1. The Board of County Commissioners of Pitkin County

(hereinafter "Board") has reviewed a request by the Pomegranate
East Condominium Association, Maroon Creek Limited Liability
� Company and Pearce Equities II, Limited Liability Company �
- (hereinafter "applicants") for Rezoning, Major Plat Amendment and
Scenic Foreground Overlay review for the Pomegranate East
Apartment site located in Pitkin County.

2. The applicants have also requested rezoning of the subject .
property from AFR-2 to AR-2. This rezoning request has been

3. The purpose of this request is to eliminate the non-conforming

� lighting on the north or west sides (facades facing Highway `
�?� 82) of the proposed garage structures. If the applicant �f "
� wishes to install safety lighting near the garage entries, �'
� they must be wall mounted units located far enough down the ty

Highway 82 by the landscaping on the property. All lighting
fixtures must also meet the lighting standards in the Land �
Use Code. The applicant may also instail two bollard type
lights, no more than 30 inches in height, along the west �t.

4. Exterior building materials sha11 be non-reflective and shall
