10U-year floodplain sha!! be placed so that
- the base habitabie floor is at least 1-foot above the Base Flood Elevation;
2) Structures on all lots located within the 100-year fioodplain shall be firmly anchored
to the ground so as not to float or drift during the catastrophic event;
3) Water heaters,furnaces, and other major appliances shaii be placed on or above the
lowest habitable floor in structures on all tots located within the 100-year floodplain;
4) Owners of lots within the 100-year floodplain shall purchase and maintain flood
insurance adequate to cover the loss of property that could occur during the
catastrophic event.
To comply with these conditions,the applicant would need to get a site specific fioodplain
analysis done that determines the Base Flood Elevation for each mobite home located in the
f(oodplain. The owners of the mobile homes would then need to raise the lowest habitabie
floor so that it is T-fooc above the 8ase Flood Elevation, anchor the mobile home to the
ground,remove any hot water heaters or furnaces from the crawl spaces below the mobile •.

oTHER: Resolution 95-198 was approved by the BoCC last September

development to occur is "the replacement of a trailer no larger
than the one being removed, and related accessory structures such

square feet in size and decks". This restriction will be rescinded
for the Lazy Glen Mobile Home Park when a rezoning is approved.
Will the subdivision provide guidelines for the future development
of the residences? Will basements or second floors be permitted? �
What about third floors? Will height be more restrictive than 28 '
feet? Will floor area be limited?
Single family dwellings and Prefabricated Housing not requiring
building code exceptions are a Special Review use in the MHP zone
district. Mobile homes are an allowed use.
The applicant states that BoCC �9-119 approved 90 homesites and
zoned Chem SR. By BOCC 83-74, the park was allo�•ied to expand by
seven (7) homesites, which were zoned PMH. If the park contains
100 homesites, when/how were the extra three homesites approved?
If the PMH homesites are not included in the l00 units indicated
on the site plan, when/how were the extra 10 homesites approved?
The plans suismitted do not seem to indicate the seven lots which
were zoned PMH. Zf these lots are included in the total of 100 ,
lots, they are included on the site plan. Are the PMH lots also
proposed to be rezoned to MHP?
The applicant has not specified what requirements are to be varied
by the PUD. �
