WHEREAS, Gary and Carol Gidley are the owners of a parcel of land located �
in Section 8, Township 95, Range 85 W, 6th P.M., (more specifically described ,

in Attachment A),and �,
WHEREAS, an existing garage/storage area exists on the property and ��
. ,�-
application was made under Resolution 80-43,
WHEREAS, existence of a 30 foot wide easement was verified by an attorney �
�
through a title search, and [
E�WHEREAS, a pu6lic hearin9 was held before the Board of County Comnissioners ,
I
� at their regular meetin9 on July 13, 1481 at which time the recomnendations �_
�:
�#' of the Planning and Zoning Comnission, the Planning Office, referral agencies 3�
;� and members of the general public were accepted. �
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of '
�:
Pitkin County, Colorado, that Sepcial Review approval for an additional
dwelling unit on the Gidley property is hereby granted subject to the following
_ conditions: '
1. The applicant be required to join a homeowner's association or improve- }
ment district should they be formed in the future.
2. Conformance with Section 5-205 of the Pitkin County Land Use Code
• (Adequate Provision for Water Needs).
3. The applicant shall, by deed restriction or other permanent comnit-
ment running with the land, guaranty that the additional unit shall 'T
remain a rental unit; not be condominiumized; be restricted to the �€
low income maximum rental limitations for one bedroom units as may
from time to time be established by the Pitkin County Housing Author-
ity; be limited to occupancy by not more than two (2) adults who ;
qualify as (and have been found by the Housing Authority to be) low �+
income tenants under such guidelines as may from time to time be �
established by said authority; be rented for terms not less than
six months. All units approved hereunder shall be registered with •; �
. the Pitkin County Housing Authority which shall verify the qualifica- >
tions of all occupants. �
