G. Primary Residence-Consistent with the Affordable Housing Guidelines any RO unit must be the
owners'primary residence. Proof of residency, including, but not limited to,voter registretion and
automobile registration,shafl be required. _
H. Income/Eamings-Applicants must demonstrate that thetr income%amings are eamed primarily in
Pitkin Counry(80%). Applicants must demonstrate that tBey pay Colorado Income Tax as a Colorado

4. If a tenant does not meet the minimum Occupancy, Income and Asset requirements upon �
requalificatian or elects not to pay the requalification fee,the tenant may conUnue to rent and "'

1. An owner of an affordable housing unif desiring ta sell shoutd consult with Housing O�ce and
review the Deed Restrictlon covering the unit to determine the maximum sales price permitted and
otherapplicable provislons conceming a sale. Unless othervvise provided in the Deed Restriction,
" the unit must be iisted for sale with the APCHO and the APCHO staff will administer the sale in
, accordance with the Guidelines in effect at the time of IisGng. There shall be a minimum listing
period of three months before a unit's price ca�be readjusted. Any termination in the listing may �
require the payment of administrative and advertising costs. ',` .
�:�: 2. These Guidefines are intended to assure that ALL purchasers and ALL sellers will be treated faidy

C. SALES AN�OTHER FEES

1. Uniess otherwise set forth in the Deed Restrictions covering the unit,at the ciosing of the sale the
seiler wili pay the APCHO a sales fee equal to two(2)percent of the sales price, The APCHO
may instruct the title company to pay said fees to the APCHO out of the funds held for the seller
� at the closing. UNess otherwise specified in the Deed Restriction,a one-half percent(1/2%)fee
is paid by the Seller at the time of IisGng,which is applied to the total sales fee payable at closing.
In the event that the seller fails to pertortn under the listing contract,rejects all offers at maximum ' k�•
price in cash or cash-equivalent terms, or shoufd withdraw the listing aker advertising has
commenced,that portion of the fee w111 not be refunded. In the event that the seller withdraws for ,
failure af any bids to be received at maximum price or with acceptable terms,the advertising and
