;;:;.I
"'-` Pursuant to Section 105(£) of the Surface Transportation Assistance
` Act of I382, Pitkin Countyis required to submit annual goals -
` for the use of Disadvantaged Business Enterorises (DBE) in UM'"A
-. p? assisted contracts. Unless given a waiver by the UiiTA Administrator,
w`, Section 105(f) requires recipients of UMTA funds to have a 10
;j;:' DBE goal. The procedure for obtaining a waiver as outlined in
:.: the July 21, 1483 Federal P.egister is lengthy and an overburden
.::, to small qovernments an transit aut.hqrities.
._
4K
x:: , _. Tf a recipient fails to meet'the mandatory goals the July ?1,
i,,:<,. ., •
,::,, 1983 regulations are vague on what actions will be imposed by
Z,;µ UbiTA. UMTA staff has in£ormed Pit?:in County that it is "likely"
t n,,, that UMTA will require proof of the good faith e£forts of S 23,45(h)
+;,= if a recipient fails to meet its goals.
,`.
Even though UMTA has not clearly dePined the actions to be taken
,., by a recipient failing to meet 10 goals, it is revuiring £hat
i;°"` recipients submit tfieir k'ederal Fiscal Year J.984 goals at this

`'''? 1984 DBF aoal of 1Q under the condition that the good faith
°"<;- efforts of S 23.95 sti11 apply to recipients who.do not meet ;
