the Doard on June 26. I[was continued ro today's date for input from the City of Aspen as to what their �:
opinion wouid be of the proposed incorporation. He said full comment from the City of Aspen is not
required,however,he dces have a memorandum from Stan Clauson,Community Devclopmen[Director,
addressing[he Ciry's comments.A copy of this letter is attached hereto and made a part of this record as

Cliairman True referted to a memorandum from County staff addressing ail of the issues associated with
the request from Brush Creek Village for incorporation. A copy of this memnrandum is attached hereto

Harty Shulman,representing Brush Creek Village,said the City of Aspen's comment refers specificalty ro
the Aspen Area Community Plan,which amends the geographic limits of[hat plan at Shale Bluffs. He said
the statute does refer specificatly to a regional or county comprehensive plan. So he does think that the
commen[s from the City of Aspen are pertinent in any way to the inquiry ihe Board haz before it.
Alan Richmond,representing Bcush Creek V illaga,said the proposed incorporation does not address in any
way either the Mills property or Cozy Point Ranch. So iPs entirely specula[ion that the future town would '
in any�vay detract from the future realization oFtlie goals of Ihe Aspen Area Community Plan.He said
more importanNy wliether Brush Creek V illage becomes an inwrporated town or remains an
unincorporated subdivision,if t0e City has plans for Brush Creek Village Subdivision then,they need to
revie�v those plans�vith the neighbors.
Chai�man Trae said he does not agree with the entire concept. For instance what is t6ere now,is not an
incorporated to�vn�vith powers and rielits that are appropriate for an incorporated town under the statute. -

Mc Shulman submitted an affadavi[from Gary Suiter,Town Manager of Snowmass Village,which refiites
any present in[ent to annex Brush Creek Village on the pan of the town. A copy of this letter is attached
hereto and made a part of this record as EXHIBIT"D".

Mr.Shel6nan asked if the Board would concur that there is satisfactory evidence that annexation cannot "`T"
occur for at least one year?
Commissioner True said he does not think it appropriate for the[3oard to commit to a determination as to .
whether it is one year or two years away.
Shulman summarized that the statute is very clearly biased in favor of the Baazd of County Commissioners ,,,
pertnitting the citiuns to have an election. And tl�e reason that it is very clearly biased in that direction,is
because the commissioners have to make three specific and difficult findings. And even if diey make those
three specific and difficuit findings,the statu[e says the 80CC may deny the election. It doesn't say it
shall deny. Therefore,the Board stili lias the discretion to say the democratic process shal!succeed. Also, y.
the statute does not even permit BOCC action if the nwnber of people in the affected area is greater than +
500 people. So there is a small exceptian to the rule on incorporetion�vhich permits the BOCC action if �-
there is a smaller graup of people. He urged the Board to let the citizens be able to vote on the ability to S
, govem themselves. p

]ohn Ely said the statutory criteria,which the Board must apply in reviewing this petition for incorporation, �
includes a finding that the proposed incorporation is consistent with the applicable county or regional �
comprehensive p)an. The NAACP is a regional comprehensive plan and he would put ta the Board that
both component parts of the AACP are regional comprehensive plan as contemplated by the statutory -
criteria. He also said d�ere has been some discussion as to annexation and whether or not that type of "�
annexation is contemplated by the Town of Snowmass Viliage. Such annazations are not discournged or
restricted in any way by the statutory scheme and framework for annexation and in fact,are allowed.
Chairman True opened the hearing to public comment. There being no comment,he closed the public
hearin�and brought the matter back to the 8oard for discussioa �
Commissioner Tuite said he has not heard a va(id reason as to why Brush Creek Village needs the �
incorporetion nor that the County has ab�sed the homeowners up there when it comes ta services. He said �
[he fact is the protective covenants state quite clearly everything has to be in the zo�ing regulations of i
Aickin Caunty,nnd it takes 51 percent of tha property o�vners to over tum[hat. He said if everythi�g was
fine wi�h the rules and regulations of the county,they would not be pursuing this. So in his mind, '
somethin�isn't fine and he has not yet heard why.
Jim Crowley commented that there are problems such as a delayed review process for ridge tine review,
through the county. There has also been a disregard on the paR of the zoning office of the violations that -
go on within the subd'+vision,rvhere propetties have been tumed into roonung ho�ses. With respect to the
upgrading of their�varer system they llad m go[hrough a long!041 review with conditions peRaining to �
the size of the line that they felt were inappropriate. Overall,he said they think tha[they can probably do a
better job of taking care of the needs of the citizens in Brush Creek Village than people�vho frankly are not
that close ro it,and that is a big motivatin�factor. '
Commissioner Lamont said that she thinks this county has a history of a growth management plan and
system that has been in place for over 20 years. And she thinks allowing people to incorporate that gets � j

them out from under that system and the ability to adopt their own rutes and regulations is inconsistent �°'
with the growth tnanagement system. Her other concern is whether or not people reafly kno�v�vhat dTey
are voting on;do they have an apportunity to really understand what they are voting on and what the long •.
term implications are. She has made a couple of ca!!s to Brush Creek residents and one resident told her . 1�
that he didn't care. The oYher person told lier that they do have a concem and have a lot of questions that
they hope will be answered prior to any incorporation being approved. What her concern is that this is
getting to the point of a vote for incorporation,bnt there are a!of of issues that cotne along,that have not
been discussed,i.e.,county services versus services that the subdivision will need, She thinks this is
something that the residents,who are voting on this,need to know.
Harry Shulman said the statete provides specificalty that there is a up to a 90 day period between the time
the district eourt enters its order and the election. Therefore,there will be that 90 day period for aH icinds ?'
of infonnation to be given bnth pro and con. He emphasized that the focmal order they submitted,provides :
for 90 days. He said he�vould offer to modify this form of order tha[they submitted to Nie District C�urt . -
to say the maximwn time of 90 days. .
Commissioner Lamont said even though s6e has concems,she is not about to teli 24 to 50 people that they
can't vote on tfieir awn destiny.
Commissioner Tuite said his position is that he does not see tlie need for this. He sees a dangerous
precedent being set if this were to go forward. lt is not what is being said that concems him,not
specutation but tlie absence of what he hears. He sees annexation with Snowmass Village as a possibility
and he�vould work toward that. If the desire is to get out from under Uie county code and to incorporate
[hen he thinks going to the nearest area,in his mind,makes the most sense,and he will commit ro working
for that and not opposing that acquisition. He also thinks it is inconsistent with the down vaHey pfan. He
said Leslie makes a very good point about democracy and[he ability for the residents to choose tlteir awn
destiny, He thinks in a perfect world that is absolutely hue,but to wfiat size do we make these
incorporations;ta whai levels do they do. For the reasans he has cited is why 6e will vote against this.
Commissianer True said it is his opinion that there has been satisfactory evidence an each of the criteria set
forth in the statute. He agrees with other commission members regarding�he reasons that they do support
this particular incorporatio�. He thinks as a whole,i[is not in the best interest of the county to go forward
with this election. He would ask that the proponents of this reconsider. But right now today,he is not
prepared to deny the proponents the abi�ity to vote on this issue. Therefore he will entettain a motion to
pennii the incorporation efection to he held;io approve that on first readirtg and to set for a second hearing
at a subsequent day.
Commissioner Lamont moved approval oC first rcading of a resalution permitting an incorporntion
clection and set for second reading and further publie hcaring on July 31,t996 at 5:00 p.m.

Chairman Truc entcrtained a motion to adjourn the special meeting and go into executive session to

Thank you for requesting City of Aspen comments with respect to the proposed incorporation
election for Brush Creek Village to be reviewed at a public hearing by the Pitkin County Board of
County Commissioners. �

� The City of Aspen is coocerned that the incarporation of Brush Creek Village would detract from
regional and metropofitan planning and growth management efforts through the unnecessary
addition of another govemmental entity immediately adjacent to our metropolitan region.
Specificatly,the Aspen Area Community Plan presents two metropo(itan area plan elements which
include the Brush Creek Road interseciion and adjacent properties. The transportarion element �.:
identifies the Mi(ts Property,and the housing element identifies Cory Point Ranch as areas which
may play a role in advancing our metropolitan and regional goals. Sanctioning another
municipality at this generat location would not be consistent with the Aspen Area Community
Plan and may detraci from the realization of spec+fically identified goals within the Plan.
lt should also be noted that the City of Aspen has worked closely with Pitkin County and the
Town of Snowmass Village on transportation issues relating to the Highway 82 corridor.
Introduction of another govemmental entity would further complicate this process and may result
in greater d'+fficulty in financing our valley-wide transit system.
Coiorado Revised Statutes provide that the board of county commissioners may refuse to permi2
the incorporation election to be held if the board finds upon satisfactory evidence that:
• Any of the criteria set forth for special districts in section 32-I-203(2),C.R.S.,exist '
with respect to the area proposed for incorporation;
• Annexation to a nearby municipality would avoid unnecessary duplication of
services...;and
• The proposed incorporation is inconsistent with applicable county or regional
comprehettsive p(an.'

INTRODUCTION �•f•
On April 23, 1996,the District Court in Pitkin County received a"Petition tor �'''>
Incorporation of Town or Brush Creek",�vhich proposes the statutory incorporation �
" and Adoption of a Home Rule Charter for the Town or Brush Creek,now known as j
Brush Creek Village Subdivision. The(andow�ers interested in incorporation(the
petitioners) have met a1!of the statu[ory requirements with one exception:
approvai of an election on the incorporation by the Board of County
Commissioners.
� The procedure for incorporation is as follows:
The petitioners for incorporation submit a petition to District Court signed `
by the required number of qualified electors. The petition describes the territory
proposed for incorporation, presents an accurate map of the boundaries,states the �^
name proposed for the town and satisfactorily proves the number of inhabitants
within the area.

- Prior to an election on incorporation,the Distrid Court must find that are ;
area proposed is"urban in nature" and that the area has an average of at least SO :S
people per square mile.

- If the area has less than 500 people res+ding within it,a public hearing must �
be held in front of the Board of Co�nty Commissioners to consider whether the '�
petitioners may hold an incorporation election.The incorporation statute(C.R.S.3 i- (`
2-101)states that the Commissioners may refuse to permit the incorporation � �.

proposed area of incorporation.

BACKGROUND '
_ Brush Creek Vil►age Subdiv+sion was recorded on January 19, 1966. 8rush Creek
Village was one of the last subdivisions to be platted prior to enactment of
Subdivision Regu(ations in Pitkin County on)une 6, 7 966. The subdivision is
situated on sloping hillsides or mancos shale outcroppings and contains
approximateiy 320 acres or 0.673 square miles. Currently,there are 134 platted
residential lots within the subdivision(238 acres/lot),a �``
pproximately 114 of which
are developed(85°/0). As ihe subdivision began to be developed,certain problems
concerning infrastructure arose. These problems induded the water(or lack o�,
(in)adequate percolation for septic systems, the subsidence or sloughing of land
within the subdivision,and the improvemendmaintenance of the roads. On
November 11, 1981,formation of the Brush Creek Village Generai Improvement
District was approved by the Board primarily to address the roads. On November
11, 1983,a mi11 levy was approved by the Board for the disuict to fund
improvements to the roads. On August 13,1984,the roads within the subdivision
were accepted for maintenance by the counry with certain conditions. On
September 22, 1986,weight restrictions were piaced on the roads by the Counry for
the first time. On March 28, 1989,the Board of Commissioners approved
Formation of the Brush Creek Water District. On May 29, 1990,the water distrid
gained 7041 approval from the County for the improvements necessary to bring .
water to the subdivision from Snowmass Village. On February 23, 1994,the water
district won the approval of the eoard for a modification ta the service plan,which ,
essentially made it a metropolitan district.

Landowners within Brush Creek ViNage began debating the strengths and t'J �ti,
weaknesses of incorporetion in November of 1995. According to correspondence � �
between the petitioners and the county,incorporation is deemed advantageous for y � .'�
the following reasons: ' `

The homeowners would be able to make regufations regarding land use and
road use with iheir own interests in mind;

The homeowners wouid be able to regulate the activities of utilities within ;t_:
the boundaries of the town; -

The homeowners wouid be abie to rormulate advisory zoning guidelines ior � .
areas(ocated within one mile of the rown. I��

Some,but not all or the disadvantages or incorporation are mentioned�vithin the �y
correspondence. It is our hope to more ruily present these potential disadvantages
ror your consideration prior to the public hearing. ; "�'

POTENTIAL SERVICES �i�
� The main disadvantage to forming a town is the potential service responsibilities a '
town or city must provide to its constituents when required. These potential �
services are outfined in Exhibit"B",a memorandum from Lynn Dunlop.The ,�
petitioners state that these"treppings"are unneeded and that the town can operate
without office space and without employees,just as the Brush Creek Metro District
has been operated. Private contractors, it is stated,can provide aii of the necessary
services such as water system operation and maintenance,road maintenance and
plowing,trash hauling,weed control,accounting and clerical services and building
inspection. The flaw with this line o4 reasoning is that it assumes a static model, --
that is to say that the town wiN remai�relatively smal!and that the demand for =
more services and the demand for annexation will not occur or not be approved. '
Although it is true that private contractors can provide any service you want them to
provide,the muitipie contracts that must be let to gain these services must be
managed and administered by some person or persons. This could be the town
council directly or(more likely)will require paid staff.

Potential services that will be the responsibility of the town include the following: �

develop and establish(codify)all rules and regulations; adopt and appropriate ��!,
annual budgets;makes supplemental changes to annual budgets;conform to ail

ISSUES OF INCORPORATION
Listed below are the issues discussed by staff surrounding the incorporation of a
new municipality such as the Town of Brush Creek(see Exhibit"B",a
memorendum from Lynn Dunlop that outlines these issues). These issues are
brought to your attention for discussion purposes and represents a shopping list of
questions that the Town of Brush Creek wiil need to address: t_
" • Except for debt service, ibng-range financial planning is not in place. What are
the future capital needs of the town2 How does the town pian to replace capital
purchases over time as they depreciate�
• Will state mandated services be provided in a economical manner? The county
provides these services already. County property and sales tax will not decrease
for town residents. in fact,their own property tax could increase over time.
' County sales tax otf-sets 5b%of net general government costs such as
administration,public safety,health regulations and long-range community
planning. The town as proposed will not have any commercial adivity.
Therefore,there is no sales tax. Because there is noY sales tax,the county will
not contribute any of the county sales tax back to this municipality like it does to
Aspen,Snowmass Village and Basalt. '
* The very limited revenue opportunities present in this incorporation proposal
wiN likely result in increasing demands on the property tax. Over time,costs
will grow faster than property tax revenue due to inflation and property tax '
limitations,such as Amendment 1 (TABOR)growth and inflation rates on

property tax growth and the Gallagher amendment's reduction of residential �, .''
. property tax rates.

* The Gallagher Amendment will continue to drive down the property tax revenue
generated from residential property,which makes up ail of the property within `'�
the town limits. How wiil the town respond� Increasing the property tax may
require a vote of the citizenry for ait increased c:osts exceat debt service.
Requirements of the Gallagher Amendment tend to encourage growth in
commercial zoning rether than residential zoning because the tax rate is higher
and will therefore garner more property tax.
* As growth occurs,property tax will lag while the citizen's demands for services
and infrastructure increase. Under this scenario,property tax growth will not
keep pace with continuing customer demands and needs. . -
k The 1996 o;�erating budget submitted by the petitioners appears sufficient,
except for possibly administrative support. Operacions are adequately tunded
with fees and property tax. Capital debt and capital projects are funded over
time using current year property tax and prior year rund balances. The questions
is,will future demands for services upset this balanced budget? In the vast
majority of cases,towns either grow over time or die trying; The To�vn or Brush
Creek needs to account ior a conservative lgrowthl scenario when pianning ror
tuture budget cycles.
* What motivates the homeowners to consider incorporation� The right to decide
their own planning and zoning standards, the ability to have a more direct say
in what goes on surrounding the town limits,and fult ownership or the
infrastructure are the reasons stated by the petitioners. There is also a feeling
that the County does a unsatisfactory job when providing services to the
. subdivision. Law enforcement and animal contro( is by complaint only,with
no scheduled patrols in the neighborhood. Although the Counry took on the
roads in 1984(see Exhibit"C",Resolution No.8470),it was with a set of
conditions that forces the subdivision tc -v for road maintenance an^capitai
improvements through an improvemen .,rict. Other services,sun:as water
and trash removal,have been provided tor b�:the homeowners throu�h districts
or other agreements. There is a feeling thai nuch of what a local government is
supposeci to provide is being provided instead by the homeowners and
improvement districts. Why not take the next logical step and incorporate?
► What services are being duplicated with this incorporation� Although it is true
that some of the more demanding services such as water and road maintenance
are supported by taxing districts, there are many services currentty provided by '
the county that the new town will need to consider providing immediateiy or in
the future. Building inspection and approval is an example of a service that will
be required. Can the service be provided through a contract with the counryi It

is possible but the County is not required to provide these services,even under �
contrad with the town. Can this service be obtained through the private sectar� ', `�•

immediately after incorporation or within the first year. �

CONCLUSIONS
The Boards role in this incorporation process is stated simply in the Revised .
Statutes: the Commissioners may reruse approval of an incorporation election if .
you rind all of the three criteria to be true:
There is no Sufficient Need for Organized Service. Is there a sufficient need for '
services that are aiready provided? Or is the e�cisti�g services inadequace ror such
need? The petitioners beiieve that there is sufticient need for services. One could
argue that there is no need for services over and above what is being provided `�,•
today. If that is true, then there is no need to incorporate ro provide what the �
county and special districts are already providing. if there is not a sufficient need �'
. for organized services, the rest ot the special district criteria is not applicable. �

There is the Ability to Annex to a Nearby Municipality. Snowmass Village,the
neares[municipality, is located in close proximity to the proposed town. If the
town limits were expanded to include the Cozy Point Ridge Subdivision,the � ;
incorporation could qualify as an annexation. Annexation would help to reduce
dupiication of services by providing building inspection, law enforcement,etc.,
discussed as lacking by the petitioners. Annexation could be a compatible option
to consider-5nowmass recently annexed the Wildcat Ranch at very low,rural-like t
densities. Annexation could also occur through a flagpoie,with Pitkin County as a �?-
willing partner via our Brush Creek Road right-of-way. `

There is no Consistency with the County Comprehensive Plan. Attached for your
review as Exhibit"D"is a memorandum from Tim Malloy,Long-Range Planner. '
Staff has reached the conclusion that the proposed incorporation is not inconsistent �:
with the DownValley Comprehensive Plan. This is because the DownValfey Plan is
silent on incorporation. However,if one considers the future consequences gf a :
new town in this area of the counry,then the proposed incorporation is
inconsistent with the DownValley Plan-especially if commercial uses are ever � •
approved.

Staff is more concerned about the bigger question of incorporation throughout the ��
county. Is this the trend of the future? tNitl Pitkin Counry checkerboard into a ( •

- 4. The proposed area for the Town is urban in character, and has at least fifty
tegistered eIectors per squaze mile, since the total square mileage proposed for the town is.673
square miles and fifty-six registered electors have signed the Petition (56/.673 = 83); also,
Pitidn County Clerk and Recorder records indicate a[otal of 198�egistered electors reside there
(indicating a density of 294 voters per squaze mile). The urtder_. :ned is preparing a reauest to
the Pitkin Cou�ry Boazd of County Commissioners to hold a hc:.zng to consider whether the
Petitioners may hold an incorporation election. There is no factual basis for the Boazd to deny
the proposed election,and Petitioners therefore expect that Board approval will be forthcoming.
(Colo. Rev. Stat. §31-2-101 (3)).
5. Colo.Rev.Stat.§31-2-101(1.5)(Supp. !995)specificaily authorizes joining both
the issue of incorporation and adoption of a home rule charter in a single election. Petitioners
have met all of the statutory requirements for su:;mitdng the issue of adoption of a home rule
charter for election by the voters of the Town. These inciude the foregoing showings for
incorporadon, and additionally:
A. Tlie Petition is signed by at least five percent of the registered voters of
the proposed Town (using the voter registration list as a guideline indicates that 28.3
percent of the registered voters have signed). (Colo. Rev. Stat. §31-2-209(2)(a)).

De�-elopmenc Department's opinion re�ardin�� ti�e proposed incorporation oi the Brush Creek
��iltnge subdivision. Our comments on tltis issue��ili include msoonses to the appropriate criteria
fur incorporation as oudined in Seciion:1-'-lUl of the Culuracio Re�•ised Statutes ICRSI,as weil
as other re(ated comments.
. Section 31-3-IOt ofthe Cotorado Re��iscd Statutes includes seveml criteria Eor evaluating requests
for incorporation. The Community Develupment Department review of this request focuses
primarily on the issue of���hether the proposed incorpotation is inconsistent�cith any applicable
county or reeionaf comprehensive plan. In this case. the applicable comprehensive plan is the
Pitkin County Down Valley Plan ��-tuch�vas adopted in 1987. However. diere are also several �:::
polices included in the .�1CP (relative to the extended MeUO rlrea) that may also have some
significance to this matter.
The Down Valley Plan does not specificaily address incorporacion. It is likely that the Plan is silent
on this issue because the idea of incorporation in the down valley area of the County simply was
not anticipated. There is also no discussion regarding annexation of the Brush Creek Suhdivision�
thouer.�mexation is discussed as it relates to Snowm�ss and Basatt.
The Brush Cceek Subdivision area is identified as Rural Residential(RR)on the Future Land Use
Map incorporated within the Plan. While this designauon is generally intended for lands that are
appropriate for the preservation of nuai chazacter and low density residential development,the Plan
aiso acknowledges thai existing developmenu should be atlowed to continue. The Plan ihen goes
on to say that the expansion of such uses�vould be deemed"inconsistent with the land use concept
espressed by the Future Land Use Map." �
[t appears.that the incorporation of the Brush Creek subdivision is not inconsistent with the Down
Valley Plan;however.expansion of the subdivision or the creation of new commercial uses within
the Subdivision tvould be inconsistent tivith the Plan.Potential expansion is a significant concem
due to the fact that the ne�vty incorporated municipality�vould have aeu�exacion authority.

Another significant concern is the toss of control over the scenic impacts of future development and `'>
redevelo ment. Under Pitkin Coun .�'�
P ty jurisdiction,development is subject to review pursuant to the
Scenic Foreground Overtay regulation. This regulation is intended to minimize the impacts of ,,��
development as viewed from Highway 82 and Brush Creek Road. This concem is somewfiat �
minimized by the fact that the subdivision is mosdy built out; howevet, if redevelopment or
expansion were to occur on the developed fots it could resuit in significant additional visual
impacu. In addition.if annexaaon were to occur,these newly annexed properties would also not
be subject to scenic foreground revie�v. In particular,Siaff�vould be concerned about ihe potential r.�•
visual impacu associated with the development of the Cozy Point Ranch propem and other neazby �
propenies located adjacent to Hieh�vay 82. .

Villaee request for incorporation. As you will recall.I sent Tom Newland a memo on this issue. �`

potential for espansion of commerciai uses in [his area and that such expansion �vould be
• inconsistent �i�ith the Down Valley Plan. Most of the references Cindy requested that i review �'
support this conclusion I have attached excerpts from the Do�vn Valley P1an.These are the sections '
referenced by Cindv and they include discussion which may be relevant to the Brush Creek Viflage
incorporation issue. Basicalty,these sections provide information and discvssion ivhich supports t
our original conclusion regarding the concem for commercial expansion and the creation of a new
rura!growth center. There was also discussion of a Mazch 1986 Issue Paper.which I reviewed. I '

concept for the Down Valley Area, it is worthwhile to describe in
narrative form the concept depicted by the Future Land Use Map. . '

� commercial centers in the Roaring Fork Valley, generally sepa-
' i rated by rural and wilderness areas. The exception to this rule
� is the presence of several concentrations of residential land
� uses which are already in existence and espanded planned residen-
tial land uses in Woody Creek northwest of the Tavern and on the
east side of Watson Divide in the vicinity of Aspen Village. It
is anticipated that Transfer of Development Rights receiving
areas may be designated in these areas pending completion of a
t more detailed study of potential receiving areas. Housing
' oriented to locals, including sites designated ?MH, is encour-
aged.
The county will seek to steer resi3ential and commercial ?and
uses away �rom the visible portions of the State Highway 82 and
Srush Creek Corridors which are designated by the Scenic Fore-
ground to enhance the entrances to the resort �or visitors and
i residents. -New residential d'evelopment is permitLed in both
i
corridors, however, new structures within the designated Scenic
Foreground should be planned in a �anner consistent :rith t:�e
Scenic Foreground site planning guidelines. New commercial
development of any kind is stronqly discouraqed within the State
� • Highway 82 Corridor. The existing 200 toot setback for State
I Highway S2 should be maintained and the 200 foot setback regula-
tion shauld be adopted for the Brusk Creek Corridor. Unclassi-
fied lands located in the State Highay 82 Corridor should be

It should be noted that the founders of the existing "reactive"
land use regulatory system made a conscious decision not to *' .

, The rate control feature of our regulations makes the Pitkin ,
County Land Use Code more proactive than is typically the case in
other communities. Nevertheless, after approximately ten years

extensivc prcparation. Even if TOSV were to becomc interested in annexing Brush Creek
Vill2ge, the cime necessary to completc thc process would be at leas[one year,possibly
longer.
