WHERSaS, the Memorandum of Understanding, made and entered into by the County t
. and the Forest Service on June 9, 1982, sets forth the responsibilities of each "��'� �
� party with respect to the development and operation of those roada that are � •.
� . part of both Forest Development and County road systems; and, ;_��;�.

,-1WHEREAS, the Forest Service, permittees of the Forest Service, and the County
� operate communications equipment at Upper Red Mountain Communications Site and
� periodically need to access the site to service said equipment; and, �`�}

� WHEREAS, segments of the access route to the communications site (illustrated �. . :;
on Exhibit 1, attached) are difficult to negotiate sa£ely in a four wheel ��
�. vehicle in summer or with a snowcat in winter; and,
WHEREAS, segments o£ the access route are, in certain snow conditions, � .i;s,�;!�?
' difficult to negotiate in winter by snowmobile; and, ��'
. WEiEREAS, segments of the access route to the communications site have been
. � damaged by erosion and have other unacceptable environmental problems; and, .
�
_ � WHEREAS, the Forest Service, permittees of the Forest Service, and the County �` � -
desire to perform maintenance work on the road to improve road safety and to
abate environmental problems; and, -! ; '
�__\_I WHEREAS, The County and members of the public are concemed that maintenance to •i
� ,-.I improve ease of travel will encourage additional motorized traffic on the road .
segments by the general public; and,

. . WHEREAS, the Hunter Creek Toll Road became a Pitkin County Road when the County
� purchased said roac� from the Hunter Creek Toll Road Company in 189i; and, >t

{ WHEREAS, National Forest land in the vicinity was withdrawn from the Public
IDomain in 1905.

NOW, THEREFORE, in consideration of the above premises, the parties hereto �

� �_ � � 2) Agrees to coordinate.the work to accomplish this project. ����
3) Agrees to diligently pursue closure of the County road to motorized use, ;� '
excepting Forest Service permittees authorized to utilize lands served by
the road, public agency traffic, owners of landa served by the road, and Y�,
hunters during big game hunting season.
� 4} Agrees to contribute, within budget constrainGs and other priorities, }'
equipment, materials, labor, and/or funds to the maintenance of the
communications site access road. ��;

- � B) THE FOREST SfiRVICE: . � � . .
1) Agrees that the plans and specifications for road improvements detailed
in Exhibit 2 are reasonable and necessary and should be performed as soon
as practical. r-
2) Agrees that the County, through its designated representative, will make
' .� the final decisions regarding the number of rolling dips, extent oE ditch
work, the extent of rock removal, amount of dozer blading, etc. in the
field as the work progresses.
_ 3) Agrees to contribute, within budget constraints and other priorities,
equipment, materials, labor, and/or funds to the road maintenance project. �'.. ,

4) The amount of improvement work shall be the minimum necessary to: a) �.�,..h.�
j abate damage to the road facility and/or the environment; b) to provide a �
safe road solely for the puzpose of providing accesa for administrative and !� +•,�
�� permittee vehicles, that are apecialized in nature, to the Red Mountain 4 :....�:
� Communications Site in both summer and winter while maintaining the road as ��' ;
� a primitive road suitable for use by high clearancey utility type, vehicles �:i'' r
in summer and by snowcat type machines in winter. It is not the purpose of � '`
this wozk to significantly improve the quality standard of this road. �'v'..�_

5) Nothing herein shall be construed as obligating the Forest Service to
expend or as involving the United States in any contract or other `�;�i�-,;.,
obligation £or the future payment of money in er,cess o£ appropriations
authorized by law and administratively allocated for this work. +' .

6) Because there are no funda available that can be clearly dedicated to I
this project, several years of intermittent effort may be required to �g
accompliah the planned work. � „

7) Nothing herein shall be construed as obligating the County to expend or
as involving the County in any contract or other obligation for the future �
payment of money in excess of appropriations authorized by law and
administratively allocated for this work.

e) Nothing herein shall be construed as obligating permittees of the Forest
Service to expend £unds for, or to otherwise contribute to, implementation �
of this agreement.
9) No estimate has been made of the project wst and neither party commits �
to any dollar amount or percentage. It is the intent of both parties that
__ work will be accomplished as the Forest Service, permittees of the'FOrest �
- �' � Service, and/or the County are able to contribute funds, equipment time,
ilabor, materials, etc. to the project. t

SD) No work shall commence until after a 14 day public notice of the work
f schedule has been distributed to user groups and published in the local
� papers jointly by the Couaty and the Forest Service. •

_ 11) No member of, or Delegate to, Congress or Resident Commissioner shall
� �. be admitted to any share or part of this Agreement, nor to any benefit that
may arise therefrom; but this pzovision shall not be construed to extend to
this Agreement if made with a corporation for its general benefit. -

' 12) This Project Agreement shall be effective upon execution by both
parties hereto. � !.
13) Either party may terminate the Agreement by providing 60 days' written � - -
notice; Provided that any funds on deposit shall be available for expenses '•
incident to closing out the work beyond the period of written notice. F
Unless terminate@ by written notice, this AgreemenC shall remain in force 4'

1. Pitkin County and the Department of the Interior (Forest Service) manage roads �� . :
leading ro what is known as the Red Mountain Communications Site from the Forest Service '� ` �� •

2. The Forest Service and Pitkin County have negotiated a Project Agreement,Attached
as Exhibit"A",that sets out the specific issues regarding maintenance improvements to these ��� ;
roads which will afford safe,reasonable access to the communications site for users of this '
facility. ��
� NOW, THEREFORE, BE 1T RE50LVED BY THE PITKW COUNTY BOARD OF �
COMMISSIONERS that the Chairman shall sign the Project Agreement on behalf of the ^
� County with the following conditions '�

1) The work will be conduded during the summer months of July, August and +�
September;
� 2) The work will be conduded.in a phased approached starting with the upper two ,�
road segments as described within the Project Agreement ;

prevent water from standing on, or running along, the road.

2) Where the road parallels Houston Ditch: install a modest ditch to ��
• intercept leaks from the ditch; install a culvert to pass ditch water under i
the road; add road base to the road to define the intended travel way and I "
. to cover the culvert;�seed, fertilize and mulch bare areas outside the k:'

3) Add fill around outcropping rocks which are a barrier to safe passage by ��
vehicles or remove the rocks or portions of the rocks. f'

� 4) Install culverts in draws which have heavy stoxm and/or spring runoff
flows. ,
. . ROUTE SEGMENT 2 [HUmmingbird Ranch to Four Comers] � � � � �
1) Open 3-4 drain ways through the continuous outside berm by pulling berm
material onto the road and construct rolling dips to direct drainage into-
the drain ways. The addition of imported road base fill material probably
will be required to complete construction of the rolling dips.

. 1) For purposes of deciding the amount of and locations of drainage i / .;
improvement and maintenance, the following guidelines shall be follo�ed. ' '��'�' -

- Pools of water with a surface area equal to or greater than 2 square
feet and a depth egual to or greater that 2 inches ahall indicate the w
need for abatement. Such problems may be corrected by filling or by ,��,
draining.
Erosion channels (including wheel rutsl equal to or greater than 3 � :i,'
inches deep at their deepest point, and which carry water for equal to
_ or greater than 50 feet, shall be abated. Correction of such eroeion i
• : problems may include, but is not limited to, filling, changing the
slope of the road cross section to facilitate drainage, or ��
installation of a rolling dip in the neareat practical location.
2� Trim off limbs which impede vehicle (including snowcat) travel and fall
� -� . dead trees which could block the road. Limbs shall be removed from all - .�
felled trees and the tree bole shall be bucked into lengths 8 feet long or
shorter and left safely of£ the travel way. Removed limbs shall be
• scattered off the travel way.

environmental damage, and to provide a safe travel way for vehicle accesa

2) The work will be conducted in a phased approached starting with the upper two ��
