THIS AGREEMENT made by and between the CITY dF ASPEN, COLO-
RADO (hereinafter referred to as "City") and TOGJN OF SNOWMASS �
VILLAGE, COLORADO (hereinafter referred ro as "Town") and the �

BQARD OF COUNTY COMMISSIONERS OF PITRIN COUNTY, COLORADO (herein- *
' af ter ref-erred ko as "County"}.

W I T N E S S E T H:
WHEREAS, there exists a need for a joint communi�ations sys-

tem serving the City, the Town and the County, and
WHEREAS, by agreement dated February 23, 1976, a Joint
-- . Communications and Emergency Services Board was created, and !'

� # WfiEREAS, all the parties hereto desire to enter into a joint -

interyovernmental ayreement regarding the operation and mainten- ;:F

ance of a joint communications system"which agreement is intended
by the parties to replace and supercede the joint ayreement orig- �;
inally made February 23, 1976, establishiny a Joint Comraunications 7

NOW, TtIEREEORE, THE CITY, TOWN AND COUNTY AGREE AS FOLLOW5:

1. It is hereby agreed and understood that this agreement -
shall replace and supercede the joint ayreement ori�inaliy inade on `
ri
February 23, 1976, establishinq a Joint Communications and Emer-
gency Services Board, together with all subsequent agreements,
amendments and addit_ions pertaining thereto. �
2. The parties hereto ayree to operate and maintain a joint �
communications system serving each of the parties. The operation

a. City Manager of the City of AsYen; ��

c. SheriEf of Pitkin County or, should the County so �
designate, the Undersheriff of the County of Pit-

d. The City of Aspen Police Cnief i5�; should the City
designate, the Deputy Police Chief of the City of
aspen;
e. The Town of Snowmass Village Marshal or a law �
. enforcement officer designated by the Town.
3. It is ayreed and understood by the parties that the
Board shall have the following duties, responsibilities and powers
regarding the opezation and maintenance of the joint communica- �

f. Establish yuidelines for providiny communications
center radio services to all appropriate public
service agencies as is feasible and appropriate.
g. The Soard shall meet quarterly and at such times as
' ' requesked by either the Director of the joint com- ?

munications system or a Board member. �
4. The parties agree and understand that the joint communi- �

cations system wi11 function and operate through a communications .
• center which will be housed and located at the City oE Aspen
PoZice Department, City Hall, Aspen, Colorado. The operation of
the communications center shall be supervised by the Director, who
_ shall have the following authority, duties and responsibilities:
a. Responsibility for the day to day operations of the

_!t;��: communications center as directed and within the

� ,:�' policy guidelines established by the Board.

� -� b. Employ and discharge all communications center
�<�,
_�; personnel.
� c. Prepare and recommend to the Board an annual oper-
ating budget which shall set forth the percentage
_- - of operatittg costs attributable to the City, County
�°�"� and Town.

5. It is agreed and understood between the parties that the
communications center shall perform the followiny communications,
computer services, record keepiny and �niscellaneous functions:
a. Communications:
•�� 1. Receive calls from the public on t_he emeryency �
and dispatch phone lines and those transferred �
w� by all user agencies for emeryency service. � I

2. Dispatch such calls to the appropriate agency �

personnel. ,
3. Provide requested Colorado Crime Information !�
- Center ("CCZC") and National Crime Informat_ion � 1

1. House, file and maintain all records and

� � ayency housing the jail facility (i.e. the

County of Pitkin Sheriff's Office) .
� 2. Combine the Town's information into the master
. index cards per copies of reports supplied.

+ 7. This agreement shall become effective on the date of the �

signatures of a11 parties hereto and shall be renewed on an annual
- basis as provided in Section i2.
8. It is hereby agreed and understood between the parties
that any party hereto may terminate this agreement by six (6) (
months' written notice to the other parties, and it is agreed that �
such termination will not affect the rights and interests acquired I�_
�,�� by the respective parties during the term of this agreement if

� such interest has, in fact, been acquired. If reimbursement is
" � to be made, it shall be based on services performed and work com-
pleted to date. It is the furkher understanding of the parties
that if and when said termination a:curs the City, County and Town
shall split owned capital equipment, it any, on an equitable basis
acoording to the financial contribution of each.

9. The 1981 budget for the Joint Communications Center

or other shall be teviewed by the Communications Board and for- �

warded on to the governing bodies of each party for confirmation. �

_ No party shall be liable for over expenditures made by another i :
-- �party unless these expenditures are formally agreed to by the

governing bodies of each party.
11. Any revenues or qrant incomes which might be received as
� a direct result of the Communications Centet Department shall be '�
shared by all three parties to rhis ayreement on a pro rata basis S
�
� in accordan�e with their share of the annual operaking costs.
12. It is the understanding of the parties that this agree-
� ment may be renewed on an annual basis with appropriate budget
preparations included for each successive year. The budget shall �
be approved by the Communications Center Board and forwarded on to
�i!`� the qoverniny bodies of all parties to this agreement £or their
� .
� approval.
13. The financial administration for this agreement shall be

�ti provided by the City at no charge to either the County or the
Town. �
14. The County and the Town shall, on a monthly basis, con-
- _ tribute 1/12 their annual budget amount ($83,388 - County, $14,502
- - Town), to the City.
15. A final ac�ounting of all revenues and expenditures for
" the program for the prior year shall be completed by March IS of �
the subsequent year, with final pay�nent adjustments between the �
parties to be made on or before that date.

The Colorndo Bureau of Investigation,hereafter called the CBI, n crim�nal justice agency !
serving as the National Crime Intormation Center (NCIC) control terminal agency in (
Colorado, and as the opeenting agency of the Colorado Crime Information Center(CCIC)
system,a�rees to furnish to the , hereafter called the User,
such information as is available in and/or through the CCIC system subject to the
following provis?ons. '
The User agrees to abide by all present rules, policies nnd procedures of the CCIC as
approved and procedures he�einafter•approved by the CCIC Policy Advisory Board and
adopted by the CBI. The User also agrees to comply ivith all state and federal statutes
and reglations as may upply.
The CBI reserves the right to suspend furnishing CCIC service to the User when either the
security or dissemination requirements approved by the Policy Advisory Board and adopted i�*.,
. by the CBI are violated. The CBI may reinstate teletype service in such instance upon ���,
receipt of satisFactory assurances that such violation has been correefed. f.
Either the CBI or the User may, upon thirty (30) days notice in writing, discontinue (
service. �
