RESUBOIVISION OF ASPEN RIVER VALLEY RANCH, LOT N0. 8 � .

WHEREAS, Michael J. Fitzgerald and Therese N. Fitzgerald (hereinafter
referred to as applicant) are the owners of record of 40.51 acres of real . !

property known as Aspen River Valley Ranch, Lot No. 8, and ��

� 4JHEREAS, the applicant has requested a two-unit subdivision of the t.
subject parcel so as to create a 17.75 parcel and a 14.26 acre parcel with �

the balance of the property, 8.5 acres, being dedicated as canmon open space,

WHEREAS, a _public hearin9 was held before the Board of County Comnissioners
��:` on August 25, 7980 at which time evidence and testimony were presented with i;
�f respect to this application. `,:

j; NOW, THEREFORE BE IT RESOLVED 6y the Board of County Commissioners of �

�R� Pitkin County, Colorado, that final plat approval for the two unit resubdivision
of Aspen River Valley Ranch, Lot Wo. 8, is hereby granted subject to the �'
following conditions: �px
` ,, 1. The final plat shall include the approved easement dedication �"
language, and
2. The recreational easement shall be amended to read "public recrea- ;.�,=
tional easement", and
3. Changes may be made to the final plat subject to the requirements '

of the County Engineer, and
4. A deed restriction against further development.
