Request: On February 15, 1983 Tom Dunlop of the Environmental • , Health Department wrote a letter to the MAA advising them that the well water supply system and septic . tanks serving the Castle Creek campus contain major deficiencies and require upgrading. Tom noted that recent water samples showed contamination of the supply which was probably due to leachate from the existing on-site wastewater disposal facilities. Tom therefore issued an enforcement action and � requested the development of a workable plan for both the water and sewer systems to eliminate the . � health hazards which are present on the campus. In response to these requests, the MAA has engaged various consultants who have d'eveloped plans to connect the campus to the City water system and . _ , Aspen Metro Sanitation District sewage treatment • • system. Under the terms of- Section 5-A07.1(a) (1) of the Code, the extension of a water or sewer system to serve 20 or more people is an activity of local and state interest, subject to 1041 special revi�w. . The applicant requests your special revieiy appro•aal . to extend these services to their Castle Creek campus. Referral Comments: The Environmental Health Department reviewed this application as to its impacts on air and water quality and noise abatement. Their attached memorandum recommends various standard mitigation techniques to resolve any problems which may result from disturbance associated with this project. The Bngineering Department provided iniormation as to ihe requirements for an applicant who is doing ' . work within a County right-of-way. Ron also suggested that a site specific geologic study be performed to ' ensure that no adverse impacts result irom the activity on steep slopes and crossing Castle Creek. . The applicant had Nick Lampiris walk the entire length of the two utility alignments. Nick and the engineers for the project believe that the most troublesome section will be the driveway from the bridge over Castle Creek to the intersecti.on with Castle Creek Road, since a 10 foot separation is required between '� the two pipes (for health reasons) . August 8, 1983 The Water Department and AMSD have indicated the feasibility of providing tne requested service. , Jim Markalunas states that Council has already agreed to a financing arrangement for this improve- ment. ' Heiko Kuhn comments that the District Board met on this proposal July 11 and agreed to pay for the extension of service from the Castle Ridge Apartments - to the Music School's driveway, up to a maximum of . $191,U00. They have also agreed to annex the campus as an enclave (that is, not annexing into the . district those areas between the City and the campus) . • and are now proceeding with the necessary legal proceedings in this regard. . , The Environmenal Coordinator saw no problem with this request. We did not receive comments from our referral to the Division of Wildlife. We did, however, receive a late comment from the Bureau of Land Management that they own .land in the vicinity of this project and require any crossing of their land to be reviewed. Therefore, they indicated that if the applicant finds that the project will necessitate the crossing of any BLM land, right-of-way permission must be obtained from the BLM office in Glenwood Springs. My contact with the applicant's engineers indicated that no such crossing wouI.d occur. Neverthe- less, we recommend addition of the appropriate condi- tion to satisiy the comment by'BLM. Planning Office • Review: • The Planning Office was asked by the County Manager to assist the applicant by expediting the review of this a lication to the de ree ! According to Section 2-10 0{ the Code, it is the � policy of the County to discourage utility extensions i to areas .not suitable for the type or amount of ; development necessary to support the service. It is also the policy of the County to regulate utility extensions in a manner such that services are constrained to areas adjacen� to existing development and which are already served by other public facilities. • Furthermore, according to Section 2-25 of ihe Code, • it is the policy of• the County to provide for efficient phasing of public services and to prevent ' the location of activities and developments which may result in significant changes in population densities. The Planning Office asked the applicant to address the prior policy statements to ensure that the utility extension would not result in a "leap£rog" growth pattern or otherwise increase the development potential outside of the already developed portions . of the metro area. A•ccording to the appli.cant, the ; potential service area for this extension includes the camPus, five existing residential units and five potential residential units. June 28. with A.J. Zabbia. Jr., of Rea. Cassens & Associates, Inc. and Ron Cloninger of Flood-Cloninger kY�gineers. We walked the entire length of the two alignme�ts and I believe we all concur that the most troublesome section v�ill be the driveway from the bridge over Castle Creek to the intersection with Castle Creek Road. The reason for this is that between the sharp cut on the left side of the road (+vest) and the steep drop-off to i;he right (east) there is very little room to place both ti•rater and sewer lines �vith the proper separation. In this and other simil.ar situations, we do not want to either remove the toe of the cut bank or trench a:,y closer than five feei: of the drop-off. It is my understandin� that a ten foot separation is necessary between the water pipe and the sewer pipe, and that the water pipe must be at least lF3 inches over the sewer pipe. Toward �Chis end it was agreed that the water line would be closest to the cut bank on the west. Once up on the Castle Creek Road, the placemerit of the two lines becomes easier because there is much more room to work � with. The se�•rer line will have i;o be placed v�ith care in the � vi.cinity oP the sharp left curve in the Castle Creek Road ivhere there is a very high bank in unconsolidated glacial moraine material to the tivesi:, and a steep bank down to Castle Creek on the east which shows recent slope failure signs. Each of them must descend the steep hillside down to the Castle Creek Road in unconsolic3ated silts, sands� cobbles and boulders of glacial moraine "b" of Auarternary age. The best vray from a geologic standpoint would be to come straight down the fall Zine alang � • an existing power right-of-way, thereby avoiding the transec- tion of the slope wii:h a long� oblique cut to the south. This alignment would approach the Castle Creek Road in the vicinity of Gary Jacobs drive�•ray. From here the water-line would trend up-valley some 20 to 30 feet west of Castle Creek . Road, presumably with aspen trees as a visual barrier. It could then cross to the nYusic School road in the vicinity of that intersection, or� preferably, proceed further up the Castle Creek Tioad, across it and straight dowri the steep bank to the bridge area on the Music School property. This would avo9.d having to try to accomodate both lines along that narrovr road �vay. Again. a trench down the faZl Zine wouZd not create nearly as much slope instability as one which transects the hillside. These are my preliminary observations. The site contains _ a total of 4.82 acres, zoned AF-2, and is presently iniproved,with a single family house, a 24,000 square foot tennis "bubble" structure, and the 386 square foot clubhouse. A previous special review approval was granted for expansion of the clubhouse by 5,456 square feet (Resolution No. 79-26) . The square footage of existing and approved improvements total 29.842. . In this application, the applicant seeks approval of a new plan which we believe will be more consistent with the County's Scenic Qua].ity Policy as well as ihe developing goals for the Highway 82 corridor. The applicant proposes to remove the bubble and the existing clubhouse, then to redevelop the facility incorporating all previous approvals including ihe indoor tennis courts under one roof. The existing tennis bubble is 37'� feet high and the redeveloped club house will be considerably lower, within the County's 26' height . limit. Page Two August 8, 1983 Since all of the exemption square footage is contained in a solar gallery/entry way, we feel that the applicants contention that there will be no impact whatsoever within the meaning of the above exe�rption is entirely correct. Furthermore, since the solar gallery will provide for the space heating needs of the indoor tennis courts, the proposal is consis- tent with the County's policy to encourage the employment of energy conservation features. . Clubhouses or recreational buildings are allowed by special review ' (Section 3-3.19) provided they are used in conjunction with and accessory to permitted outdoor recreational uses. This particular use in this location was determined to be appropriate in several previous approvals. We believe that the changes in the use which are requested at this time will reduce the adverse impacts and will result in the creation of a club which will be an asset tc� the community. All accessory facilities are intended for the exclusive use of the Club members. These facilities include pool, jacuzzi, clubroom, lounges, locker rooms, pro shop, and exercise room. Food service has been available in the past and' will continue to be available in the clubroom for members only. There is no public restaurant included in this application. , A new landscaping plan has been developed in conjunction with this redevelopment plan. We feel that the new plan is superior to that which was previously apnroved. The plan features a larger lake and land forms 15 feet high separating the facilities from the Higbway, and incorporates the County's bike path. The bike path will be relocated to wind through and over the land forms. Bikers will be able to use the shores of the lake as a rest stop. The land forms will be vegetated with a mix of conifers, cottonwoods, shrubs, native grasses and flowers. Generally, the new club house with its landscaping plan will � result in substantial improvemenis in the scenic quality of this property. The application includes a traffic impact analysis prepared by Design Workshop. Their analysis indicates that the clubhouse is proposed to serve ex.isting outdoor recreational facilities and will not independently generate additional traffi.c. The traffic analysis indicates that the two indoor courts will generate slightly less traffic than the three courts currently in the "bubble." This might result in a slight reduction in traffic generation. Both the County Planning Ofiice and Engineer concur with the conclusions of Design Workshop. The parking lot will be relocated to the rear of the property and will contain 51 parking spaces. The Land Use Co3e requires one space per 400 square feet of non-residential space but provides for a parking reduction by special review for warehouse uses. In this case, the applicant is proposing one space per 400 square feet for the clubhouse space, for a total of 34 spaces, plus 17 extra spaces for a grand total of 51 spaces. Special review • approval for the reduction oi the requirement to 51 spaces is requested on the ba.sis of the similarity between the traffic generation characteristics of warehouses and indoor tennis courts. _ ���W�.�-- ldemo: Aspen Racquet Club Page Three August 8, 1983 In further support of this parking reduction request, the applicant has developed a contingency plan for handling overflow parking needs should such a need develop during special events. Overflow will be handled along the clubhouse drive entry road, by lease on adjacent property, or on the Buttermilk parking lot. These plans were developed through cooperation with the Planning and Engineering �Departments. We therefore recommend special review approval of a reduction in the parking requirement to 51 spaces. The Board of County Commissioners is requested to act on a subdivision exemption for a lot line adjustl►ient resulting in new lot lines ' which follow the footprint of the new facilities proposed. The Board has previously interpreted the Code such that trail ease- ments are not subtracted for density calculations. Therefor.e, the lot line adjustment will have no impact upon development potential and will be consistent with PUD procedures which p�rmit variation of off-street parking spaces, setbacks, and lot widths. A drainage plan has been developed which handles all drainage from impervious surfaces on-site in dry wells and/or retention areas. This plan satisfies the concerns of both the Environmental Health Department and County Engineer. A commitment was made in the process of the original Racquet Club Subdivision Filing No. 1 which runs with the land to grant an easement through this property upon request for alternative access to Park Meadows. That was a voluntary commitment as it was not required by the Land Use Code. The applicant continues to be willing to abide by that commitment. The Aspen Metro Sanitation has reviewed and approved the utility extension plans. Jim Markalunas indicated that an additional easement is necessary in order to achieve looped service. The additional easement was requested in or along the curbed access road between "Stage Road to a point easter.ly at the new parking lot." Looped service is a policy adopted by the Water Department to achieve service reliability. The information in this paragraph represents a clarification of Markalunas' comments which the Planning Commissicn did not have the benefit of at the time they reviewed this application. Nonetheless, the additional easement requested should be dedicated as a condition of approval. Planning and Zoning Commission Recommendati.on The Commission reviewed this application at their regular meeting on July 5, 1983 and recommended approval of the special review subject to two conditions: 1. The landscaping plan shall be fully implemented prior to the issuance of a "certificate of occupancy." 2. Parking shall be prohibited within public easements and • right-of-ways. A previous special review approval was granted by Resolution 79-26 for the construction of approximately 5,500 square feet of clubhouse space together with three additional tennis courts and a swimming pool. The current proposal is for an amendment to the previously granted special review approval in order to expand the size of the clubhouse. Substantial community benefits will accrue through approval of this proposal by the elimination of the "bubble" structure located on the property and by the enhancement of the amenities of the proposed clubhouse to provide a first class private tennis club for both members of the community and visitors. The attached mapping found at Figures 1 through 6 includes an artist' s rendering (Fig. 1) , e�isting conditions map (Fig. 2) , site plan - including utility, road/access and parking plan (Fig. 3) , landscaping plan including drainage information (Fig. 4) , floor plan for clubhouse (Fig. 5) and cross section visual elevations incorporating removal of the "bubble" structure and i installation of landsca in ursuant to landsca ' p 9 p ping plan (Fig. � 6) . The effect of the new clubhouse and removal of the "bubble" structure will represent a dramatic improvement in the visual � appearance of the Highway 82 corridor leading into Aspen. Open space is preserved and extensive landscaping is provided to beautify the area. I The project complies with current County goals, policies and regulations. The proposed reconstruction includes the clubhouse, attached tennis building housing two tennis courts and a solar � gallery to provide an energy efficient heating system as part of the entryway to the clubhouse. The existing tennis "bubble" � str.ucture and the eaisting clubhouse will be removed. The existing clubhouse special review approval will be fully utilized and the Applicant requests a 1 ,000 square foot allotment exempt from the Commercial Growth Management Plan quota system pursuant to Section 5-510.2 (i) . The lower floor of the structure which contains locker rooms, steam and sauna areas and an exercise room is situated approximately ten feet below existing grade. Ext�nsive landscaping shown on Fig. 1 and on the landscaping plan attached at Fig. 4 together �aith walkways, decks and the free form pond significantly enhance and beautify the site. A cross section � visual elevation attached at Fig. 6 shows view lines from several points along Highway 82 with the "bubble" structure compared to ' the same view lines with the proposed landscaping plan and the new clubhouse and tennis building. The lower profile of the proposed new structure and landscaping of the site will definitely be an improvement over the present conditions. The Applicant will relocate the existing parking lot to �he rear of the property and close off the Highway 82 access point. This area will be replanted and landscaped to further enhance the feeling of open space and cr?ate an overall improvement in scenic quality. These changes in the present site will obscure from � v�ew the road access areas and parking areas of the facility and ! significantly reduce the visual effec�. of the proposed clubhouse � � and tennis building. The average daily occupancy for the new tennis courts will be 50 percent. This figure is based on historic records. 2. Peak hour occupancy of the new tennis courts will be 100 percent. 3. The indoor courts will be in operation from 8: 00 A.M. until 10: 00 P.M. - 14 Hours. 4. The two indoor courts will generate slightly less traffic than the three courts currently in the bubble. 5. The courts will be used for singles play 70 percent of the time and for doubles play 30 percent of the time. 6. No traffic will be generated by the clubhouse as it serves only players. Two scenarios have been developed to arrive at the average daily • traffic generated by the additional facilities and the parking that will be required. Scenario A - This proposition assumes the worst conditions and is based on the assurnption that 100 percent of the new court users will arrive by private automobile at a ratio of one person per car. At this rate, the new facilities would Qen- erate 110 trips per day or 55 cars with a peak hour trip generation of 16 trips or eight cars. Under these condi- tions, 16 additional parking spaces will be required. Scenario B - This proposition assumes 90 percent of the new court users will arrive by car with 1 . 5 persons per car, producing averge daily traffic of 66 trips per day or 33 cars per day with peak hour �raffic at 10 trips or five cars per hour and demand for 10 additional parking spaces. With either scenario, the impact on Highway 82 and the additional parking requirements are minimal indeed and contribute very lit- tle additional peak hour traffic. FROM: Richard Grice, Planning Office - RE: Expansion of Sundeck Restaurant - Commercial GMP Exemption and Special Review - Public Hearing DATE: August 8, 1983 We have received an application from the Aspen Skiing Corporation for special review and for exemption from the commercial GMP for the expansion of 1,000 square feet of their existing deck at the � Sundeck Restaurant on Aspen Mountain. Section 5-510.2(i) provides for exemption from the commercial GMP for expansions of existing commercial buildings by not more than 1,000 square feet when the impacts are found to be minimal or manageable. That section in its entirety reads as follows: " (i) the expansion of an existing commercial use in a building by not more than one thousand (1,000) square feet, excluding employee housing, for the purposes of groviding a small addition of space which can be shown to have minimal or manageable impact upon the community and can be justified by the benefit which will accrue to the community. For expansions which involve not more than two hundred fifty (250) square feet, the expansion shall be approved jointly by the Planning Director and the Chief Building Inspector. For expansions which involve greater than two hundred fifty (250) but not more than one thousand (1,000) square feet, the expansion shall be subject