AMENDING SECTTON 3-8.5 OF THE LAND USE CODE
� •• CONCERNING THE CALCULATION OF LOT AREA :

WHEREAS, the Board is cognizant of the need to further
elaborate and clarify what encumbrances on real property should be �

- taken into consideration when computing lot area and yards for �
purposes of Section 3-2 (area and bulk requirements) , j
� NOW, THEREFORE, BE IT RESOLVED Hy the Board of County �
Commissioners of Pitkin County, Colorado, that Title II Section 3-8.5 �`

of the Pitkin County Code (Land Use Code) be repealed and reenacted
� to read as follows:
, "3-8.5 Calculating Lot Area
(a) in calculating lot area and yards, the
following areas shall be excluded:
: ��
_�_ : (1) Areas under natural water courses �
�r up to the historic mean water line.

� (2) Areas witl�in any public or private
access right of way.
(b) In calculating lot area and yards, there
shall be included areas within public
and private subsurface easements." �s
