AMENDING THE AIRPORT REGULATIONS �
TO PROVIDE FOR CONDUCTING
c ADMINISTRATIVE PROCEEDINGS BY A DESIGNATED

HEARING OFFICER OR OFFICERS � "

WHEREAS, the Board is authorized by Section 2-7.2 of the Home
Rule Charter, to delegate any of its powers, duties and functions "as
it in its sole discretion may deem necessary or desirable from time �

• to time.", and
WHEREAS, the Board wishes to delegate to a designated hearing
� officer (or officers) the authority to conduct administrative hearings
Fa provided for in Title IV of the Pitkin County Code (Airport Regulations) . �
¢ NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado, that Title IV of the Pitkin County Code F�
��'t (Airport Regulations) be amended by the repeal and reenactment of
� � Section 50-3 to read as follows:
"50-3 In addition to (or in lieu of) the penalties ,�
� provided for in Section 50-1 and 50-2, the Board Y
of County Commissioners, or any hearing officer _
(or officers) designated by said Board, may,
subsequent to notice and hearinq, prohibit the use
and/or occupancy of Sardy Field by any person, t�.
t firm or corporation, either permanently, for a �
stated period of time, and/or under such terms
t and/or conditions as are reasonable under the
� circumstances. During such hearing anyone charged
` with violating any airport regulation shall be
afforded the right to be represented by counsel; ' '
' ; to present and submit testimony and evidence; to -
cross-examine other persons giving testimony; to
require (or request) that all witnesses be placed
under oath; to a record of proceedings; and (on €
request) a written decision setting forth the �
findings of fact and conclusions, with reasons or
� basis for said decision, on the material and
( relevant issues presented in the record. The Soard
r or hearing officer (or officers) shall not be
bound by formal rules of evidence, but may consider �
any matters which they, he or she conclude is
reasonably reliable and calculated to aid in �
reaching a correct determination of the issues
� involved." �
