PITKIN COUNTY, COLORADO, APPROVING THE PRO CYCLING CHALLENGE MAJOR
SPECIAL EVENT PERMIT
Decision No. 60 - 2012
RECITALS
Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ( "Director ") may approve a permit for special
events through an Administrative Decision.
2. The City of Aspen (hereafter, the "Applicant "), on behalf of the Pro Cycling Challenge has
applied for approval of a Major Special Event Permit to conduct a professional cycling race on
August 22nd and 23rd, 2012 that will consist of the top 120 riders in the world. On August 22nd
racers will enter Pitkin County from the top of Independence Pass and ride to the intersection of
Garmisch and Main Street in the City of Aspen. On August 23rd, racers will leave the same
intersection within the City of Aspen and climb over Independence Pass and continue the race.
The Applicant anticipates that approximately 3,000 will watch the race east of Aspen along Hwy
82.
3. The Applicant has requested the use of a helicopter and fixed wing aircraft for communication
purposes and filming of the event. The helicopter and fixed wing aircraft will be used for both
days of the event. Closure of Hwy 82 is represented to occur from approximately 10:30AM to
6:OOPM on August 22nd and from 9:30AM to 2:30 PM August 23rd
4. The Sheriffs Office has created an Incident Action Plan that provides details of the safety and
operations for the day of the event.
5. The Pitkin County Sheriff's Office, Aspen Fire Department, Colorado State Patrol (CSP), CDOT,
East of Aspen Caucus, Independence Pass Foundation, Aspen Valley Hospital, County Engineer,
Open Space and Trails Department, United States Forest Service, RFTA, Pitkin County
Environmental Health Department, Aspen Ambulance, Mountain Valley HOA, Stillwater HOA,
Pitkin County Communications Department, and the Colorado Division of Wildlife were all
referred on this event. Most entities have participated in the planning of this event. Some entities
have specifically commented with conditions that are outlined below.
The Colorado State Patrol will issue a permit for the race as will the United States Forest Service.
7. The Applicant has provided insurance for the event and coverage for use of the helicopter in
accordance with the standards of the County Risk Manager.
8. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 4- 30 -50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Major Special Event Permit for the 2012 Pro
Cycling Challenge Bicycle Race subject to Applicant's compliance with each of the following conditions:

1. All material representations made by the Applicant in the application (which shall
specifically include representations made in all related supporting documents,
correspondence subsequently provided by the Applicant, and representations made by
phone), shall be adhered to, and considered conditions of approval, unless superseded by
specific conditions in this Resolution.
2. The helicopter shall comply with a 500' height restriction within 50 yards on either side
of the Hwy 82 corridor. When the helicopter flies outside this corridor, a 1,000' height
restriction shall be in effect.
3. In effort to avoid harassment of wildlife, the helicopter shall not deviate from the above
mentioned course for the purpose of filming big game wildlife. Hovering of the
helicopter outside the course that results in the disturbance /displacement of wildlife is
prohibited. It is acknowledged that if wildlife is harassed, the CDOW will invoke a
penalty assessment.
4. Prior to August 21', the Applicant shall supply the Community Development Director
with executed permits from the Colorado State Patrol and the United States Forest
Service.
5. No camping shall occur on Independence Pass from Lost Man Trailhead to the summit.
6. The Applicant shall post notices of the event and subsequent Hwy 82 closure at the
doorsteps of all residences within Pitkin County, east of Aspen.
7. Failure to comply with the conditions of approval may result in revocation of this permit.
8. The Director finds that, to the extent applicable, the application complies with the
standards in Subsection 4- 30 -50(i) of the Land Use Code.

2. DESCRIPTION OF PROPOSED ACTIVITY:
Incidental use of National Forest System land (NFS lands) along and adjacent to State and County
roads /highways that will comprise the U.S. Pro Cycling Challenge Race route in Colorado. The bicycle race
has been permitted by the Colorado State Patrol- Colorado Department of Public Safety, to travel on state
highways and by Gunnison County to travel on county roads. The race will be run in six stages over the
course of seven days in August 2012. The applicant would use NFS lands to place portable toilets and trash
receptacles at locations where it is expected that the public may gather to watch segments of the race. The
applicant would also place temporary signs or traffic control devices (e.g., cones, barricades) on side roads
that enter the race route to alert people and protect racers as they travel along the route. Still photography
and video of the event will also take place.

PART II — PERMIT
Use under this permit shall begin on 8/20/12 and end on 8/26/12. The permit shall not be extended,
2. The estimated fee for this use is $8900.00. It shall be paid in advance and is not refundable. Within 30 days
of conclusion of the event the holder shall submit final records of gross revenue collected for reconciliation for
any additional fees due the United States.
3. CLASSIC BICYCLE RACING LLC, represented by Jeff Corbett of 1515 Arapahoe St., Tower One, 10"'
Floor, Denver, CO 80202 (the holder) is hereby authorized to use, subject to the terms of this permit, National
Forest System lands described as: GMUG — Gunnison and Norwood RD's; PSICC — Leadville, South Park,
Pikes Peak and Salida RD's' White River — Aspen /Sopris, Eagle /Holy Cross and Dillon RD's; San Juan —
Dolores RD; and Arapaho - Roosevelt — Boulder RD, as shown in attached Exhibit(s) A. This authorization
covers approximately_ acres and /or 400 miles.
4. The holder is authorized to conduct the following activities and install the following improvements in the
permitted area:
The holder would use NFS lands to place portable toilets and trash receptacles at locations where it is
expected that the public may gather to watch segments of the race. The Holder must provide portable toilets

and trash receptacles to accommodate the larger than usual crowd. Over 150 portable toilets may be
required. The Forest Service would provide the holder with specific numbers and locations for placement of
portable toilets and trash receptacles. The holder would also place temporary signs or traffic control devices
(e.g., cones, barricades) on side roads that enter the race route to alert people and protect racers as they
travel along the route. The holder will provide the Forest Service with materials and supplies to close off areas
where gathering of spectators will not be allowed.
The portable toilets would be placed at several mountain passes and other locations where spectators are
expected to gather to watch racers crest the summits. There are four major mountain passes on the approved
race route: Lizard Head Pass, Cottonwood Pass, Independence Pass, and Hoosier Pass. There are existing
parking areas at these passes and along the highways that Comprise the bike race route. These existing
parking areas will most likely be used by the public to view the race and they are the likely locations for the
temporary placement of portable toilets. Some of these existing parking areas already have permanent vault
toilets and the holder would be responsible for pumping out these vaults prior to or after the event. The Forest
Service will notify the holder of which vault toilets they will be responsible for pumping and when. The holder
will be responsible for trash clean -up after the event passes through. Still photography and video of the event
will also take place.
5. The holder shall conduct the authorized activities according to the attached approved plans and
specifications, Exhibit(s) A. The holder shall not install any improvements not specifically identified and
approved above or in exhibits.
6. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands without
specific prior written permission from the authorized officer.
7. The holder shall comply with all federal, state, county, and municipal laws, ordinances, and regulations
which are applicable to the area or operations covered by this permit.
8. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness,
sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the expense
for all damages, other than ordinary wear and tear, to National Forest System lands, roads and trails caused
by the holder's activities.
9. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees,
hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to individuals.
After securing permission from the authorized officer, the holder shall remove such hazards.
10. The holder shall be liable for any damage suffered by the United States resulting from or related to use of
this permit, including damages to National Forest resources and costs of fire suppression.
11. The holder shall hold harmless the United States from any liability from damage to life or property arising
from the holder's occupancy or use of National Forest System lands under this permit.
12. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all
lawful and proper purposes not inconsistent with the intent of the authorization or with the reasonable
exercise and enjoyment by the holder of the privileges thereof.
13. This permit is subject to all valid existing rights and claims outstanding in third parties.
14. This permit may be revoked or suspended upon breach of any of the conditions herein or at the discretion
of the authorized officer. Upon expiration or revocation of this authorization, the holder shall immediately
remove all improvements except those owned by the United States, and shall restore the site within days,
unless otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become
property of the United States, but that will not relieve the holder of liability for the cost of their removal and
restoration of the site.

15. This permit is a license for the use of federally owned land. It does not grant any interest in real property.
This permit is not transferable. Upon approval of the authorized officer, the holder may enter into agreements
with third parties to exercise the rights and privileges granted by this authorization.
16. The holder is required to comply with standards for adequacy and type of services set out in the attached
operating plan.
17. Gambling or gambling machines or devices will not be permitted on National Forest System lands
regardless of whether or not they are lawful under State law or county ordinances.
18. The holder, in advertisements, signs, brochures, letterheads, and like materials, as well as orally, shall not
misrepresent in any way, either the accommodations provided, the status of the authorization, or the area
covered by it or the vicinity. The fact that the permitted area is located on the National Forest shall be made
readily apparent in all formats of the holder's brochures and advertising regarding the use and management
of the area and authorized facilities.
19. Pursuant to 31 U.S.C. 3717, et seq., interest shall be charged on any fee amount not paid within 30 days
from the date the fee or fee calculation financial statement specified in this authorization becomes due. The
rate of interest assessed shall be the higher of the rate of the current value of funds to the U.S. Treasury (i.e.,
Treasury tax and loan account rate), as prescribed and published by the Secretary of the Treasury in the
Federal Register and the Treasury Fiscal Requirements Manual Bulletins annually or quarterly or at the
Prompt Payment Act rate. Interest on the principal shall accrue from the date the fee or fee calculation
financial statement is due.
In the event the account becomes delinquent, administrative costs to cover processing and handling of the
delinquency will be assessed.
A penalty of 6 percent per annum shall be assessed on the total amount delinquent in excess of 90 days and
shall accrue from the same date on which interest charges begin to accrue.
Payments will be credited on the date received by the designated collection officer or deposit location. If the
due date for the fee or fee calculation statement falls on a non - workday, the charges shall not apply until the
close of business on the next workday.
Disputed fees are due and payable by the due date. No appeal of fees will be considered by the Forest
Service without full payment of the disputed amount. Adjustments, if necessary, will be made in accordance
with settlement terms or the appeal decision.
If the fees become delinquent, the Forest Service will:
Liquidate any security or collateral provided by the authorization.
If no security or collateral is provided, the authorization will terminate and the holder will be
responsible for delinquent fees as well as any other costs of restoring the site to its original condition
including hazardous waste cleanup.
Upon termination or revocation of the authorization, delinquent fees and other charges associated with the
authorization will be subject to all rights and remedies afforded the United States pursuant to 31 U.S.C. 3711
et seq. Delinquencies may be subject to any or all of the following conditions:
Administrative offset of payments due the holder from the Forest Service.
Delinquencies in excess of 60 days shall be referred to United States Department of Treasury for
appropriate collection action as provided by 31 U.S.C. 3711 (g), (1).

The Secretary of the Treasury may offset an amount due the debtor for any delinquency as provided
by 31 U.S.C. 3720, of seq.)
20. For the purpose of administering this permit (including ascertaining that fees paid were correct and
evaluating the propriety of the fee base), the holder agrees to make all of the accounting books and
supporting records to the business activities, as well as those of sublesees operating within the authority of
this authorization, available for analysis by qualified representatives of the Forest Service or other Federal
agencies authorized to review the Forest Service activities. Review of accounting books and supporting
records shall be made at dates convenient to the holder and reviewers. Financial information so obtained
shall be treated as confidential as provided in regulations issued by the Secretary of Agriculture. The holder
shall retain the above records and keep them available for review for 5 years after the end of the year
involved, unless disposition is otherwise approved by the authorized officer in writing.
21. Appeal of any provisions of this authorization or any requirements thereof shall be subject to the appeal
regulations at 36 CFR Part 251, Subpart C, or revisions thereto.
22. This permit is accepted subject to the conditions set forth herein, including any conditions in any exhibits
attached to and made a part of this authorization.
23. The above clauses shall control if they conflict with additional clauses or provisions.
B6 =1. Nondiscrimination.
1. The holder and its employees shall not discriminate against any person on the basis of race, color,
sex (in educational activities), national origin, age, or disability or by curtailing or refusing to furnish
accommodations, facilities, services, or use privileges offered to the public generally. In addition, the
holder and its employees shall comply with the provisions of Title VI of the Civil Rights Act of 1964 as
amended, Section 504 of the Rehabilitation Act of 1973, as amended, Title IX of the Education
Amendments of 1972, as amended, and the Age Discrimination Act of 1975, as amended.
2. The holder shall include and require compliance with the above nondiscrimination provisions in any
third -party agreement made with respect to the operations authorized under this permit.
3. The Forest Service shall furnish signs setting forth this policy of nondiscrimination. These signs
shall be conspicuously displayed at the public entrance to the premises and at other exterior or interior
locations, as directed by the Forest Service.
4. The Forest Service shall have the right to enforce the foregoing nondiscrimination provisions by suit
for specific performance or by any other available remedy under the laws of the United States or the
State in which the violation occurs.
BB =2. Equal Access to Federal Programs.
In addition to the above nondiscrimination policy, the holder agrees to insure that its programs and
activities are open to the general public on an equal basis and without regard to any non -merit factor

The holder shall have in force public liability insurance covering a combined single limit in the amount
$1,000,000.00. The minimum amount and terms are subject to change at the sole discretion of the
authorized officer at the five -year anniversary date of this authorization. The coverage shall extend to
property damage, bodily injury, or death rising out of the holder's activities under the authorization
including, but not limited to, occupancy or use of the land and the construction, maintenance, and
operation of the structures, facilities, or equipment permitted by this authorization.

