COLORADO, CONCERNING THE APPLICATION
OF LITTLE ANNIE LIMITED PARTNERSHIP FOR I
SPECIAL REVIEW ApPROVAL

WHEREAS, Little Annie Limited Partnership (hereina£ter "Applicant") j ,

_ has submitted an application pursuant to the provisions of Tztle II �

of the Pitkin County Code (Land Use Code) (hereinafter "Code") Eor �

special review approval for the development of the Little Annie Ski �
Area (hereinafter "proposed ski area" or "project") and �

WHEREAS, the Board has previously made certain findings with

' respect to the project contained in the Board's resolution No. 81-50, and
WHEREAS, the Board wishes to amend its findings all as hereinafter
described, �

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners ��
that it does hereby amend its Resolution No. 51-50 in the following �
manner:

The Applicant has submitted a considerable amount of %

1 information to date; however, certain deficiencies in the �
application with respect to these poiicies remain. The !i ,
Soard requests all additional information and submissions ''

required by the Code and makes this request pursuant to t'
Section 6-3.4(d) (3) (B). �.

In addition, the Board has found the following policies
contained in Article 2 of the Code are technical in nature

at a minimum such agreement shall place no limitations on ��

the use and disposition of the funds; provide that payments .
shall be made in perpetuity without regard to any change in r} !

circumstances; and shall include a waiver by the Applicant
of any challenge to the enforceability of such provision." �
