Associates, a Colorado partnership (here��naftZ� referred � '� to as "app7icant") is the owner of record or ho7der of record of the right to `�� �. �� acquire approximately 289,337 square feet of land zoned AR-1 and 2,957 square i- feet of land zoned Af-1, a total land parcel of approximately 6.71 acres, more � �.:� ` specifically described in Exhibit A, attached hereto and incorporated herein t� " by reference, and i. WHEREAS, the applicant has requested detailed submission approval to �? � > � demolish and reconstruct the Highlands Inn, to inc7ude 159 condominium tourist � 1�; units and 21 employee units, and �. �� WHEREAS, the Board of County Commissioners did approve Resolution No. 82- � ;� 54 on May 10, 7982, exempting the Highlands Inn project from the administrative �` i;,� ;;?, ;,� delay on the processing of lodge development applications which was imposed by ��( r� Resolution No. 82-44, and � �.�-� WNEREAS, at a regular meeting on January 18, 1983, the Pitkin County ;�'; �;^ � Planning and Zoning Commission did consider the applicant's detailed submission ,< ��� E� and did recomnend that the Board grant detailed submission approval to same, �+ subject to sixteen conditions, and � G� ;; WHEREAS, the Board of County Commissioners did hold a public hearing to consider the applicant's detai7ed submission, due to the provisions of Section 6-4.4(d)(1) requiring that a public hearing be he1Q if the application differs �� substantially from that approved at the general submission level, and � '� WHEREAS, as a result of evidence and testimony presented at the public f.� � �� hearing, the Board did unanimously approve of the detailed plans for the '�f �, �-`i•,.-. . f: Highlands Inn Renewal. � � i �, �' NOW, THEREFORE, BE IT RESOLVED by the Board of County Comnissioners of '' �. Pitkin County, Colorado that �t does hereby grant detailed submission approval `' �Y to the Highlands Inn Renewal, subject to the foilowing conditions: ;; 1. The applicant shall request approval of a resolution by the Board of County Commissioners prior to applying for a building permit, which � resolution shall approve the improvements agreement, confirm that the pians and specifications comply with the provisions of the Uniform Buildin9 Code in effect in Pitkin County and assure compliance with all other land use regulations of Pitkin County> as required by i Section 6-4.5(d) of the Land Use Code. The applicant wil] submit condominium declarations along with the �^� final plat which will be approved as to form by tbe County Attorney, ° �=: setting the following limitations upon the use of the Highlands Inn ` Lodge Condaminiums and the operation of the condominium association: - � � a. An owner's personal use of his unit during a 13 week high season which is set annually by the hotel management company, shali not exceed 28 consecutive days, except that such limits �_:� may be exceeded on a space availability basis. An owner may designate other individuals or groups who may �^;:� . occupy his unit for a period not to exceed 28 days, except that such limits may be exceeded on a space availability basis. � i� c. An owner's total personal use of his unit during the high season shall not exceed 42 days, except that such timits may be exceeded on a space availability basis. � , ,4' �'' d. Companies or corporate-owned units that are occupied by different �':� parties at least every 21 days during the high season shall be T`�� exempt from the above limitations. 4- r ��..;=� e. An owner shall be prohibited from keeping his unit off the 4�Y r— short term rental market when he does not personally occupy the � r�� unit or it is not occupied by a guest of the owner, other than '" ` '� for repairs or maintenance which make the room unrentable. � ��':� f. The applicant will not be permitted to burn construction materials ° � on-site. � � �'J� 10. The applicant will maximize design and construction quality of the : hotel to reduce the noise impact of snowmaking nozzies on condo- minium owners, hotel guests and employees. ��� i;, :t 4�. 17.
