Plaintiff Alan A. Storey and Defendant Douglas P. Allen, •,� _ and their assignees Snowflake of Basalt, LLC and Srad-Allen, Inc., agree that the terms and provisions of the Access Agreement are not ;' y affected by this Settlement Agreement, and the claims which said +>. ^ pazties have against one another for reimbursement of construction �� and maintenance costs pursuant to the Access Agreement are '- soecifically ratified and reserved and are not affected by this ��r' Settlement Agreement. Said parties further ratify and confirm the � + terms of the Access Agreement. The quitclaim deeds to be executed =� ' by the Plaintiff and Defendants shall be made subject to the �. ..! easements created under the Access Agreement. As between Plaintif£ � e ' - - ' Alan R. Storey and Snowflake of Basalt, LLC only, this Settlement ?': . Agreement shall be subject to the terms of a Closing Agreement dated December 14, 1993. � � ` �_' ' 7. By Agreement and Grant of Easement dated July 14, 1994, s` � � and recorded August 17, 1994, as Reception No. 373303 in Book 758 aL Page 789 of the Pitkin County Records, Snowflake of Basalt, LLC aranted to Plaintiff, Alan A. Storey, a non-exclusive easement to extend underground utility services over property then owned by r : Snowflake to the real property referred to herein as Parcel A owned _. by Plaintiff, Alan A. Storey. Alan A. Storey has since installed various underground utilities in said easement, which utilities are privately owned by Plaintiff, Alan A. Storey and the parties agree that no connection shall be made to such private utilities except - . . upon further written agreement with Plaintiff, Alan A. Storey. ' This provision relates only to connection to the private utilities and� does not change the non-exclusive nature of the easement. e. Plaintiff Alan A. Storey and his assignee Snowflake of Basalt, LLC, and all the Defendants in the Lawsuit who are parties to this agreement agree to quitclaim to Brad-Allen, Inc. all of . - � their right, title and interest in the "Basalt Store" parcel shown on Exhibit A attached hereto and described on Exhibit C attached � ' nereto. r� 9.
