� WHEREAS, the Board of County Commissioners of Pitkin County, Co7orado _

� did grant to Frank Lerner, as concessionaire for the Aspen Skiing Company, ��
special review a �
pprova7 on May 17, 1982 for the construction of Ruthie's
� Restaurant at the upper terminus of Lift 1-A on Aspen Mountain, and
� WHEREAS, the approved use of the facility was limited to the winter
� daytime hours to coincide with operation of the ski area and to service skiers
# on Aspen Mountain, and

- � _ WHEREAS, the Board of County Comnissioners, at their regular meeting on
� January 24, 1983, extended that approval for use of the facility in the summer
� daytime hours to serve the various types of recreators on the mountain, and
� WHEREAS, at that meeting of January 24, 1983, a motion was made to recon- ��

� sider operation of the facility in evening hours in both winter and summer, and

� WHEREAS, a public heari�g was held on February 28, 1983 to discuss the
t�,� request and the meeting was continued unti] March 7, 1983, and � �

� WHEREAS, fihe Board did express its feeling that housing more employees k
� generated by the expanded hours of operation on-site would be undesirable, and ,

WHEREAS, the Board did find that recreational activities to which the �
S �.
� restaurant would be accessory do not take place on the mountain after dark, and
` WHEREAS, the Board recognized that a restaurant in its own right is a
use which, according to the Land Use Code, is prohibited in the AF-1 zone, and

}� WHEREAS, the Board did indicate its concern with the visua� impact fran -
:�� town of lighting the restaurant for operation during nigf�ttime. _-
� NOW, THEREFORE, SE IT RESOLVED by the Board of County Commissioners of

:� Pitkin County, Colorado that operation of Ruthie's Restaurant in the evening � ;
hours of the summer or winter season is hereby denied. �`�
