TEMPORARY USES, OF THE PITKIN COUNTY LANU USE CODE
Resolution No. 81 - 131
WHEREAS, the County Attorney and Planning Offite have initiated a code .
�
" � e amendment for the creation of a new category of Temporary Uses, which has �
I .
received the Planning and Zoning Cortsnission's recortenendation for approva�,
and
WHEREAS, the Board did consider the recortanendations of the Planning Off.ice,
' �
the Planning and Zoning Commission, and the members of the public at a public e
hearing held December 74, 1481, and wishes to adopt the code amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
� Pitkin County, Colorado, that it hereby amends Section 3-8.11, Temporary Uses,
of the Pitkin County Land Use Code by the addition of a new subparagraph (d) �
, to read as follows: �
� "The Board of County Commissioners may, upon receipt of an application �
�� tfierefore, permit the issuance of a building permit for a single family �
residence whi.ch is intended to replace an existing single family residence
# on the same parcel of land notwithstanding the occupancy of the existing �
single family residence during the pe�dance of construction of the rep7ace- �
± ment residence prov9ded the applicant executes an appropriate guarantee
i.n a form acceptable to the Board which will insure the cessation of the
use of the exi.sting resi.dence as a single family dwelling upon the
issuance of a certificate of occupancy for the replacement residence.° �
