Tom Baker,representin�the North 40 applicants,introduced John McBride developer of the proposed
North 40 Subdivision.
John McBride proceeded by stating that he has been a supporter of R/O units forever;he thinks lhere
should be splashes of R/O ihroughout[he whole valley. He e�plained[hat the reason he has problems
with the R/O zone the way it is written,which is different than which they have in the business center,is
for two reasons: One is he does not[hink it is fair in that different people are treated differently with
e�isting R/O legislation(the principal developer,the smatt developer and the individual). Further,he �'-
thinks the Bonrd is tending to destroy crea[ivity and diversiry because to him the most interesting pinces nre
created by individuals and the small owner/developer. He ihinks tlie Board is making i[more at[ractive for
the principal devebper. Ne said what he would like ro do is work with a few architects and implement
everyone's covenant ideas and all kinds of ne�v innovative energy ideas and buiid a small house as a model
home. He said the way the R/O le�istation is written now[his caanot be done.
Mr.McBride and his consultants further urged the Board to ailow the first purchase oFan R/O bt to
construct n home and sell[hat home,after three years of ownership without the four percent appreciation
cap curcently contained in the guidelines. After this initial sale,the four percent cap would apply to any
resale. A copy of Mr.McBride's proposed Innguage change ro the regulations is attached hereto and made
a patt of tliis record as EXH(IiTT"A"
Commissioner True said the housing authority board has revie���ed this and made recommendations
regarding this projec[. The applicant has requested chat the Board of County Commissioners rnnsider
speciGc restric[ions diat would be differen[than the standard R/0 restrictions. Therefore,the housing
autltority board Bas been invited to this meeting to discuss this issue.
Housing authority member,Fnnk Peters,said he has made it a focus of his jab on U�e housing board,as a
City representative,to hy to keep the resale prices controlled so[hat the nest aeneration can buy. He
thinks it�vould be a mistake ro creare a housing program where speculation is part of the prognm.
Commissioner Irel�nd said he supports McBride's request because I�e believes the housin�market allo���s
enough supply and demand that speculation«�on't happen. He said the housing market in Aspen disrorts -
the amount of money i[takes to buy an affordable home and there aren't enougli units available in the the �

market to keep the prices down through competition. He said people aren't foolish,they aren't going to `-
buy something for a high wst. ,

Peters said he sees people spending exorbitant amounts of money to have roofs over their heads and plant
roots in the the community. He said we have a developer and a prnposal on the ta61e.Now�ve are in a
"let's make a deal"atmosphere and he dces not like it

Commissioner Ireland sug�ested that perhaps the units could be sold based on a certain amount per square
foot or the portion of the development cadd be built with no appreciation cap and[he o[her por[ion could "
be subject ro the four percen[cap.

� Lee Remmel,Assistant Director of Aviation,gave a brief overview of fhis item. He noted that there have
been two changes to tiie Ordinance since the work session. He proceeded to describe these changes as
fol lows:
• Recognizing that�ve�vi{l not:tccommodate autamatic vehicle identification frequency of opeiation
concerns this year,the annual permit fee for"lusury limousines"as a category of operaror has been
increased to$400 in iine with[he annual permit fees assessed other commercial opentors in 1996;
• A need has arisen on severa!nccasiais whereby local and o[her commercial operators have liad the
need ro luin�vehicles into operation at the airport on a temporary basis. A temporary permit program
is now being proposed.

pS AMENDED -Debbie Quinn,Assistant County Attomey,proceeded�vid�her presentation regarding
this item as ouNined in her Agenda Item Summaty dated October 23.1996. A copy ofthis summary is
attached hei�ta and made a part of this record as CXHIBIT"C".
Ms.Quinn referred ro a letter from William Jordan,representing the McCloskeys. She said his letter rnises
a number of issues�vhich she will address. She said basically,Nte McCloskeys are in favor of closing the
road to vehicular tiaf6c but they have raised a couple of issues. She referced to dtie letter from Mr.Jordan
outiining these issues. A copy of[his le[ter is attached hereto and made a part of this record as H 1

With respect to the issue of closin�tlie road along the eastern boundary of McCloskey's property,she said
everyone agrees that there is no dispute concernin�the abiliry to ciose the road beyond the eastern
boundary of the McCloskey's property because there l�as never heen a dispute about any private o�wiership
of the road beyond this point,
Commissioner True said he H�inks it would appropriate to at least darify that if Mr.Jordan is liaviny some
question as Yo the wording.
Ms.Quinn referred to pangrn�h d ot the Ordinance. She suggested itiat i�nguagc 6e addcKl tivhich
states"At the United States Forest Servicc snd McCloskcy boundary".
Commissioner Truc moved to amend thc Ordirtance ta includc this langu�ge in Paragraph 4 of tl�e
Recital. Commissioner Krntvzoff seconded the mofion. Motion passed unanimously.
Ms Quinn refcrrcd to paragraph 3 of Mr.Jordan's lettcr regarding w�hat thc intention is concerning
motorized vel�ic{es. She noted tGat there is a typo in the dra(t ordinnncc which references C.R.S.42-
1-102(50) Sl�c said this should be sub-section(58)ratl�cr thau 50.
In discussing this�vith Mr.JorJan and also�rith the Forest Service,the state stutory language for
motorized vehicles in t6e two sections tliat sl�e has referenced include a number of exceptions. And
shc thinks Mr.Jordan makes a good point in that she believes the intent of thc intent of the 4oard
wes fo make the ciosure as broad as possible to all motorized vcliicles in ordcr ta en6nnce t6e
recrcationa!e�perience therc. Thcrefore,shc�grees t6at additional language should be included
under Stction 5 to makc dear that intenL S6e suggested that tbe definition of vchicic bc put in undcr
42-1-102(112)as"Vehicic is further defined as any drvicc whicl�is capnble of moving itsclf or of
being moved from piace to place upon�vheels or endless tracks." She would also suggest l�nguage ,
H�at statcs"For purposes of tbis Ordinancc,motorized vchicles shall be given a broad intcrpretation
and includes,but is not limited to snowmobiles,motorcycles,al[eriug vc6icics,tractors,U�rce- �
�vlieelers�nd faur-�rf�celers." �

Ms.Quinn referred to paragraph 5 of Mr.Jordan's Icttcr concerning liabitity. She s�id thc
par[icular portion of thc orUinancc that migl�t bc problematic is in subsection b)�vhicl�states"Thc �
public works department will close the ezisti��g gates located on the Hunter Creek Toll Road at thc
boundary of the nntional forest and on Smuggler Cutoff Road net�r the Benedict properq�. Shc noted
tha[1�1r.McCloskcy docs not havc�probicm with thc Count closing it as long as 1ic is not nny rvay

Ms.Quinn said that issue is still outstanding in terms of whcther or not the ro�d is pubtic or private
nt that point.

Ms.Quinn�vas directed to draft language accordingly after checking�vith tt�e county's insnrancc
company.

the�vinter time. He suggests that the best alternative is an electronic gate because d�at gives you a locked
gate which�vould be much more effeciive than a closed unlocked gate,and it wouid not interfere with their
access. He said if ihe gaie is closed i[will be in violation of their agreetnent with the counry.
Commissioner freland said he disagrees that it is a useless gesture ro close tfie gate. He Uiinks it sends a

be determined) of $30,000/mo.; and landing fees.

instal!an electronic gate at either ti�e east or tvest boundan�of the McCloskey property. T1ie
current gate is not an electronic gate and is located on the east boundary ot the ��leCloskey
property. The easement agreement wltich is attached to the Settlement Agreement and which
was recorded unsigned indicates t31at Austers would take the access easement in an "as is"
condition,which,in 1993,inciuded the existing gate. [am still wairing to hear rurther from
McCloskey's attorneys concerning the history of that gate�vith respect io the Austers use,and
iVtcCloskeys'position�vith respect to the ordinance.
Alternatives: Adopt the ordinance upon second reading in its current forttt,or continue second
ceading for further input srom McGoskeys.

ISSUE: Tlus is a continued hearing regarding the James Weber application to"legalize" �� `
a caretaker dwelling unit located in the Brush Creek Village Subdivisioa At the last t�°
meeting on September 25,a number of issues were raised regazding this applicauon. �j

At th.:tsoazd's request,the staff inspected the residence with Mr.Weber. The staff also '� r'
reviewed Mr.Weber's records and discovered a letter frorn former County Zoning %
Officer Bill Drueding,dated March 16,1982,(attached)in which the County made the �,�
. determination that the residence is a legal"grandfathered"duplex.

RECOD4MENDATION: Based on this letter,the staff zecommends that this application
be withdrawn and that the County continue to recognize tius residence as a legal �
nonconfonning duplex. The applicant is encouraged to work with the Brush Creek
Metropolitan District to resolve water supply issues.
The following items are in answer to the Board's questions from the last hearing for
' genenl informational purposes: .�
1. The Board directed the staff to conduct a site inspection. A site inspection was �
conducted on October S,1996. The exisring residence appears to be developed as a
duplex dwelling in an upstairs/downstairs configuratioa The upstairs dwetling
contains 3 bedrooms,3 bathrooms,a kitchen and a game room with a wet baz. The .
downstairs dwelling contains 3 bedrooms and 2 bathrooms.
