WHEREAS, the Board of County Commissioners has determined to amend �;r� �x, its Sales Tax Resolution, dated October 7, 1968, as amended, to increase � the Countywide sales tax from 28 to 3B, and to apply the portion of the � �= � � `; increase allocated to Pitkin County to oublic transportation purposes �' `• � `� within the County; and � ��: :ii WHEREAS the increase in the Countywide sales tax, if approved and �; imposed, would result in the imposition of a total sales tax by the �_`< �'� �.:.. �. The Sales Tax Resolution, dated r;' R;.'•:? October 7, 1968, as amended, (the "Sales Tax Resolution") is hereby ' : .;y- i:. „;r� t 'y ,. amended to provide for a 38 countywide sales tax on the sale of tangible . ;,r;? ,� . �, .�'`�j personal property at retail, and the furnishing of services as provided =�r� ,`wT'� in section 29-2-105(1)(d), Colorado Revised Statutes 1973, as amended, i=--� fir and upon all taxable transactions within Pitkin County. All other pro- ��:Y {�� visions of the Sales Tax Resolution shall apply to the collection, admin- � ?�� istration and enforcement of this sales tax except as hereinafter pro- ` :�. There is hereby �_ �'�s• imposed on all sales of tangible personal property at retail and the ' �.� `� - ��;:� furnishing of services as provided in Section 29-2-105(1)(d), Colorado �; i� - _ ' :� Revised Statutes, as amended, a tax equal to 3B of the gross receipts. r;:'1 Section 3. Receipt of Additional 18 Sales Tax by Pitkin County � �::� t 1!:::i � �:',1 and Allocation to its Incorporated Municipalities. All receipts of the �,,:,� a:d additional 18 countywide sales tax which are collected within the County � i�.,;� ;� a�,`,� � t'_„� and its incorporated municipalities shall be allocated and distributed � . ;:- A <:� promptly upon receipt to those municipalities as follows: a `- .y ? The City of Aspen shall be allocated an amount equal to that � ° portion of the additional 1$ countywide sales tax which is � �� � �� collected within its corporate limits as shall be necessary �. Use of Additional 18 Sales Tax by the County. � (a) $300,000 of the annual revenues derived from the County's addi- � =,w . f �� tional 1� Sales Tax, including that amount from Section 3(a? � (iv) above, shall be deposited to the County's Capital Zmprove- " . F � -.. ment Fund (hereinafter created) and used solely for the purposes � for which the fund may be used. (b) There is hereby established a special fund of the County to be �� known as the "Pitkin County Transportation Capital Improvement Fund". The provisions of this Resolution �`''" shall become effective and shall be in force at 12:01 a.m, on the first day af January, 1984 (January 1, 1984) or on the subsequent first � day of the January or July next following the satisfaction of the condi- � tions set forth in Section 8 hereo£ and the forty-five day notice period for the State of Colorado. {'..,/"_ Section 7. Termination. The additional one percent (1$) sales � tax of Pitkin County imposed by this Resolution shall continue in effect � I until repealed by the registered electors of Pitkin County at an ! election held for such purpose. Conditions Precedent. This Resolution shall not be � effective unless and until each of the following conditions shall have ,r ;� been met: - � ,_. ; (a) The City of Aspen shall have taken due proceedings reducing _ ± � its existing sales tax to not exceeding 18; r � (b) The Town of Snowmass Village shail have taken due proceedings � � t. reducing its existing sales tax to not exceeding 1�; and � � (c) The Town of Basalt shall have taken due proceedings reducing its y '.. � existing sales tax to not exceeding 1�, or legislation shall have been enacted or other action taken to make any such reduction unnecessary. . Section 9. Severability. If any provision of this Resolution or r• fa the application thereof to any person or circumstances is held invalid, � such invalidity shall not affect other provisions or applications o£ the � �;. Resolution which can be given effect without the invalid provisions or ; application, and to this end the provisions of this Resolution are t ydeclared to be severable. Section 10. Publication. The County Clerk and Recorder is directed : � to publish this Reso].ution in full four separate times, a week apart, s � in the Aspen Times, the Snowmass Village Sun and the Carbondale Roarinq Eork Valley Journal in the issues of such newspapers during the periods of April 6-7, April 13-14, April 20-21, and April 27-28, 1983. � � i.
