Housing director attached hereto and made a part of this record as

� ? on January 25th with a specific request relative to their abi7.ity
to select the occupants of a certain number of the affordable
housing units which are being offered as part of the Moore
u proposal.

? The Aousing Board recommended approval of the request with several I
,, ; conditions. The applicant has requested that six of the 31 ,
'� _ i affordable housing units be reserved for school district employees.

� The Housing Board aqreed ta this request with the following
j conaitions. ;

� 1) Whoever the Housing Board selects the household they select
� � must meet the priorities in the housing guideline. At least
one person per bedroom. Must have one dependent child. Be �
a working resident of Pitkin County for at least four years. '
I£ no households picked by the school district meet these
priorities, the units shall be made available to any
households in the community who meet the priorities. i

The sewnd aspect ittvolves two of the 31 units. The units would `i `
be made available to be purchased by the school district itself, 4
to be made available to persons at their discretion. Intended to �
provide housing for someone recruited to this area. The conditions
( for these two units are.

� 1) The qualification of the proposed residents would be reviewed �
3 by the Housing Office in order to establish that the household
� is a working resident. r

- � 2) The subdivision Covenants would include provisions such that
� the renting of these units would nat result in significant
� impact to neighboring owners,

a Tha last aspect of the request involves a single unit which would �
be made available to a Moore family member who would otherwise
. z qualify to own and occupy that unit. With the condition that, if
'i no qualified fami2y member wished to purchase the unit, it would
� be made available to households in the community.

� Suzanne Konchan asked if anyone could help explain the sub-section

` Gideon Kaufman responded by explaining that the first time around
is what the concern was. If somebody in the school district would
go into the pool and win that one, they cannot compete in the �
, � lottery.
' Konchan said that other school employees may go into the general
lottery, but the six who get the school distriat�s units are �
obviously excluded.
Bob Child asked if these units would be linked to the job. If a
school district employee qualified for a unit and then subsequently

doesn't think it's consistent with the household selection to be
used to meet residency employment. �

- Glen Horn said two units would be separate. And what they mean is,
; these units will be used primarily to recruit people for top level F.,: .
position in the school district. And once they are there, they
� need to report to the housing authority, say I'm here so that the
housing authority knows.
Ireland wants them to address the issue, that the resale price is ?�7

� Ireland then opened the Public Hearing. He asked that the Public �

Ireland expressed his concern that the policy of the Board is to ���
i weigh the projects on their indivi.dual merits and not because of

; Beth Willey, had a question regarding the occupancy of the units.
� Malloy stated that each household should meet minimum occupancy one q-
person per bedroom, shall have at least one dependent child living
in the household.

Tom Farrell, Superintendent of Schools, said fairness is allowing �!

Ireland stated that if they were hiring them at $24,000 a year, �'
they couldn't buy a house anyway. xe thinks part of the answer is ��

� Farrell said he is finding that more and more teachers who came
here three and four years ago are saying they can't stay. ,;,,�
Ireland asked why the School District isn�t alloca�ing funds and •�

i Farrell said one reason is the finance laws of Amendment One. He �
isays this subdivision is their best investment right now. ;�.j
� Jim Curtis addressed what may be a public misconception and that �`
� � is the issue of fairness. The argument in front of the housing

E board was that this applicant was proposing 31 affordable housing „
� units and the threshold requirement of the land use code is 17 �
units. Therefore, 14 units were above the requirement.

Gideon Kaufman said tihe big concern that was raised was they didn't
� want to get into a situation where a couple was able to get a three
or four bedroom. The discussion focused on people in the rooms in ?
terms of priority. He does not think there was discussion as to �

� They didn't want two people to have a priority on a four bedroom. !

Ireland suggested that the top six school candidates get it ,
provided they fill all the bedrooms. .
Bill Tuite agreed if they could get to a point where they say this �'
is for the school district and even though we have guidelines, do �.
we want to start mico-managing how they feel their preference

The school district can deem what they need more importantly than i�: ��

some of the housing, it would be appropriate for us to make a �� �.
finding of this situation of the contribution of the Moore family i,:

school. Those two things alone are unique circumstances that we `�` �

won't find very often. He stated it would be appropriate for the �'.`.�"=:
j Board because it is a departure from the normal housinq policy to �'-;- `

make a finding of this situation of the contribution of the Moore ,; ;: .

� It will not be a new arrival. •

Ireland has a lot of reservations about doing priority for anybody. ,
They are based on the calls he gets from people who say," don't do �

Ireland stated there will be six units, they will be teacher �
, dedicated, they will be required to fill the guidelines, one four �
� year resident, they will meet income guidelines, they will not be
t kicked out if they quit working for the school. He senses the �
� Board will go along with the two units under the control of the
: School District with resale restrictions.

� Ireland told Tom Farell they need to see the District involved in �
i housing. He has been told by other Board members that they are not
- � j in the housing business. He thinks it's in the School District's
� interest to get into it and soon.
� Ireland stated there was no problem with the designation of an
� eligible Moore designee.
Malloy stated among the criteria listed was to fill the bedrooms.

Ireland's concern was if they build 8o affordable housing units it '• a
. would create a deficit of $73,000 a year. That is about $1,100 per ':.i:
-- unit per year. If you capitalize that nwnber they would be -
subsidizing each of the houses for about $10,000 in services. To
him $73,000 to get 80 units is not a great burden to the County.
'' And not an obstacle to approving it. { r

" The objection he has is philosophical and it is that the applicant '
- -= is saying to the county, ��We're building a project. It has a lot } �
� of nice amenities and we're asking far approval for what i,t�uld be j..
between 40 and 60 million dollars in sales. And when we're done != •
� you're going to be left holding the bag for $18,60o a year or ask �.

clause is there. But he doesn't think that should be the case.

it a contradiction. We're building extra units but there's a
deficit in the project. The units aren't really extra, iE the
taxpayers paying for them every year by providing additional
services. We can�t both pay for them and consider them as extras.

� Tim Malloy asked iE the question was do we have the authority to
- . require more housing over what is require by the code. He believes
the answer is no.
A continued discussion ensued.
Bob Child asked about the net fiscal impacts to Pitkin County, as
a whole or the government. When you factor in school districts and
_ the other major districts what would be the fiscal impact?
King Woodward, President of the Meadowood xomeowners' Subdivision
spoke about the impact on the surrounding areas. He does not feel -
that this is the place for additional housing. He urged that the
open space be retained.
'� Bob Child stated that this is a large parcel of land and limiting '
-� � it to 31 housing units for the lifetime of the property. At some
Z, point in the future, he thinks we�11 look back and say, nSoy, we
`�? should have put more units on that parcel��. And the community will
have changed and maybe Meadowood will be a very different place.
, He wondered if there was a possibility of laoking at 31 then ,
reserving some portion of the land for future use under certain,
very rigid criteria, which would include consideration for
Meadowood and so forth. �
� Ireland suggested that there is 63 acres of property across the
� street that presently have a restriction that is in the Moore

Glenn Horn said with respect to the overall traffic circulation in
that valley, the most significant improvement is breaking the e "
traffic up and splitting middle school and elementary school from ��
� hiqh school traffic.

I A discussion ensued with regard to whether or not improvements ('
3 should be made to the intersection and Highway 82 prior to the EIS E �
� process being completed. r.

IIorn said that Mr. Moore and the kioore family made a commitment to ��
� the Maroon/Castle Caucus that nothing will be done in this valley
� € until something is done to address the traffic concerns at State
' � Highway 82 and the Castle Maroon intersection. So the funds and i
� the improvements that are committed to in the short term are in
� reaction to the commitment that Tom has made to the Caucus and the �
� Castle/Maroon neighborhood. If things work out it is possible that ' .
� there could be a decision can be made on what's taking place there
y about the same time they begin to construct some of the
"- __._.j improvements on the Moore property. ;

1 Horn said he does not think there would be problem in discussing i
I with the Moores the possibility of taking the funds that are
' committed to this intersection and utilizing those to jump start
' i the process so that improvements could take place in the Highway
Corridor to correspond with the EIS. .
Ireland said at this point he will close the public hearing and
bring the matter back to the Board for discussion.

Proposal aad Housinq Board Recommendation: The Applicants made the
, following specific requests, which are recommended for approval by �
� the Housinq Board, with conditions: � -=:
_ I o Six of the 31 affordable units would be purchased by j
I employees of the school district. The initial purchasers `
would be chosen by the school district, and upon resale
of these units, the school district would have the right ',
_ � to select a purchaser. The Housing Board recommended . ;
approval of this request, subject to the following
conditions:
� 1) The initial purchasers selected by the school shall ?
meet the priorities set forth in the Housing �
Guidelines for three bedroom ownership units.
Specifically, each of the households shall meet !
' minimum occupancy (one person per bedroom), shall
have at least one dependent child living in the
household, as defined in the Housing Guidelines and �
at least one member of the household shall be a
working resident who has worked in Pitkin County
for at least four years immediately prior to ;' .
purchase of the unit. If no households picked by �'

be made available to any households in the
community who meet the priorities.
. 2) On resale of any of the six units, the school
