Rivexs) and THE BOARD OF COUNTY COMI�fISSIONERS, PITKIN COUNTY, ?

COLORADO (hereinafter xeferred to as the "County") to be
completed during the calendar year 1981t �

W I T N E S S E T H: �

WJ3EREA5� the County and MountaSn Ri'vers recognize the

need for a detoxificatibn facility availatile to Pitkin County �
,
residents, and
�: YTHEREAS, Mountain Rivers has demonstrated their ability ,t
� to adequately administer and provide quality non-medical detox-
ification services, and
{1�I�EREAS, Mountain Rivers facility has been relocated
and reopened for services since the fire which occurred in 1979, �
- and t�,;
WHEREAS, the parties wish to establish a method of }

payment foT these services; �
NO{V, THEREFORE, in consideration of. mutual benefits to �.
be derived herefrom, the parties hereto agree as follows: }�
1. Services To Be Performed E`

A. Mountain Rivers will maintain a non-medical �
detoxification center and substance abuse
treatment and rehabilitation facility.
B. Mountain Rivers will provide emotional support, � �
involve client in counseling and facilitate
transfer of client to continue treatment as � �
necessary. �

C. Mountain Rivers will comply with all Colorado �
' Department of Health regulations for non- �
medical detoxification care. � �
. D. Mountain Rivers will explore the establishment �
of an emergency transportation system for use � i
in conjunetion with their facility. � �

2. Payment For Services Performed

A. Mountain Rivers shall bill Human Resources '
� Department, Pitkin County, for local residents
on a monthly basis, identifying clients, � .
� number of days enrolled per client and type �
of services provided. +
i

B. Pitkin County agrees to pay Mountain Rivers on �
a monthly basis following review and accept- j
ance of billings by the Human Resources Coordin- f
ator. The unit of service for billing purposes �
! shall be Detox Day or Aalfway House Day. �
. C. Reimbursement rate for the unit of service shall k
. be $15.93 per day for Detox clients (not to exceed C
7 days), and $4.67 per day for Halfway House `
clients (not to exceed 30 days). The above amount �
may be increased according to daily increases in �
cost per client which is the amount required by
E the State in order to meet the 25 percent which
Mountain Rivers is mandated to collect locally. �
D. The maximum payments by Pitkin County for services �
_ ' during calendar year 1981 shall be $3,000.00. It
-` is agreed that services for all eligible clients �-
� will continue throughout Calendar Year 1981 even
• though monthly billing may exceed $3,000.00. How- ;
� ever, should actual service be below the projected s
level and monthly billing be equal to less than s'
� �3,000.00 Mountain Rivers will be
actual client days provided, as indicatedlbyfor {

billi�g. ,

E. All billing will be submitted with the understand- 3
ing that all other sources of money are to be c
- explored and persued, especially the resources
that the patient himself has available. The bill- �
- ing may be paid by other entities than the County �
(e.g. private insurance). The remaining portion
of the unpaid bill may be billed to the County
(the State covers 75 percent of the cost and the
money concerned with here is the remaining 25 ��
percent as described above).
F. These unit costs will be renegotiated before a !
contract is established for Calendar Year 1982.

G. This agreement is contingent upon continuing �
State and Federal funding after July 1, 1981.
3. b4ountain Rivers agrees to imdemnify and hold the t �
County harmless for any and all claims for loss or �
damage arising from the operation of the detoxification '
, facility and provision of the services herein con- j
tracted for. I
4. This contract may be canceled and terminated by �
either party, but the party desiring to terminate or
cancel must give written notice 30 (thirty) days
prior to the date of cancellation. �
5. By subscribing to this Agreement, the parties represent : �

necessary approval and authorization to enter into , '
this Agreement.
