�`� as alleged in the Plaintiff's Complaint in Civil Action No. 80-CV-218 in

' ; ;. to be made to the Plaintiff, JOYCE ST. JOHN. Said monthly pay-
ments shall begin as of November 1, 1982, and shall remain the �`�
- same amount for each subsequent payment, with all future �'
' - monthly payments pursuant to this Release and Settlement Agree- "
�` ment continuing thereafter, payable on the first day of each �
=r and every month throughout a period for ten (10) years certain �j

of JOYCE ST. JOFIN prior to the commencement of the ten-year period '�

� Hundred Sixteen Dollars and 66/100 ($216.66) per month to be
� paid to the Plaintiff's attorney, ROBERT A. FRANCIS, P.C. Said
a� monthly payments shall begin as of November 1, 1982, and shall
� . remain the same amount for each subsequent payment, with all
future monthly payments pursuant to this Release and Settlement
Agreement continuing thereafter payable on the first day of each
`� and every month throughout a period for ten (10) years certain,
or the lifetime of JOYCE ST. JOHN. In the event of the death of
r JOYCE ST. JOHN prior to the commencement of the ten-year period

,,y COMMISSIONERS OF PITKIN COUNTY and its insurance carrier, have .
;r� denied liability in whole or in part and that the terms and conditions t':S•
ti; of this Agreement are made without admission of liabi.lity and re-
��� ceived in discharge, compromise, settlement and satisfaction of all
actions, claims, and demands heretofore and hereafter described.
��� 2. That this is a full and final release applying to all unknown and �
s unanticipated injuries, deaths or damages arisin9 out of said �
�-' accident, including any consequences thereof now existing or which '

!� may develop, whether or not such consequences are known or anti-
��. cipated, including any and all claims for subrogation. The parties
s� specifically declare that it is their express intention to include �;
i-� within the scope of this Release and Settlement Agreement any and �,
s:n. a17 injuries, damages and losses, past, present and future, whether �

�fi„ known or unknown by JOYCE ST. JONN at the present time.

,`:� 3. That there are no liens or claims of liens or assignments in law or
�''� . ' equity or otherwise of or against the claim or cause of action of ;'
�� � JOYCE ST. JOHN. Further, that JQYCE ST. JOHN is fully entitled to

� give this complete release and discharge.
'' �"r 4. That JOYCE ST. JOHN will abandon and dismiss with prejudice all �

action.
�';._� 5. JOYCE ST. JOHN will indemnify and save harmless the parties herein
t;.'y� released from any loss, claim, expense, demand or cause of action =.

State Compensation Insurance Fund, Mutual Benefit Life, and any � ;
other insurance carrier or any party or stranger hereto of a claim ; °;�

=� connected with the subject matter of said accident, and from any �`
�:; loss incurred directly or indirectly by reason of the falsity or i;,
t�: inaccuracy of any representation herein by JOYCE ST. JOHN. If any f �

;;_ COUNTY, the Insurance Company of North Rmerica, or the First !� �
'rt� Colony Life Insurance Company shall have the right to pay into the !,

the terms of this Release and Settlement Agreement until such time
as the Pitkin County District Court resoives and determines any
liability for such a claim or claims and determines the right to .
apply any payments due under this Agreement against such a claim
