outstanding issues with Snowmass Village.

Magill, Planner, summarized this item as an application, submitted °
� by Ms. Kerin Hean, requesting approval of 1041 ha2ard review and
: qeneral sUbmission for construction of a single family residence
; on a revised building envelope.
Magill said during the planning and zoning commission review it was
- recommended that dogs owned by construction workers be retained on
site. Planning staff is recommending that be removad as a
condition.
i Previous approvals for the subdivision have limited the upper lots
in terms of square fbotage to l0,Oq0 square feet. Staff recommends �
� this also be limited to 10,000 square feet as well.
� Magill's revision of the size building envelope is 3 acres not 2.5
� acres.

� Staff recommends approval with conditions as amended.
Tuite asked for clarification on fencing. The building lot or the
�� building envelope be fenced in.
' � Magill said there is no specific limitation on the fencing other
� than it be restricted to the building envelope that is being
proposed.
Tuite did not see that spelled out, that fencing must be contained ,
in the buildinq envelope. Tuite requested that if they are in a •
� transition area, he wants that spelled out and clarified.
• � John Young, appl3cants representative, stated that was implied and
understood throughout the ranch that the only area you can fence
is the boundaries of the building envelope. Which has allowed for

Young had one clarifiaation concerning a condition and it would
request that an access easement be obtained by the applicant pzior
to the issuance of the building permit.
It is his understanding the access permits are only when you are
' accessing off a County road. Which in this case and the other lot
ithey are not. He is nat certain that is appropriate.
I Ethridge said they are required for all access. �
- ? Whitsitt said it doesn't have to be direct access but access which
� will eventually lead to a county road.
� Young said what they were asking for is permission to access off ;

a 5 acre envelope and require everything to be in it.
John Young said this lot is unique by virtue of the fact that it
does have a lot of irrigated pasture land. He said is ideally �
suited as a horse lot. It has horse pasture directly right in
front of it. The thought being that it was ideal pasture land
- would be an ideal location for corrals and horse related
facilities. If you get into the building enveZope you're getting ,
� into a grade situation that isn't really ideally suited for horses.

� Young said this truly would be a barn intended for use by horses. �
That's the representation he�s making and what he believes to be
_ � true and that is why the P&Z agreed to allow not only a barn like
'' structure to be there but to also allow it be fenced in to corral
' the individual horses.

Ireland said to let his clients know it will be a barn. Or it will
be a pile of rubble pretty quickly.

Young said he has not discussed with the applicant that they would "��
have a cap put on them that was inconsistent with the balance of
the ranch. He said the 10,000 square Poot limitations were placed ��a.r•
on the lots by virtue of the DOW's concerns of a sphere of impact
that was created in wildlife sensitive areas.
Young thinks as the DOW has pointed out� this lot is one of the `'
- ` least sensitive areas. He said every other homesite has a 15,000 �'4.
' square foot maximum FAR. It is somewhat a restrictive, that is �'
� inconsistent with the balance of the ranch. Therefore he expects i;: '
i his client will object to it.
Ethridge said part of his motion on the 10,000 square foot limit,
C� is a concern of visual impact because of its proximity to the
roadway.

f Young said in terms of visibility there is a severe drop off to the
y road. And the reason for the building envelope recommended by the
{ DOW was the fact that it places the entire structure totally hidden
� by the natural land form from the Crown area across the street.
Which is the primary winter range for the Sopris Mountain Elk Herd.

� Tuite asked Young what the houses size were up from Lot 1?
; Young said the average house right now was 5,00o square feet in the
ranch, with 12 being developed.

Ordinance assured that the public was fully notified o£ the changes ,,.
and insured that the new Land Use Code reflects the postponement i;;.;, i
of the 1994 competition (Metro Area Residential and Lodge} from the `
� fall to the end oE the year. Given additional delays in the N-;V;`::
; adoption of the GMqS amendments the staff proposes the following `�" �
j amendment to the Land Use Code, thereby amendinq Ordinance 94-19 ;'�; �

In addition, we have processed an amendment that gostpones the Non- � �.
Metro Residential submission date. At a recent work session the ¢
�oard determined that theze may have been some confusion ��
surrounding whether or not the Non-Metro submission date had been

amended at the same time the Metro date was amended.
' Pursuant to Section 4-606(G) of the Land Use Code, annual �,
I submission dates For Growth Management Quota System Applications �'
(in order to be eligible £or any year's competition) shall be filed �
with the County Planning Office on or before:
1. September 1 for non-metro residential development;
2. January 15 for metro area residential development; -
2. November 15 for commercial development and; `
� 3. January 15 fqr tourist accommodation development. `

