PiLB •I .ARIN OAI J LY 9. 1996- Cindy presented the amendments to the Rural �� and Remote Ordinance as outlined in her June 26, 1996 Summary. A copy of the Summary j is attached hereto and made a part of the record as Exhibit"A." Cindy Houben brought documentation explaining the special review criteria needed for TDRs. A copy of the documentation is attached hereto and made a part of the record as Exhibit"B." (James True arrived at this part of the meeting.) .� Cindy Houben stated the P&Z felt 8,000 square feet was a reasonable size for non-residential use. Special review is required because of the impacts of non-residential use. It is difficult � to anticipate different uses;thus,the reason for special review. A discussion ensued regarding using 7,500 square feet versus 8,000 square feet. Gideon Kaufman,a local aitorney,gave the history of TDRs and their requirements. , , Cindy Houben st�ted the general consensus from the public was they want a set square '' footage for TDRs so they know what they are dealing with. If people know what they are �� � dealing with,they will design their projects such that if they need two TDRs,they can look � . at it that way. She feels it is to the County's advantage to have some square footage ;� standards rather than having it open-ended. Somebody might come along and have a large �, project and only purchase one TDR for a 12,000 square foot project. He prefers a - standard so that each project is not a"IePs make a deaP'project. �+•�- ` Y� Commissioner Lamont wanted to know if there is a definition for"non-residential use"in the y��' �..;y Ordinance. Cindy Houben stated right now there is no definition. Staff plans to inseit a �,• definition into the Ordinance for second reading. j:` Commissione� Lamont expressed a concern regarding if a person has a project oP 8,200 square feet and has to purchase another TDR for the 200 feet over the 8,000 feet,will they • have a tendency ro try to"fill the TDR vacuum?" She feels they mi�ht try to fill the vacuum �"�* because of the extra money spent and extra space available. ��' ;h . . Commissioner Tuite stated he wants to create as much TDR availability as possible. He • stated there should be more incentives on how to use TDRs. r'; Commissioner Tuite asked if procedurally people are required to actually have ownership of a TDR or can it be under contract? Suzanne Konchan stated upon final plat approval that ''`� you have ro be at least under contract for a TDR. �; ' Lenny Oates usked if the 8,000 square feet can be attached or detached. Cindy Houben '+�t, stated it could be either way based upon a speciat review,all depending on impact. �� � Commissioner Tuite siated he is looking for more ease in the TDRs. He wants a market and � a market in an area where there is already development and impacts and they are accepted. Bill Mohrman stated he feels the County is not making a marketable tool. He believes a N; ' monster is being created. He thinks his rights,as an individual property owner,are being taken away. He feels the Board is telling him if he gives up his property right,somebody - else will have the right to build something 8,000 square feet or bigger for either a guest home,swimming pool,or riding arena. He feels a market is being created for people with large amounts of money to buy up all the existing properties that may be able to have a TDR. He feels it is un incentive to bring in more wealthy people to build bigger and better things with TDRs. He wants Rural and Remote repealed because it infringes on property owners' r rights. Commissioner Lamont stated as the Ordinance reads now,you can transfer TDRs off one site within the Rural and Remote Zone District to another site within the Rural and Remote Zone District. The TDRs the Board is talking about now are outside the Rural and Remote Zone � District so an 8,000 square foot development would be outside the District. ; ,�� . Ed Smart,a member of the public,asked what the visions are for people who have property ' Y' rights now(as a pauper) in the Rural and Remote Zone District? Right now,they cannot ,i� have swimming pools because of the denial of water rights. He feels there is too much �,�;, regimentation and that his rights are being taken away. Mr. Smart wants the Ordinance �� redone. He feels it is too arbitrary. He stated there is not enough TDRs(not enough mining _ claims). Cindy Houben stated a new amendment would be that either an existing structure or a new :".�''�.;; structure can be deed restricted to resident occupied. � +:".. Concerning affordabJe housing mitigation, the P&Z recommended that the County not require housing mitiga[ion where TDRs are being utilized. The County dces not require mitigation fees for pre-existing rights. - `"r. Commissioner Lamont stated she would like to see Aspen as a receiver site of TDRs. ! '� t' - t Cindy Houben stated another amendment,which is not included in the amendment packa�e � ' right now, is to amend the special review section of the Code. T'his amendment would require that you obtain a TDR based on the residential square footage schedule. ('or example, if you are going to increase your residential square footage, you are required to obtain a TDR based upon the schedule. i ' Sontty Vann stated in a development of a house over l5,000 square feet,he would like the "1' ability to use the purchase of a TDR for attached or detached residential use also. He stated �. • if you want a market for tl�e TDR,there are some individuals who can afford and believe � t6ey need more than t 5,000 square feet. This would be under special review criteria. He t stated the only difference between residential and non-residential use is the square footage. � 3 In regard to the next amendment,Cindy Houben stated tlie original Ordinance required that � you deed restrict a parcel from the sending area,the preservation site,and that it be certified. � _._ . The County has changed that to say thaY you deed resirict a parcel once the TDR is sold. � In regard to amendment No.7 of the Summary,the consensus from the Board in the work session was that they would not pursue map clarification. Staff will research why the Dexter claim was not included in the Rural&Remote Zoning District. i Cindy 1-Couben stated in reference to amendment No.8 of the Summary,they will not nddress this issue at this time. It will be taken offthe request for amendments. It wilt take a separate track. Commissioner Lamont wants it clarified in the Ordinance that there wili be no affordable housing requirements. She wants the City Council apprised of the affordable housing decision and where they are going with the issue. Marta Steinmetz,a member of the public,stated the maps she has acquired of the Rural and Remote Zone District are of poor quatity. She wants better maps. She also wants a list of everybody affected by Rura1 and Remote Zoning. Cindy Houben stated Marta can acquire maps(particularly the Little Annie map)from CommuniYy Development and if she has any , concerns,to red-(ine them and Cindy witl address those concems and/or amendments. The map is not totally approved � yet. Marta can obtain a list of the people affected by Rural and Remote Zoning from the " Assessor's Office. Marta asked if there are only mining claims. Commissioner Ireland clarified an article in the newspaper regarding GMQS as follows: � J There is a possibility the Board would make a provision for guest houses,which have been j:�` eliminated from the Code. They mighi treat the guest houses as a use that a person could obtain in the GMQS competition with other lodgers or a person could be exempt from the = GMQS process by obtaining TDRs to build a guest house, but it still counts against the � GMQS quota. This is not part of the amendment to the Rural and Remote Zoning at this `�'r,� time. 'k:' '�` - .y., In regard to the City being a receiving site for TDRs,Commissioner Tuite stated the 8oard is - ' trying to meet witl�the City Council in the near future to discuss annexation in general.He feels this is definitely a topic they need to discuss. In an effort to clarify specific provisions and intentions of the RR Zone Dimict staff and the County Planning and Zoning Commission are proposing several amendments. Additionally, "� staff would like the Board of County Commissioners to consider sevecal amendments which will �' hopefully tiuther en6ance the value of TDRs. � �� �' �� .a list oT the proposed amendments and their status relative to the County Planning and Zonin¢ - Commission recommendations is provided below: 1he most significan�revisions are intended to �� increase the use of Transferable Development Ri�hts(TDRs). The City Planning and Zoning Commission was also consuited on the proposed revisions and their comments have been added. ` PROPOSED A,�IENDbIEMS TO THE RR ZONE DISTRICT: The proposed amendments are indicated in italic in the attached draft ordinance. — - 4 l. The charts explaining the use of TDRs are very complicated and are difficult to use. Staff has eliminated one chart and revised others. "s Stams: Counry Pianning and Zoning Commission recommends amendments to the charts. (Sce pages 17,18, 19 of the attached ordinance.) 2. Some feel that there is a market for TDRs to be used for non-residenual space such as znciosed recreational uses(pools or tennis courts). The concept is that additional square � footase may be allowed above I�,000 square feet if TDRs are purchased for the non- � residential space. �, . ., Status: Counry Plannin�and Zoning Commission recommends that TDRs should be used for i non-residential space and that each TDR should allow 3,000 square feet of non-residential ?'�� space. 5pecia!Review is also required. Currendy guest houses are profribiced in the Cude. In che past they required GY1QS approval(fora free mazket unit). Staff believes that there are some areas in che County where guest houses may be appropriate wirh a Specia4Review. Staff is not asking for a formal recommendation tonight because additional work inust be done to complete our research rela�ive to che locacions where guest y houses may be appropriate. However.stai£would like your initiai reacrion to che concept - and whecher we should pursue it any huther.
