WITNESSETH: �'

WHEAEAS,the Forest Service has the responsibifity to issue Speciat Use !'-
- Permits and other approvats for development and tand use accivities on National Forest System Lands;and
WHEREAS,the Courny exeroises jurisdiction over proposed development and
land use pursuant to the PRkin Courny Land Use Code a�d Building Code,as provided by Golorado law;and
WHEREAS,The Ciry exercfses jurisdiction over proposed development and Iand �
use pursuant to both City and Pitkin County Land Use Code and Builciing Code,as provided by Colorado
law;and
WHEREAS,the Permittee is a private agent that proposes to amend their
Master Deveiopment Plan Yo upgrade and expand the activities currently under speciai use permit with the
Forest 5ervice and in need of complying wfth Courny Planning Codes;and

_ ' WHEREAS,it has baen joiritly determined dy the Forest Service,the Courrty,
�: the Ciry,and the Permittee that further coordination of their respective authorities is in the besc interest of aii

WHEREAS,the Memorandum of Understanding fa l.and Use Planning Coordination
of 1974 between the parties should be supplemented with appropriate procedures tor coordination and
, . � information sharing,wRhout interfering wfth the respective jurisdiction of the parties. :

Statemertt the ernironmental affects with regard to Transportation and Air Quality.While the ` �
' Forest Service may not have jurisdiction over these resources their is aa effect to the'Human
, Environmerri�and sha(i be disclosed as per CEQ Reg.40 CFR 1508.14. �i�;.

. , 1. The County and City will participate in ihe selection of a
qualified non-btased sub-consuftarn that will perform the Transportation and Air Quality analy-
ses under the direction of the Forest Service.The County and City wilf aiso assist in the -�'_
determination of the assumpUons that the analyses wilf proceed under.
C. DUTIES OF THE PERMITTEE. �

9 1. The Permittee will supply any and all information needed in the r
anaysis of the proposed Master Development Pian upgrade%xpansion.
_ 2. The Permittee will participate irt ihe selection of a qualified
non-biased sub-consukant that will perform the TranspoRation and Air Quality analyses under �'t'
the direction of the Forest Senrice.The Pertnittee witl also assist in the determfnation of the
assumptions that the anayses wili proceed under.

IT IS MUTlJALLY AGAEED AND UNDERSTOOD BETWEEN THE SAID PAR'(7ES THAT:

1. The Forest Service wiN manage the enUre National Environmentaf -
, - Policy Act(NEPA)process.As a pan of that process the Transportation and Air Quaiiry analyses wiA Y
be performed by a mutualy agreed to sub-consuftant.The sub-consultant will perform the analysis with
the mutuaily agreed to assumptions under the strict supervison and direction of the Forest Service, ,.- ;

� interrtion that the disclosure of one analysis for both Transportation and Air Quality will serve the needs ,��',

� 5. In establishing that the Ciry and the Courriy will assist the Forest ; 7�
� Service in the selection of a qual�ed sub-consuttant to perform the Transportation and Air Qualily i �

� � analyses will proceed under,the Ciry and CouMy recognize the Forest Service has complete autonomy ''^

e 6. The independeM nature of the NEPA process creates the need to conduct
,_� the process with ir�tegriry.Any requests for information by the perrnittee,interested partfes,or the
y public for copies of documents wiN be cortsidered urtder the Freedom of Information Act(FOIA)
direction of the ageney to avoid the appearance of favored treatment �
