+� WHEREAS, Section 5-510.2(a) of the Land Use Code, GMP Exemptions,

E�' Management Quota System, provided that no addition of dwelling �

}�' units nor ex ansion of commercial floor area takes lace and

j"; WfiEREAS, implicit in the provisions of said section is a

limitation on the ability of an applicant to change the use of

any existing building at the time of its remodeling, restoration '

-:,�'` � or reconstruction, and

WHEREAS, the Board of County Commissioners does wish to

s`-:� amend the Land Use Code to explicitly identify guidelines for the

5 administration of a change in use GMP exemption, and

�+:� WHEREAS, the Pitkin County Planning and Zoning Commission,
�'` by resolution adopted on March 22, 1983,did recommend the adoption

of a change in use GMP exemption.
'' NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners `�

�� of Pitkin County, Colorado that it does hereby amend Title II, �'i

r� Section 5-510.2(a) of the Land Use Code to read as follows: ;
�'j "The remodeling, restoration or reconstruction of any existing �`" '
�1 building, provided there is no addition of dwelling units
.� (except i£ constructed pursuant to Section 5-510.2{b) , nor
expansion of commercial floor area (except if constructed � �
� pursuant to Section 5-510.2(i) , nor addition of lodge, ;�!;,-_ >
�. motel, hotel or tourist dormitory units."

� Section 5-510.2 of the Land Use Code by the adoption of a new
subsection (j) to read as follows: �"
"Any change in use of an existing structure for which a
certificate of occupancy has been issued for at least two
years, provided that the applicant can show to the Planning ,
and Zoning Commission that said change of use will result in
negligible growth impacts on the community. Any activity
resulting in a change between the use categories identified
in Section 5-510.1 of the Land Use Code which is found by
the Planning and Zoning Commission to cause a growth impact
shall be subject to the need to acquire a development allotment,
purspant to said Section 5-510.1.

��F: For the purposes of this section, growth inipact shall �:t'.
y�� be defined as any activity which results in the need for
�� additional employee housing or parking spaces; generates
increased traffic demand, water and sewer needs, fire and
�"� police protection requirements, off-site drainage and road
�'�' demands; or otherwise requires the provision of increased
� governmental services. The Planning Office shall add to
' the appropriate quota any commercial space, dwelling units �
�� or lodge units which are removed from the inventory by an �
"" application approved pursuant to this section and shall 7
.•�: deduct from the appropriate quota any commercial space, �
'�. dwelling units or lodge units which are added to the inven- 4

�-; tory by an application approved pursuant to this section."
