the U.S. Department of Hcalth and Human Services, OEEice of Comm�nity Services,
-:� under the Coaununity Services Block Grant Act of 1981, as amended, to provide

r,y WHEREAS, Conqress amended the aforementioned CSBG Act qf 1981 on September 30,
��-j 1982, to change the entities eligible to receive CSHG funds in federal fiscal year
i`_( 1983. Subsequent to this change, which made ineli,qible the prior State Plan for
distributing CSBG funds to political subdivisions, the�State had to formal2y sub-
`�.)t • mit an eligible disCribution glan to the U.S. Department oE Health and Human Services,
�.;I OEfice of Community Services {HHS-OCS), for approval. Also, HHS-OCS incurzed delays
'�i ira making funding available to the State due to•national program legal determinations
. �� w�aich it had to make before distributing CSHG funds to states. The aforementioned
<,�, fmds aow received by the State may be used pursuant to the CSSG Act to reimburse
� eapenditures incurred by the State, and its contractors, commencing Tanuary 1, 19B3; =

3. Certification as Eliqivle Entity. Contractor certifies hereby that it
is aw eligible entity under the CSBG Act of 1982, as amended, and that it will maintain
that status. Contractor shall immediately notify State if any change takes place to

4. Time of performance. The services of the Corttractor shall commQnce as �

7. Financial Rules. The Contractor shall follow the State of Colorado Local ?
Government Financial Management Manual financia2 rules and procedures for accounting, '�`3
reporting expenditures, budqeting and procurement, etc. Minimum standards to be ��
adhered to are those contained in the State of Colorado Local Government Financial f
i4anagement Manual (State Ruditor's Office). � ' {

8. Responsible Administrator. The performance of the services required
Lereunder will be under the direct supervision of ,
• �ho is hereby designated as the administrator of this work program.
9. Responsible Personnel. The Contractor represents that he has, or will secure
all personnel required in performing the services �nder this Contract. Such personne2
shall not be employees oE or have any contractural relationship with the State. All
- , of.the services required hereunder will be performed by the Contractor or under his
supervision, and all personne2 engaged in the work shall be fully qualifieft and shall -
be authorized undar state and local law to perform such services. None of'the work
, or services covered under this Contract shall be subcontracted without the prior
� written approval of the State. •

� . 10. Termination ot Contract for Cause. If, throuqh any cause, the Cantractor + .
' shall fail to fulfill in timely and prol�er manner his obligations under this Contract,
or if the ContracCOx shall violate any of the covenants, agreements, or stipulaCions
'. . of this Contract, the State shall thereupon have the riqht to terminate this Contract
by giving written notice to the Contractor of such termination and specifying the
effective date thereof, at least five (5) days before the effective date of such -

Not withstanding the above, the Contractoz shall not be relieved of. liability
to the State for any damages sustained by the State by virtue of any breach of the �
Contract by the Contractor, and the State may withhold any payment to the Contractor . ��
