is to define the agreereiit concerning grazing of cattle owned by Michael Strang on

1. Michael Strang wi.11 agree to the following: �

a) Cattle brought onto the pmperty will be awned by Michael Strang or family. ;
Any cattle or other stock belonginq to other awners will be allaved onto �
the Pmperty only aftes pri.or mutual agre�nPnt between Strang ani the cbunty. �
b) Michael Strang will be responsible for regular rnnitoring of the health of '�
tne cattle and will be responsible for the treaiinent of sick or injured �

i� c) Michael Strang and/or his enplayees will be admitted to the pmpexty at any
; time for the purpose of such ironitoring, treatme�zt, or other activities �
directly associated with t'ze manag�nent of the cattle provided that:
(i) No motAr vehicles be used on the pmperty except during ernxgencies
or for the transportation of ani.mals to and fran the property. �
(ii.) No do45 acc�nPanY Mr. Strang or hi.s e�loyees.
(iii) No manag�ent activities which might interfere wi.th pvblic use of the 4 :
area taY.e place without prior consultation with the Coimty.

d) Michael Strang wi.11 be responsihle for Eence repair and maintenance connected �
with the day-to-day management of the cattle. Costs associated with extra-
ordinat.y repair or maintenance of fences will be eligible for rebate fran

grazing fees, such rebates to be negotiated on a case-by-case basis. I
(
e) Michael Stsang will be similarly responsible for maintenance and renair of k
irrigation ditc.'ies on the property. I

f) Michael Strang wi.11 pay the County $10.00 per cow-calf �;r per month and
$10.00 per yearling bull per month, such paytnent to be calculated fmn the � I

allowed on the property at any one time.
- 2. Pitkin Cbunty agrees to:
(a) Re��r airl maintain entry 4ates in and out of the propei-ty. 4
(b) Not enter into grazing agree�mmnts with third parties without prior
ama„g�nt and agreeirnnt with Mr. Strang. �L

(c) Prevent harass!�ent of the cattle by manbers of the public.

3. Michael Stsang agrees to ind�trtv.fy and hold Pitkin County, its agents a�
a�loyees, free fran any claims, or loss for injury or property damage �,

� arising by reason of the foregoing agreenent, and further waives any and ��
all claims against Pitkin Oounty for loss of or injury to :�is cattle without
, regard as to whether that loss is attributable to the actions of the County, � ��

�t-' its a[�loyees, agents or licensees.

' 4. The term of this agre�[ient will be frcm Jime 15, 1981 through Novanber 1,

1983. It can be renegotiated or ahrogated at anytime during that period � .•,
by mutual agre�nent of the parties involved. � `
