- RECITALS '�*� ;�
1. Pitkin County, hereinafter "Applicant", has applied to �j�',:,
_ the Board of County Commissioners of Pitkin County, Colorado,
hereinafter "BOard", for approval of a Minor Amendment to a �'�`
Development Permit, pursuant to Section 3-1408 of the Land Use
Code.
� 2. The Applicant is requesting approval of minor amendments
to the previous approvals (Resolutions #90-73 & #89-19) for
� the State Highway 82 relocation project. The minor amendments
i
"•�'� � will address some changes in Federal Aviation Administration
regulations and minor alignment changes on the south end of
the project. Further, the State of Colorado through the
Department of Transportation and the Aepartment of Revenue '
�- '-=-=� have requested a widened shoulder to allow for Department of -
r; ,'� .
Revenue weigh stations on Highway 82. The Applicant also
-- requests the removal of a previous condition which required
that a crossing for wildZife be constructed in association ( ,
� . , . . � : 7,l �
with the Highway 82 project. .: � "
� 3. The Board considered the Applicant's request at a public
: i , meeting on June 6, 1995 at which time the Board found that �y�
i �,
�' the Appliaant's request meets the requirements of the Land Use

�; l. The Applicant shall adhere to all material sepresentations ,,:
,� made in the application and in the public meeting. ���

F� 2. The Applicant shall comply with the provisions of the 1041
� Hazard Review approval (Resolution #90-73) granted for the '�t
� Relocation of State Highway 82 , except as otherwise modified ' �:
„ � by this and other additional or subsequent approvals. �^" '

€ 3. Condition #1 of Resolution #90-73 shall be modified to allow
the Applicant to pursue an agreement with the Colorado .'�
Department of Transportation for the construction of a `
wildlife crossing (Highway 82 bridge) as recommended by the
Division of Wildlife. �¢a
4. The Applicant shall obtain a Section 404 Permit from the Army q
, Corp of Engineers, prior to the issuance of an earthmoving
permit. r' .
5. The Applicant shall submit a Revegetation and Landscaping Plan
=+ to the Community Development Department for approval, prior
. � to the issuance of an earthmoving permit. The Plan shall
include a planting plan and planting schedule which addresses
the size, species, location, and timing of all proposed �
revegetation and landscaping associated with the Project. The I
Plan shall include the provisions for screening the Sardy ; � .
`�' residence from the realigned highway. .

�'-_.�� 6. The Applicant shall submit a wetlands mitigation plan to the ;
i Community Development Department for approval, prior to the ''�
, � issuance of an earthmoving permit. �
f 7. The abandoned section of Highway 82 shall be removed and ,�
j revegetated one (1) year after project completion or by • .y'�;� ,
November 1, 1996.
8. The Environmental Health Department will require a Fugitive
Dust Control Plan for the realignment of Highway 82 project �
and the removal of the old section of roadway, prior to the
issuance of an earthmoving permit. �� �.
