1. James Duke("Employee"),l�as filed an appeai of an employment decision -'3;`� ,•
made by the Director of Public Works,pursuant to Section 535 of the Pitkin County ` �

2. On December 15,1994,the Employee was terminated from l�is `
emgloyment with Pitkin County. Fotlowing the termination,the Employee filed a � •
,, ' grievance with the Grievance/Appeal Committee,which was heard on May 18,1995. �` `
: 3. The Grievance/Appeal Committee concluded that the termination was for
cause. The Employee appealed the Findings and Conctusions of the Personnel Board to i,+�
the Boazd of County Commissioners.

4. The Board of County Commissioners received the record of proceedings
before the Grievance/Appeal Committee. The recozd consisted of the notification of
termination,the Employee's notice of appeal,the uanscript of the hearing with exhibits,
the Findings and Conclusions of the Personnel Review Board Committee and the letter
;�
rejecting the Grievance/Appeai Committee and the notice of appeal to the BOCC.
5. Following a review of the record and having considered the Employee's
,; performance evaluations and Yhe terms of the Personnel Policies and Procedures Manual, �
the BOCC finds that the action taken by the Director of Public Works was for canse , t'
- justified and appropriate under the circumstances.

NOW THEREFORE, be it resolved that the Board of County Commissioners of
' � Pitkin County hereby affirms the ternunation action taken by the Director of Public
Works and adopts the Findings and Conclusions of the Grievance/Appeal Board.
