The trees were planted,however the location of such plantings did not fu[ly screen the � visuai impacts created by the Williams Woods subdivision;and X} � � ., ! WHEREAS,in 1995 Hunter Creek again requested that the BOCC complete screening which would accomplish the required minimizing oF visual unpacts of Williams woods;and � WHEREAS,the BOCC responded that it would allocate an additional$3,600.00 � for landscaping providing that the Hunter Creek and Williams Woods homeowners reach a finai agreement on the placement of spruce trees in order to accomplish the screening; : and WHEREAS,Hunter Creek presented to Williau►s Woods homeowners a location sketch oudining the location of six spruce trees attached hereto as Exhibit B,and . y. Williams Woods homeowners agreed to the proposed loca6on;and �� - - WHEREAS,the BOCC,Hunter Creek and Williams Woods desire to forever I resolve their differences resulGng fromthis matter and adopt a final solution in order to accomplish the screening of the Williams Woods buildings in accordance with the terms, I � conditions,covenants and mutual promises contained herein. ; , �• , � NOW,THEREFORE,the parties hereto agree as follows: � , I; ': 1. The BOCC hereby agrees to wntribute$3,600.00 to the Hunter Creek � Commons Corporation for the purchase of six spruce trees to be planted in the locations ,,,. shown on Exhibit A attached hereto. Hunter Creek agrees to use the$3,600.00 allocated by the BOCC solely � �� ::�, for the implementation of the screening as shown on Exhibit A and to supervise the .c�•��-�� planting of the six spruce trees and the installation of the irrigation drip system in a rnanner which wi11 minimize any disturbance to the Williams Woods homeowners. `:`"' .::Y' 5.
