1. James Duke("Employee")filed an appeal on November 28,1994,of three �
written reprimands relating to job performance, a thirty day suspension and a F��
reassignment of employment duties,pursuant to Section 535 of the Pitkin County `"'a' �
Personnel Policies and Procedures Manual;and ''�'�-
�,;
2. On December 16 and 20,1994,the Pitkin County Grievance/Appeal �„-�
��. Committee heazd the grievances filed by the Employee;and
3. On January 3,1995,the GrievancelAppeal Committee issued its Findings a'�.
in the matter and detecmined that the three written reprimands,the thirty day suspension
- ; ' and the reassignment were all for cause and a�rmed the disciplinary actions taken by the '

Director of Public Works with regard to the Employee;and t
4. On January 19,1995,the County Manager notified the GrievancelAppeal 'E�
Committee of his affirmation of the Board's Findings;and the Employee appealed that `��..�''
decision to the Boazd of County Commissioners;and
5. The Boazd of County Commissionets received the record of proceedings
before the Grievance/Appeal Committee. The rewrd consists of the disciplinary actions `�•:
' taken by the Director of Public Works,the Notice of Grievance,the transcript of the f
hearings with exhibits,the Findings of the Personnel Review Board,the Memprandum to �f ; •
�- the Grievance/Appeal Committee from the County Manager,the Memorandum to the . �
��� Employee from the Counry Manager and the Notice of Appeal to the BOCC;and ;z

6. Following a review of the record,and having considered the Employee's ,y
performance evaluations and the terms of the Personnel Policies and Procedures Manual, �
the BOCC fmds that the disciplinary actions of the Director of Public Works were for %1 1
causg and the action of the County Manager in upholding the Findings of the r'� �`�!
Grievance/Appea(Committee was for cause.

NOW THEREFORE,be it resolved that the Boazd of County Commissioners �
hereby affirms the Findings of the Grievance/Appeal Committee and affirms the action of ; :, �'
the County Manager in upholding those Findings. ;i,:� �+;
