(NON—CONFORMING USES) TO PRESERVE EXISTING
LODGE USES

Resolution No. 81- 49 �
WHEREAS, the Board of County Commissioners has determined that
the retention of existing non-conforming lodge uses is in the public _
interest and wishes to provide for the same,
+ NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners �
of Pitkin County, Colorado, that Title II of the Pitkin County Code �

(Land Use Code) be amended by the addition of a new Section 7-1.13 to !
read as follows:
Ct "All hotel, motel and lodge uses that were lawful when �
established and continuously so used thereafter shall
be entitled to continue and be deemed allowed uses;
� provided, however: �

(a) The use cannot be enlarged.
r ;
�k (b? Any change in use shall not be to a use of a
� ' lower or less restrictive classification, but �
�, rather to a use of the same or higher classifi- �
,� cation, and only on receipt of special review
use approval pursuant to the pzovisions of the `
� Code.
(c) The use cannot be restored if all of the structures
above the foundation have been destroyed, nor resumed
if discontinued for more than one year, unless 9`
special review use approval is received pursuant to ��
� the provisions of the Code. The use may be restored
and resumed onlyin substantially the sa� form and
location without enlargement.

f (d) With respect to discontinuance of use for one year,
< the submission (and diligent pursuit) of a good
faith building permit application within said one
year period shall toll said period, and the use
may be resumed on completion of construction, �
provided that the same is resumed within thirty
(30) days of issuance of a certificate of occupancy."
BE IT FURTHER RESOLVED that the existing Sections 7-1,13, 7-1.14, F
7-1.15, 7-1.16, 7-1.17 be renumbered 7-1,14, 7-1.15, 7-1.16, 7-1.17 1
and 7-1.16 respectively. �
