1. The Aspen Consolidated Sanitation District (hereinafter b�� '� ;�_

"Applicant") has applied to the Pitkin County Board of County `, � '

� Review use Permit for the Applicant�s sZudge site. ° � ;

2. The subject site is comprised of approximately 55 acres and '�^ �

/-� is located adjacent to the W/J Ranch in Woody Creek, more �

_ � specifically described in Exhibit "A", attached.

3. The Board reviewed this application at a duly noticed and
� .
regularly scheduled public hearing on February 2s, 1995, at which �
time evidence and testimony was presented with respect to said �
application.
4. The App2icant's sludge disposal site has been continua2ly
� operated for this purpose since 1974 under consecutive Special �;
Reyiew Use Permits granted by the County. The Board last approved ' ' �
'``� a 5 year extension of the Special Review Use Permit for the sludge `'� .

site in 1989. The most recent annual review approval was granted �
'•,; , ; by.the Board in September of 1993. The ACSD 5ubmitted this current �

application for special review use in July of 1994. On November 22, i _

1994, the Planning and Zoninq Commission forwarded a recommendation
� of a roval to the Board for a ten ear extension of the Special � ,, ,

NOW, THEREFORE� BE IT RESOLVED by the Board that it does ;i":'��'�,=°

hereby grant a ten (10j year Special Review Use Permit for the `�;`,� ,�
Aspen Consolidated Sanitation District's sludge site, subject to '��'°�
the following conditions: ���J
�.�:
., - 1. The AppZicant shall annually submit a statement which ' -�-:
demonstrates the continued conformance of the use to the
conditions of the Special Use Permit to the Community
Development Director. The submittal shall include annual
' letters of compliance to be provided by the Colorado �
Department o£ Health or the Environmental Protection Agency,
whichever has jurisdiction. If, after reviewing the statement,
inspecting the site and considering any other relevant
materials, such as complaints from the residents of the W/J
housing development, the Community Development Director '
determines that the use is not in conformance with the
provisions of the Special Use Permit, the Director shall
recommend to the Board that it consider withdrawal of such
permit, pursuant to a duly noticed public hearing. The
statement shall be annually submitted to the Community
Development Department 45 days prior to the anniversary of
- approval by the Board af County Commissioners.
2. The District shall continue to monitor soil, ground water,
�: -) run-off, vegetation, and odor as required by the Colorado � ..
� Hiosolids Regulations or EPA 503 regulations, whichever is .
;,�i applicable. The operation of the sludge disposal facility
sha12 meet or exceed the objective performance standards of
the above regulations.
3. The noise level shall not exceed the current county noise
abatement regulations, as set forth in Resolution �92-06, and ;� '
as amended from time to time. ' . ;, �, ,

4. Sludge applied to the site or other material resulting from
disturbances of the surface in connection with the operation
at the site shall be retained and managed in a fashion that ,
; prevents potential pathogen from leaving the site. ` . ,,t;,

� 5. The applicants shall keep their gates locked, provide adequate �i;. '

8. Hours of operation shall be limited to 8:00 A.M. to 5:00 P.M. �`7
seven days a week, except in occasional emergencies when `�'-
operations shall not be conducted after 9:00 P.M. without the
approval of the Pitkin County Department of Health.
• 9. The District, in order to optimize mixing procedures, shall �
work small areas when mixing the sludge into the soil, mix
• frequently, and maintain a log of when odor conditions occur,
- relative to current weather conditions, to estahlish optimum
site use times.
l0. In regards to the visual impact, the Applicant shall�avoid use
of tall vegetation as a visual screen, continue frequent
planting•with native species and prohibit the outside storage
of equipment not directly related to operation of the sludge
site.
• 11. The District and County shall continue to cooperate with
" composting efforts at the County landfill until it is mutually � ,
`._ i determined that it is no longer beneficial ta do so.

' ' 12 The applicant shall continue to keep abreast of alternative r
'� --I treatment methods and seek other disposal areas which would
� utilize sludqe for agricultura2 or other uses.
13. Any significant change to the operations shall require an _
- amendment to this Special Review Use Permit shall constitute �
a new application and shall require a repetition of the �
procedures described in Section 3-20 of the Code. Minor r+! �
changes to the use may be authorized by the Community ��"
I Development Director without additional public review. �.
� 14. No solid wastes other than soil cover material and stabilized ''