At first reading the following dates were considered to amend

This waiting period not only affects this proposed Ordinance to
• amend submission deadlines, but also the effeative date of the
_ Ordinance amending Metro and Tourist Accommodation regulations ,
being adopted this evening. To ensure that the effective dates of ,.
these Ordinances passes before applications are received, the
following revisions to the submission dates must be adopted
tonight.

thought that speaking as an individual and for the Board it is very
muoh in keeping with the goals and desires of the community plan. .

and never revisited. Staff and the Attorneys have met to
discuss those projects which have competed in 19.93 GMQS , ��
competition and have unfulfilled allotment needs for their ��
� project huildout. In the County there are only two such
projects: Moore and High2ands Lodge. In the case of Moore, ' '
their successful scoring in the 1993 competition will provide _� �i �
25 of their 40 free market units, if the project is approved _
by the Board. Therefore, 15 GMQS allotments are necessary to � ',i'
complete the project. In the case of the Aspen Highlands �(`
Resort and the Lodge at Aspen Hiqhlands proposal, the �;;

Education who has unanimously resolved to support the Moore Family PUD proposat and, `
_ specifically,the six(6)affordable housing units planned for the property for use by the � "

i DzstricYs employees.
Schoois,particulazly middle and high schools,are unique among the Aspen Area ,j
employers in that our feachers spend a considerabie amount of dme supecvising and
sponsoring after-school and eyening activities--practices, games,dances,participating in
parent conferences, etc. As a District,we have been experiencino an increasing number of +
: teachers moving down-valley precluding or limiting their extra-curriculaz acuvi6es. We
woald tike to reverse this trend by having the Moore units available to them. This
arrangement not only heips our teachers but benefits our students whom we encourage to be ��.
active in after-school activities. ���;,.

The six units offered the District empioyees are"extra" units over the required
number of employee units and alIowing one employer ro"benefit". HoQefulty,the Boazd
_ � wili approve these units for this purpose since they are gratuitously being offered by the
developer. �.

Lasdy, the Aspen School District has not always been able to attract the best teacher
�: or administrator candidate because of the high cost of housing in ri�e area and iew wish to be

at public meetings on February 3, 1994, February 10, 1994 (GMQS ,i.: �
scoring), and October 4, 1994. At the February 3rd meetinq, the P&Z �-° -
tabled further consideration of the general submission application
to allow the Applicant time to revise the proposal in response to ��� ,
� concerns raised by Staff and the Planning Commission. A revised �• y;``
j application was submitted in April of 1994. The revised application �} �,•;
' was reviewed by the P&Z in October and it is this revised �'
; application which has been recommended for approval by the P&Z and e �

4 The City Planning and Zoning Commission has also reviewed the �
+ revised application as required under Section 6-3.4(bj (2) of the
3 Land Use Code. This section requires the City to review
; applications for subdivision within the County when the subject
f property is within 2 miles of the City boundary. The City has � f
E reviewed the project for compliance with the Aspen Area Community
�. ._I Plan (AACP). In addition, the Applicant has requested the extension -
i of City water service to the parcel. The City's review process for
development applications requirinq a water service agreement is
essentially the same as that for subdivisions within two miles of
the City boundary (compliance with the AACP) with a few exceptions. <

requires an evaluation of the potential impacts on other City 'o ,

B7ICEGROOND/SITS DATA: The sub j ect property is a metes and bounds i'`;.±,r,
parcel containing approximately 215 acres. The Moore family � .; '.
purchased this site as part of a larger parcel (325 acres), in �'�
1952. Since the original purchase of this property, the Moore ;;_• r:
1` family has donated land to the County for the schools and the
community pool. Also, in 1992 the Moore family sold 65 acres on the �``�:�;.�. `
- north side of Maroon Creek Road to the County for open space. The '
' Moores have retained a 45 acre parcel on the north side of Maroon `�`�.
Creek Road where Mrs. Moore currently lives. This site is not ,;.j:,
considered contiguous to the subject parcel due to the separation -
i by Maroon Creek Road. '
i; The subject property is located approximately 1/2 mile from the '"
City of Aspen, as measured along Maroon Creek Road and Highway 82. �s
The site is bordered on the north by Maroon Creek Road and the
County-owned open space land on the north side of Maroon Creek !
Road. The eastern boundary of the property abuts the Meadowood '
i Subdivision on the north and the City of Aspen Water Treatment
! Plant on the south. The southernmost portion of the property F
� extends over the ridge and into Castle Creek Valley. A small corner `;1
� of the parcel extends to the south side of Castle Creek Road. The
' property is bordered on the west by the Aspen Highlands Ski Area ,
and the Aspen Highlands Subdivision. The school campus is also
located immediately west of the northern portion of the site.
� The Aspen Highlands subdivision is Zoned R-30. The subdivision is �
comprised of approximately 30 lots which range in size from 30,000 � �-
� to 40,000 square feet, with a few lots being considerably larger.
The Meadowood subdivision is also zoned R-30. Many of the lots in
this subdivision are in the 30,000 square foot range, the minimum
4 lot size in the R-30 zone district.
� The property's terrain and vegetation varies substantially from ;
north to south. The northern portion of the property, between the �
� school campus and the Meadowood subdivision, is characterized by
°� ' gently rolling terrain (geherally slopes less than 15 percent) :
� � vegetated with native grasses and sage. This portion of the
property also includes scattered clusters of oak brush and other
shrubs. The southern portion of the property is traversed by a
ridge which runs through the property from the southeast to
� northwest. This ridge separates the Maroan Creek and Castle Creek
Valleys in this area. The slopes in this portion of the site are •
steep (well in excess of 30 percent) and heavily wooded with spruce
trees and stands of aspens.
Between the northern meadow area and the steep slopes of the
southern portion of the property is a relatively narrow transition
zone generally between elevation 8150 and 8350. This area is