Such insurance shall also name the United States as additionally insured. The holder shall send an
authenticated copy of its insurance policy to the Forest Service immediately upon issuance of the
policy. The policy shall also contain a specific provision or rider to the effect that the policy shall not be
cancelled or its provisions changed or deleted before thirty (30) days written notice to the authorized
officer at 216 N. Colorado St., Gunnison, CO 81230 by the insurance company.
X -22. Regulating Services and Rates.
The Forest Service shall have the authority to check and regulate the adequacy and type of services
provided the public and to require that such services conform to satisfactory standards. The holder
may be required to furnish a schedule of prices for sales and services permitted by the authorization.
Such prices and services may be regulated by the Forest Service: Provided, that the holder shall not
be required to charge prices lower than those charged by comparable or competing enterprises.
X -29. Signs.
Signs or advertising devices erected on National Forest System lands shall have prior approval by the
Forest Service as to location, design, size, color, and message. Erected signs shall be maintained or
renewed as necessary to neat and presentable standards, as determined by the Forest Service.
X -30. Advertising.
The holder, in advertisements, signs, circulars, brochures, letterheads, and like materials, as well as
orally, shall not misrepresent in any way, either the accommodations provided, the status of the
authorization, or the area covered by it or the vicinity. The fact that the permitted area is located on the
National Forest shall be made readily apparent in all of the holder's brochures and print advertising
regarding use and management of the area and authorized facilities.

According to the Paperwork Reduction Act of 1995, an agency may not conduct or sponsor, and a person is not required to

will be relayed by a repeater flown in a fixed wing aircraft.

On the Pass we are expecting crowds of several thousand. In town we are expecting a
crowd on Wednesday and Thursday around 10,000.

Most City staff will be working, along with our safety staff which will equal
approximately 300.
We will have approximately 350 volunteers on Wednesday and about 75 on Thursday.
We will have vendors for tents, portalets, catering, decor, fencing and signage.
Security will be handled by Torn Dalessandri of Colorado Protective Services. They will
be assisting APD in traffic management, handling road crossings for pedestrians, and
key intersections.
There will be many national and local vendors on Wednesday, August 22nd in Paepcke
Park, along Hopkins Avenue, Monarch Street and Aspen Street.
The event is free and open to the public.
Fees will be charged for the races that will take place prior to the Pro Challenges arrival
into town. (Approximately 11 am to 2pm).
Two trainings will be held for the volunteers and they will take place in early and mid -
August.
There will be music in Paepcke Park and on Spring Street between Main and Hopkins.

Communication Plan:
We will once again be utilizing the Incident Command System jointly headed up by the
Aspen Police Department and the Pitkin County Sheriff s office. The IAP will be
finalized and available around 4 to 6 weeks prior to the event.
Security Plan:
We will be using Colorado Protective Services. Tom Dalessandri 970- 379 -4201 175
Oak Run Carbondale, CO 81623. Their function will be both traffic management and
road crossings. They will be utilized a full day on Wednesday 8/22 and a half day on
Thursday, 8/23. Both the Pitkin County Sheriff s office, Aspen Police Department,
Aspen Volunteer Fire Department, Aspen Ambulance, Mountain Rescue and the
Colorado State Patrol will play a role in this event.
Medical Plan:
Yes, 911 might be utilized. Medical will also fall under the Incident Management Team
and the plans will also be included in the IAP.
We will be using Aspen Ambulance for Independence Pass through town.

Again, the IAP will have the entire safety plan detailed out. We will be assisted by
Pitkin County Sheriff s office, Aspen Police Department, National Guard, Colorado
State Patrol and other valley agencies.
There will be stationed officers from the top of Independence Pass all the way through
town. These locations are still being worked out and will follow a similar patter from
last year.
TransportatiowTraffic Plan:
We will be publishing our traffice plan in June. RFTA will be re- routing busses onto
Hopkins avenue and on Main at 7th. Vehicle traffic will be routed through town via
Bleeker street and Durant Street.
In August we will be doing a concentrated effort on notifying hotels /taxi's etc about
traffic plan.
We are already making the No Parking signs that will be needed for these days. We will
need streets cleaned on Monday and Tuesday, 8/20 and 21.
Parking Plan:
We will be providing extra busses into town. Parking will be available at all the park and
ride lots up and downvalley as well as any legal space that isn't marked "no parking"
within the City of Aspen.
Sanitation/Recycling Plan:
Ashley Cantrell from the City's Environmental Health Department is heading up our
recycling program so all aspects will comply, if not exceed ZGreen standards.
Waste Management will be contracted for the dumpster, recycling, etc. United Services
will be contracted for the portapotties.
Alcohol Mitigation Plan:
Yes, we will have several beer gardens within the City of Aspen. The exact entity
handling the permitting and staffmg is yet to be determined, but will comply will all
recommendations.
Beer will be sold on Wednesday, August 22nd from 11 am to 6pm in the beer gardens
indicated on the map.
We will be serving alcohol at both VIP tents on both days.
Accessibility Plan:
Accessible parking will be located in all open and available accessible parking spots as
well as a designated area, most likely Hunter Street between Durant and Cooper. All
transportation will be handled by RFTA. This event is held on the streets of Aspen so
access shouldn't be an issue.
