;3° commonly known as the Heatherbed Lodge property and more specifically described

WHEREAS, Joe E. Cooper and Steve C. Peer (hereinafter referred to as

�,� °applicant") have entered into a receipt and option contract for the purchase

;;,_j WHEREAS, the applicant has submitted a development proposal under AR-2
;,;�� rezoning for the redevelopment of the existing lodge into a 10 unit middle-

• �= WHEREAS, the Planning and Zoning Commission did consider the application -
at their regular meeting on November 1, 1982 and again at the request of the
Board of County Commissioners in conjunction with a remand of the GMP recom- �'

'r mended scoring on January 25, 1983, and C:

WHEREAS, a public hearing was held before the Board of County Commissioners �'

r:� on February 28, 1983 at which time evidence and testimony were presented with

respect to this application.
+, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
r Pitkin County, Colorado that it does hereby deny the Heatherbed PUD, general

�� submission, rezoning and special review and makes the following findings: ��
'� 1. The proposed AR-2 rezonin9 is inconsistent with the adopted Master ��
Plan for this area. There is more than enough AR-1 zoning at the -'
Highlands base area to accomnodate the tourist accommodations density ,'` .
� recommended in the Master Plan. Also, the site for the new condominium *.�
;.� units has more in common with the AF-1 zone than with the AR zones
due to the grade separation which exi�sts between the Highlands base
area and the proposed site for the condominiums on Maroon Creek.
2. The setback variance requested as a part of the PUD would not result ,
in the preservation of the site's unique natural scenic features
and would be inconsistent with the County's policy for the preser-
vation of scenic quality (Section 2-16).
