Ne said�vhat happened in 1995, '� was this document was looked a[and found to be fairly inadequate for the County's needs. There tvere utility contractors that were rearing up the roads and wc needed to have a litde more reeth to conttol those ��'..J' contractocs. 7'haPs tvhere tl�e Road Maintenance and Management Plan originated. At Hiat time they • � reaGzed there was a need out there to place roads in service levets of low,medium and hir,,h service tevels. In doing Niat they looked at die past hisrory of those roads ro see wlaa[had historically been done on Hiose roads ro piace them in one of those three categories. Pettett said this year diey found Uiat the Rond Maintenance and Management Plan had a few ertors and they needed to wrrect them and also make sane amendments m it He proceeded to review those changes 'r as ouNined in his memorandum to the Doard dated July 10,1996. A copy of Ihis memorandum is attached ' hereto and made a part oFdiis record as�XHIt31T"Ii". - " Pettett said in the last Few days there has been a lo[of questions cotne up and he has taiked ro several people on Ihe phone�nd via�AX,etc.over this Road Maintenance and Manngement Plant. He said what staff would like to do,with the permission of the IIoard,is do a complete title check of all the low service roads that are in question. Hc noted that diere are a couple of peopVe�vho have broueht to his attention that they don't think some of the roads area County owned or they may think may be County owned. Secondly,what he would like to do�vith representatives ofthe AG Committee,may be to amend the criteria in the low service level roads to make sure it meeu the needs of the residents and also the needs of the Road and Bridge Department. }fe would also like to do a complete analysis of the over-capacity roads. What they would iike to do is have a continuance of the public meeting process to August 14di with an aG � Committee representltive,and present a ne�v revised Road Maintenance and Management Plan to the Board of Couary Commissioners for adopting as an Ordinance. Su7anne Konchan,County Manager,said she supports this because the pfan may be substaniially altered fi-om its present form, Commissioner Ireiand said�vhat he�vould like to see added io the report is a way to identify roads that ; - should have shoulders for pedestrians and bicycles. One of tlte roads tha[comes to mind is Brush Creek � Road. Also,he thinks it would be useful for the AG Committee to look in[o the issue of plowing roads that have not historically been plowed,and accessed,etc. because of a change in use. Chairman'Crue said this is not a puhlic hearing,but lie�vould[ake public comment if anyone wishes[o speak to this matcer. , Dwioht Maurin entered a letter from Tom Smith inro the record regazding the ciassification of the upper ' end of Capito!Creek Road as low maintenance. Paul'faddune also spoke on behalf of a resident in the Nicholson Creek area who has maintained that road for 20 years. 1'hey believe Ihat portions of it are probab(y public,but it literelly it is the driveway to his liouse. Marta Steinmei[z submitted u letter into the record regarding this matter. A copy of this lette�is attached ' here[o and made u part of this record as EXH![31T"D" Ruth Perry voiced her o6jection to tl�e proposed pfan. A copy of her written comments is made a part of this record as EXHI6IT"E". There were sevecal odter people who voiced opposition to the proposed plan. They were opposed to the . $600 fine for those who defy dte niles of the plan. Bill Mohrman felt tliot the proposed plan may not be a downzoning of the roads but i[certainly would be a dowmm�ing of the property xcessed by the roads. Commissioner Ireland said tBe classifications do not mean the roads aze being downzoned. He assured that people who have been maintaining their roads would not have to be threatened by imposition of a fine. He r ' said each simation will be handled on a case-by-case basis. � Other persons who voiced opposiqon to the plan were Cd Smart,Ed Fales and Bob Perry. ' Betty Lamont said there is 1.13 mile section of the Thomasville/Eagle Road that has been muintained by Eagle County and they do a good job. She said their roads are being done very well in the morning,but if there is a big storm in the aRemoon,people can not ge[home. Chairman True said staff ivill be nsked to look into this issue. Roz Tumbull said she knows there is a Iot of frustration. [iut for the first time there is a spirit of coopera[ion.Instead of a waq there is an opportunity to get things done. - Chairman True assured everyone[hat staff will�vork closely with[he Agriwfmral Committee to try to come up with a plan tha[works for everyone. PUBLIC COMiNENT: Amy Browustein appeared before the Board to comment on the park bebveen Centennial and Smuggler. She said this park is only 6eing used as a dumping ground by contractors,and there have been no . improvements made to the park as promised. She asked if someone could take responsibility to get the deve(opers to proceed�vith the improvements. Chairman True sttid part oFthe agreement to allow the access in the manner it was done involved that park so[he County does have Ihe abili[y,[hrough tlie conditions of approval,to address the status. King Woodward,representing the Maroon Creek Caucus,said their concern is with respect to the size of the units on the property. He e�pressed a concern that the lower cabin could be increased in size. ;.r ' Marcella Larson said she�vould be ivilling to limit the cabin to 500 square feet. Commissioner Ireland said he would be�villing ro approve this if it were classified as an employee unit. ' M:trcella Larson said qieir inten[ion is to use the unit for a caretaker to take caze of their property. She questioned if she would have to rent Ihe unit? Commissioner True said it could be used as an employee beaefit. Commissioner Ireland clarified thac the reason he wants it ro be an emptoyee unit was to etiminate the possibility of the next person making it into a guest hause. . Larson expressed a concern about not bein�able to fill the unit by[he date specified by the housing authoriry,in between caretakers. Commissioner Tnie said there is a 90 day period to fill the unit. Also,he Ihinks iFshe worked closely with the housing authority on lhis matter,it would not be a problem if additional time were needed. Sassano sug,v,esred that the unit be called a caretaker d�velling unit and as a condition,require that they use � a deed restriction simitar to employee dwelfing unit guidelines. Commission members agreed tha[the unit can be in exchange for work. The�e being no further public comment,Chainnan True closed the public hearing and 6rought[he matter back ro dte Board for action. The City Planning and Zoning Commission was also consulted on the proposed revisions and their comments have been added. The section allowing an existing cabin to remain on the property should be amended to ctarify that either the existing OR the newly constiucted residentia]unit may be deed � � restricted(currently the regulation requires that the o[der unit be deed restricted.) '"r Status: The County Planning and Zoning Commission recommends that either the existing or . the newly constructed unit may be deed restricted. (See page 8 of the attached ordinance.} � 4. Affordable Housing mitigation for TDRs was not discussed as part of the existing ordinance. This shoutd be clarified as part of these amendments. Status: After substantial debate,the County Plaaning and Zoning Commission recommended that no housing mitiDation be required for TDRs. ;. 5. Amendment to Section 3-200.90 of the County Land Use Code which allows increase above ' 15,000 square feet by Special Review to require TDRs. Status: The County Piannin�and Zoning Commission recommends that an increase above I5,000 sqnare feet in residendal space should require the use of TDRs. 6. ClarificaTion to 5ection 4-60.95A2e(page 23 of the attached ordinance}noting that a deed � restriction on a parcel does not need to take place until the TDR is sold. 7. Map clarification: It has been brought to our attention that there may be a m2«_�o arror in the Cas[le Creek azea,and staff would like your recommendations as to whether or not an amendment is necessary. Staff has researched our files and cannot determine why the Dexter CIaim was excluded from the RR Zone District. 8. An amendment to allow TDRs to be used for;uest houses. Currently�uest houses are prohibited in the Code. In the past they required GMQS approval(for a free mazket unit). Staff believes that there aze some areas in the County where�uest houses may be appropriate with a Special Review. Staff is not asking for a formal recommendation tonight because additiona]work must be done to complete our research relative to the locations where gues� houses may be appropriate. However,staff would like your initial reaction to the concept and ' whether we shoutd pursue it any further.
