e WHEREAS, William V. Hodges, Jr. (hereinafter referred to as "applicant") �:�
"� is the owner of record of 4.626 acres of real property more specifically described "

� in the attached Exhibit "A", and �
�� WHEREAS, the applicant has requested subdivision exemption for the division
�� of said property into two separate lots; Lot 1 to contain 3.218 acres and Lot 2, !

�,j 1.408 acres, and

WHEREAS, the Board ofi County Commissioners has considered the evidence and
� ;13`� testimony with respect to the subdivision exemption request at their re9ular r

� meeting an April 25, 1983.

ii NdW, THEREFORE, BE IT RE50LVED by the Board of County Comnissioners of �
� Pitkin County, Colorado that it does hereby grant subdivision exemption for the
� division of property described on the attached Exhibit "A" into two separate -
tracts, Lot 1 shall contain 3.218 acres and Lot 2, 1.408 acres, subject to the �;�
�
following conditions:
1. The applicant shall construct a sewer line connecting the existing
house on Lot 1 with the Aspen Metro Sanitation District trunkline
when and if the sewage system on Lot 1 fails, prior to the sale and �
� conveyance of Lot 1 and in no case later than November l, 1984.
� 2. The subdivision exemption plat shall reflect a 1e9a1 easement on
� , Lot 2 for the benefit of Lot 1, allowing for use and maintenance
� of the sewer line where it must cross Lot 2.
� 3. This property shall be deed restricted against any further subdivision,
not to include the construction of accessory uses such as garages,
greenhouses and similar uses, and a note to this effect shall be added
! to the subdivision exemption plat. -
