' A RESOLUTION OF THE BOARD OF
COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,
APPROVING EXPENDITURES TO BE FUNDED FROM THE
PITKIN COUNTY 1/2 CENT TRANSIT SALES AND USE TAX

RECITALS
1. The Aspen City Council, the Pitkin County Board of County Commissioners and
the Town Council of Snowmass Village (the "Parties ") have previously identified general
-- elements of their Comprehensive Valley Transportation Plan (the "Plan ") which are eligible for
funding from the Pitkin County one -half cent transit sales and use tax.
2. By intergovernmental agreement dated September 14, 1993, the Parties agreed:
a. to conduct regular public meetings to continue to refine and agree upon
! proposed projects and transportation elements consistent with or complimentary
to the Plan; and
b. that all expenditures and projects to be funded from the County -wide one-
half cent transit sales and use tax shall be agreed upon by the Parties and
evidenced by a resolution adopted by the governing body of each party.
3. In November of 1993 Pitkin County voters authorized the issuance of up to
$13,650,000 of revenue bonds for the purpose of improving the public mass transportation
system in the Roaring Fork Valley (the "Revenue Bond Authorization ") if such improvements
are authorized by agreement between the Parties.
4. The United States Treasury has issued regulations requiring local governments
i to officially declare in advance their intent to reimburse project expenditures by incurring tax -
exempt debt.
5. At a public meeting held in the Aspen City Council Chambers on February 16,
1995, the Parties considered and approved several projects to be funded in 1995 from the Pitkin
County one -half cent transit sales and use tax and approved a request from the Roaring Fork
Transit Agency to use up to $1,325,000 of the Revenue Bond Authorization for the acquisition
! and equipping of a downvalley maintenance facility.
6. By adoption of this resolution Pitkin County wishes to ratify the approvals given -
at the February 14th meeting and declare its intent to reimburse project expenditures by issuing
tax- exempt debt.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado, that the following expenditures are hereby approved from the Pitkin
County one -half cent sales and use tax for 1995:
RFTA debt service for 5 buses $ 146,000
Expanded RFTA bus service 735,000
Project management and administration:
management contract closeout 10,000
meeting support and financial administration 10,000

' AND BE IT FURTHER RESOLVED that (1) RFTA is hereby permitted to use up to
$1,325,000 of the Revenue Bond Authorization for the acquisition and equipping of a
downvalley maintenance facility, (2) the expenditures for this project may be made from RFTA
funds prior to the issuance of the bonds and then be reimbursed from bond proceeds, and (3)
this statement is a declaration of official intent under Treasury Regulation Section 1.103 -18.