in this area is predominantly aspen trees with shrubs and some . �;�
scattered clusters of spruce trees. One of the raw water lines
_ which supplies the City of Aspen Water Treatment Plant passes `'"�,.+.,,
through this portion of the property. This corridor is referred to �
as the "Flume" and is currently utilized as a nordic ski traiL �`.�
There are two small valleys located on the east side of the ��
property near the Aspen Water Treatment Facility. These valleys are �
visually isolated from the surrounding residential areas, most �.:s,Y: �
notably the adjacent Meadowood subdivision. �,:;_•.` '
' The subject property is encumbered by avalanche hazard, moderate � �
to extreme wildfire hazard, and steep slopes (as shown on the f:;,•4•'
"Existing Conditions" exhibit included in the application). The
: avalanche hazard is located in the southern portion of the
property, on the north side of the east/west traversing ridge. The `'j
; hazard maps also show a fault line running through the property. '. ,
� The property is not mapped as wildlife habitat, though there is a
big game road crossing over Castle Creek Road near the southernmost S'•
i property boundary. Several adjacent residents have reported seeing w�"
j mule deer and other wildlife crossing the property.

�' The subject property is currently vacant. The Moore family has
allowed the site to be utilized for nordic skiing and a substantial
system of nordic ski trails has been established and maintained by E�
the Moores and the Nordic Council over the years. This system of �
trails is depicted on Figure 2 (Existing Conditions) provided in
j the application. Portions of the school system roads and parking °'`

� Physical Imnrovements
� The Applicant proposes 40 free market lots and 31 affordable j
� sinqle-family detached homes. The Applicant also proposes to
construct the necessary roads and utilities to serve the project
as well as signifiaant improvements to the roads and parking areas
____ which serve the school campus.

I The revised plan divides the affordable housing lots into four �
clusters. Each of these clusters contains from seven to nine 1ots. �`
Three of these clusters are located near the schools and the fourth
is located amonq the free-market lots in the upper portion of the �

proposed roadways and parking for entire project. and especially

,� One of the key concepts on which the proposed redesign of the
: school campus circulation system was based, is the separation of ��.`_
traffic for the Middle and Elementary Schools and the Hiqh School. ��- `'
The future conditions plan (figure 3) in the application shows the �:;-�
northern entry road will be reconstructed to loop around a new
parking lot and will not connect with the loop road that will serve
� the High School. This desiqn creates an auto-free zone between the ",:
two loops which eliminates Elementary and Middle School children '+•
from having to cross a roadway to get to and from the drop off ��f�'��
i area, or the proposed athletic facilities located in the meadow.
� The loop road which circles the parking area, is proposed to be a ��
. ,I one-way road with two drop off lanes.
The Applicant also proposes several changes on the High School side �
of the campus. iJnder the current proposal, access to the High a`
School will be provided via a driveway which will tee into the
proposed Moore Drive. Kathleen Krager notes that there is a `:,����w
discrepancy with respect to the design of the High School access .�
� road between the 200-foot-scale "future Conditions Plan�� (plan
� showing overview of entire property) and the 100-foot-scale plan
i (detailed plan o£ school campus). Ms. Krager prefers the design as ._
� depicted on the 2o0-foot-scale drawing because it creates fewer ,�s,
traffic conflicts. The Planning and Zoning Commission also
preferred this design.
� The preferred design involves combining busses auto and traf£ic �
-- ---i bound for the High School onto one access road for the short
� distance between Moore Drive and the point where the loop road for
the High School parking lot rejoins the main school access road.
At this point, the plan is designed with a separate bus lane which
interseats the main access road on the right and provides a �`
segregated one-way bus route back to the Middle School and ,- .
Elementary School. The one-way bus lane provides the only bus � � -
access on the campus as well as providing access for service
` vehiales. There would be no busses utilizinq the northern access
