to be sufficient. Pursuant to the Colorado Constitution, State statutes, and the County's Ilome Rule };�
Charter,an election needs to be set by the Board itself within 60 days. Due to time constraints,not the
� least af whiclt is to provide for absentee voting,tfie earliest possible date to set the electiott in keeping with t
the requiremenu o£not being out further than 60 days and sufficiency of the petitions,and allowing for �
absentee voting,is April 9,1996. Silvia Davis,Couaty C1er1;,has requested t6e Board set the elec[ion for
April9,1996.
Commissfoner Tuite moved to set for ttic recall dection for bvo County Coaimissioners t6e Aate of
Apri19,i996. Wifli a second by Commissioner Ireland,the motion pnssed ananimously.
Commissioner lreland commented it is rearettable that the petitioners,who have had this for 60 days,show
purpose to delay turnin�in the sianatures so that they could have the eleciion at a time when people would
not be here to participate. He feels it is regrettable when penple try to manipulate[he election schedule ro
eaciade people who they do not think are appropriate members of the community or appropriate members
to paRicipate Pn the election. He liopes people in the vatley will take advantage of absentee balloting
because Iheir vote and Hteir presence in this community is just as important as the petitioners.

Section 3-I50.160 of the Land Use Cade; : �
• change the language in paragraph 2 oF recital No.10 which talked about when the applicants would be 'b•
required to vacate or ab:uidon the previously approved project and associated lodge allocations; �
• verified diat condition No.IO was not changed. It is to be undersiood that there was going to be �'-
exclusion of a portion of Smuggler which is in blue and red avalanche zone because diere is a separate
mitigation(the roadway is to be closed during avalanche times};
• Condition No.29 was redrafted u discussed in the February 5,1996 meeting; �
• A condition No.41 waz added ro state the actual height of buildings 5,7,and 9 would be addressed at
detailed submission. Fundamentally,there�viil be an allowance for increase of height on some of the -
buildin�;s in order to promote a greater variery in the appearance; r
• Condition No.32 is cl�anged to recognize that the applicant is not tied to the landscape plan which was .� -
provided ut yeneral submission;that they would be allowed some Bexibility in designin�landscaping .
which might allow some screen views of the architecture;and �
• Condition No.47�vu added which discusses the U.S,Forest Service bus service up ro Maraon Bells �
requirino the applicant to work with the Foresi Service. It is recognized the applicanks will not be
respnnsible for any traffic impacts or air quaiity impacts associated ividi the bus service since i[is a
community service.
Mr.Malloy understands the applicant hu been having continued discussions with the surrounding property
owners and has made some progress. Mr,Malloy also suggests adding another recital between the tirst and
second paragraphs in recitat No.�t regarding tlie Board's resolution wl�ich dealt with pipeline cases when '
the new Code�vas adopted. This reciial�vill clarify that this application is going to go under tlie old Code.
� Gideon KauFinan,representing Uie applicant,stated in having discassions with die neiahbors,they have
reaclied an understanding with a number of Ihe neibhbors in terms nF mitigati��some of the impacts
associated�vith the properties that are adjacent to the ski area.
Regarding the proximity oF the ihree affordable housing lots,they have eliminated three lots nnd moved the
projec[down somewha[. They(iave gone more toward the sinple-family zero lot line type home. They ,,_
have a very nice buffer area,which will be landscaped. !t provides distance behveen the existing houses
� and what wilt be the affordabfe liousing area.
The second item diey addressed was the nvo lots sittin�between some l�ouses and the ski area. They have
relocated the two tots creatin�a very large buffer area. Lots 3 and 4 have been combined into one lot,
which is Lot(I,so that the impact on some l�ouses is lessened.
Tlte affordable housing sizes will be four-bedroom houses. The square footage of ho�ses will be
approximately I,G00- 1,700 square feec The minimum size will be 1,400 square feet. T7te parcels ure
slightly smaller. The buffer area is landscaped, The area is intended for open area. For the most part,they
have kept themselves out of the 30 percent slope areas except the two new bts, Staff ivill comment more
on the newest set of plans at the neat meetin„March 6,1996 at 3:00 p.m.,loca[ion ta be announced.
Commissioner ireland stated he is glad to see that the neighborhood and the developers have worked out
different issues,to the bettennent of d�e communiry. The Board has been instrumental in havine these
issues worked ouL He wanted ro thank the Hines Team and the neiehbors for sittine down,t�lkaig the .
problems out,and coming 6ack�vith some solutions that may�vork for everyone. He stated the community
is better offwhen they do not litigate differences.
Commissioner Ireland moved approval of thc Resolution,as amended,on secoad reAding and set for
public hearing and third reuding on March 6,1996 a[3:00 p.m. With a second 6y Commissioner
Tuitc,thc motion passed unanimously.