to the special approvaZ of the Planning and Zoning Commission. The review of any request for the expansion of an existing commercial use shall include a determination of minimal or manageable impact on the community, considering but not limited to findings that a minimal number of additional employees will be generated by the expansion or the applicant will provide additional employee housing; that a minimal amount of additional parking demand will be created or that parking can be accommo3ated on site; that ihere will be minimal visual impact on the neighborhood due to the project; and that minimal new demand is placed on services available at the site such as water, sewer, roads, drainage and fire protection." "Ski lifts and necessary related facilities" are permitted by special review in the AF-1 zone district. Any expansion of related facilities such as the Sundeck Restaurant expansion proposed in this application requir�s additionnl special review approval. This application does not propose expansion of production facilities (i.e. , kitchen space) . Instead, it proposes enclosure of space which has historically served as seating space oz the outdoor deck. In addition to the request made in the application, it has come to our attention that the applicant has also filed plans for an additional 1,200 square feet of deck space to be constructed L-o replace the deck which is being enclosed. We have discussed ihe enclosure of 1,000 square feet of deck space and the construction the additional replacement deck space with • the Ilousing Ofiice and have concluded that the impact upon employee ' housing of both actions will be minimal. The bottom line is a 1,000 square foot increase in interior seating capacity and approximately 200 square feet of additional outdoor seating capacity. Any of you who are tamiliar with the winter operation of this restaurant will know that there is currently an overcrowded seating situaiion. i Memo: �xpansion of Sundeck Page Two . August 8, 1983 � The restaurant has more production than seating capacity. The only direct impact expansion of seating capacity is likely to have in this case would be the need for an additional "busboy." Neither the Housing Office nor the Planning Office believe that this expansion will generate a need for more than one additional employee and possibly none. ACCOrding to the Environmental Health Department, some modification to the on-site wastewater disposal system might be necessary because the County's disposal regulation only considers enclosed space. The disposal capacity requirement is a direct function of ' the indoor seating capacity. The Planning Office concludes that the impacts from this expansion will be "minimal or manageable", consistent with the requirements of Section 5-510.2(i) and recommends approval of the special review and the commercial GMP exemption request noting that the applicant will be required to meet both the Colorado Food Regulation and the Pitkin County Individual Sewage Disposal regulations. Planning and Zoning Commission Recommendation The Commission reviewed this application at their regular meeting . on July 5, 1983 and granted approval of the exemption from commercial GMP and recommended your approval of the special review without condition. The impact on the community should be negligible as the restaurant isn't in town but on top of Aspen Mountain. The project wouldn't generate more slciers but would instead improve existing services, by providing a ' pleasant area to dine or warm up. . The proposed addition is being designed to utilize the positive aspects of the existing building while increasing the seating in a more efficient manner. . 2. No new employees would be necessary as the restaurant is a cafeteria operation and the addition just generates seating and would not need more employees. The kitchen and line are not being changed to muke more employees necessary. The extra cleanup and table bussing can be handled by the persons now doing the existing restaurant. Without more room in the work areas, }ritchen nnd line, there is not room for more employees. 3. No additional parking would be necessary for new employees. The Aspen Skiing Company provides parking for its employees and also restaurant employees. 4. The proposed addition is on the west side of the Sundeck. This side of the restaurant is almost invisible from summer jeep traffic or �vinter skier traffic. The existing deck is almost 25 years old and is in need of extensive repairs, this along with the fact that prevailing winds make the existing deck unusaUle much of the ski season. The changes in the deck with the new building to shelter it will make it much more usable. 5. There will be no demnnds made on city water, sewer and roads. The Aspen Slding Company provides water from their otivn �vells. The restaurnnt has its own sewer tanks which are cleaned yearly. No new toilets will be involved. The roads are not involved since they are used for summer jeep traffic. 6. There are two housing units in the existing restaurant.
