1. The Board of County Commissioners (BOCCj is concerned ••?•'
about the quality of surface and ground water in Pitkin County, and .i1f�-'
realizes the potential irapact individual sewage disposal systems ;.a-
(ISDSj pose to these aqui£ers.

2. The BOCC realiaes the public health impacts of surface and �� •� ,
ground water deterioration as the result of subsurface discharge
� of waste water. �2 �
3. _The BOCC recognizes the fact that all areas of Pitkin �
County cannot be served by public sewage collection systems, and �!�
in such cases, the technically correct method of sewage treatment
• , is by the installation of ISDS.
4. The BoCC recognizes that establishing minimum design
standards for ISDS using souhd scientific and technical practices
is necessary to assure long-term protection of surEace and ground
� - water in Pitkin County.
5. The BOCC recognizes their ability to adopt ISDS
' requlations specific for Pitkin County, using the Colorado
°GUidelines On Individual Sewaae Disnosal Svstems", Revised 1994,
- as a minimum standard.
6. The BOCC realizes they can make sections of the Pitkin �� .
County ISDS regulation as strict, or more strict than the Colorado
�.. �
Guidelines.
NOW THEREFORE BE IT ORDAINED by the Board of County
Coatmissioners of Pitkin County, Colorado that the PITRIN COUNTY
- INDIViDUAL SEWAGE DISPOSAL 8YST8H REl30LATIONB, Revised 1995, are I .
adopted, and will become a section in the Pitkin County Code. • ,�; ,

� The purpose of this regulation is to preserve the environment and protect the public �
health;M eliminate and control causes of disease,infection,and contamination;and to �,�

reduce and control pollution of the air,land and water.The Pitkin County Board of
� Health therefore declares it to be in the public interest to establish m;n;m�n standards, ' "
rules,and regulations for Individual Sewage Disposal Systems(ISDS's)in Pitkin
County.These regulations provide the authority for the administration and �{ ,>;
enforcement of such minimum standards,rules,and regulations. �

� The Pitkin County Board of Health declazes that its policy is to require the use of public .
. ' sewer systems whenever feasible.Its policy is to limit the installation of ISDS's to azeas
i where public sewer systems aze not feasible.

� 1-2 Regulation Coverage,Systems Requiring both State and Local Approval
An ISbS with a design capacity greater than or equal to an average daily flow of 2,000
' gallons per day must be approved and pernutted by the Colorado Department of
Pablic Health and Environment Water Quality Control Division("Division').
• However,local ISDS reguladons then govem all other aspects of permits,performance,
construction,alterarion and installation.For all systems of any capacity,the owner or
agent must submit an ISDS application to the Aspen/Pitkin Environmental I
I � Department,("Department")The Department will then determine whether state
� z�= aPProval is necessary.

� The Department may not issue an ISDS permit if the property is in a municipality ar
special district that provides sewer service,eaccept where the municipality or district • � `
determines sewer service to the property is not feasible.The Department may require a ,; ;

feasible,so it may issue an ISDS pemut.

� experimental system faIls. The local Boazd of Health may not arbitrarily deny any
person the right to consideration of an appIication for such a system and shall apply �

" 421 Prohibition of TSDS's in Unsuitable Areas:The local Board of Health may ";�
conduct a public hearing,after written notice to all affected property owners as shown `
• { in the records of the cownty assessor and publication of notice in a newspaper of
general c'uculation at least ten days prior to the hearing,to consider the prohibition of
° permits for ISDS systems in defined azeas that have or are subdivided for a density of �•
more than two dwelling units per acre. The local Boazd of Health may order such
- --- prohibition upon a finding that the construction and use of additional ISDS's in the t� ; '
�� °•- defined area will constitute a hazard to the public health or the environment. In such a �
