Reid Haughey, County Manager, asked that three items be added to
the agenda at this time. one is a Resolution Authorizinq Execution
� for the Lyon Residential Cabin Lease and Delegating Signature
Authorization to the Pitkin County Manager. Second, an addendum
� to the agreement with Bishop Construction for operation of the
solid waste center. Thirdly, approval of the 1995 ambulance
licenses
. . � Dave Myler appeared before the Board to discuss the Mills code
determination. He said at the last meeting this matter was
� scheduled for this time. However, he noticed it was scheduled for
later in the evening and he will not be able to attend due to a
scheduling conflict.
� After a short discussion, it was agreed that the matter should be �
, � tabled to Wednesday, March 22, 1995 at 3:30 p.m.
'� Ireland asked that a resolution be added to the agenda regarding
` the FIS determination of taking away A.J. Kitt's win for the second
� time here in Aspen.

APPROVING 1995 SUPPLEMENTAL BUDGET RESOLIITION - Lynn Dunlop,
Finance Director, noted that this is the first supplemental budget
resolution of 1995. It was created because a number of significant
. projects have developed early in 1995 for which budget is needed.
She proceeded to give a brief overview of the projects which
I consist of Centennial law suit settlement pre-payment, EPA
superfund remediation and institutional controls and library
building improvements and equipment purchases. She noted that the
Shadowwood apartments buy-down budget had been removed from the
resolution because negotiations were not successful.

PUBLIC COMMENT: Dan Kitchen thanked the Bartos family £or their ��'
donation of 800 acres of land along Watson Divide. He also thanked ���x
the Snowmass/Capital Creek Caucus for not dropping their lawsuit S'-
regazding the water issues on Snowmass Creek. He tihanked the Board
� of County Commissioners and the Aspen City Council for their .A�
contribution to the Sierra C1ub for the brochure they are producing �
� to how educate realtors and other people within the valley
regarding developments and the fencing issues of how it impacts �
wildlife and migration. With regard to the Guber conservation a
easement, he said there are a lot of people who are still waiting �'
t for Mr. Guber to make this donation.
� With respect to the wildlife mitigation issues, Kitchen said he is
_ once again requesting help from the County that he could go out and
document and inventory some of the County roadways.

Mr. Kitchen was asked to prepare a proposal with regard to what it
; is he wants to do and how much he wants to charge for it.

REVIBW AND GENSRAL SDBMISSION - Rick Magill, Planner, introduced �
"� this item as an application, submitted by Mr. Walter Pfanensteil,
� for 1041 Hazard Review and General Submission to allow the
construction of a single family residence.
_ Magill said the project site is accessed off of Coal Basin Road by
• a driveway that is approximately 500 feet in length. The building
envelope is approximately one half acre in size and contains slopes
of approximately 15 percent. Y ''"�'
� Magill proceeded to review the 1041 issues as outlined in his i� �
� memorandum. A copy of this portion of his memo is attached hereto
� and made a part of this record as E7�iIBIT ��C��.

1 Magill noted that the other issues associated with this application
1 has to do with public access and the use of Coal Basin Road. He
i said the Open Space and'Trails Board is currently negotiating with o
Mr. Pfanensteil for unrestricted public access on Coal Creek Road
, to public lands beyond. Mark Fuller has drafted an easement .', ,
agreement which the Pfanensteils' are now reviewing. He said he -� � �
spoke to Mr. Pfanensteil today and he said he is willing to sit
down with staff as soon as next week to hammer out the details of �-

� is part of his severe winter range critical habit designation above � `
7400 feet or not. She thinks this is critical to staff in terms �
� of procedurally how to treat the application because under the new s+-:.��'
'� code, development within winter concentration areas is prohibited
and could only be approved through a third step taking

Konchan suggested that this matter be tabled to Apri1 5th to allow t �
time for the road issue to be finalized and also, to get more ���1
information from the Division of Wildlife with regard to the � ,,
location of the homesite. ��

Mr. Bier said their application has been in since August 29th with �
a previous letter from Kevin Wright. He said they met with Kevin
Wright on site last week to determine the location of the proposed �'�
_ homesite. They agreed to move the building envelope closer to Coal
Basin Road below the 7400 level. He said Mr. Wright told them that
� he does not believe the property is within the concentration area,
� and if it is, it is way back up in the basin behind this building
� site. They have been counting on this meeting for an answer on
� their application and urged the Board to approve their request. �

Ireland advised Mr. Bier that if the conversation with Kevin Wright
" ; is as he represents, then there is not a problem and perhaps this
� could be approved subject to verification of that conversation.
� Ireland moved that this approval be qiven subject to verification
of the representation by the applicant that the xildlife
concentrations are ahove 7400 feet. And that the buildinq envelope � .

Reduction Lot Split in the Metro area. The McDade property is
� located on Red Mountain and is within the designated Metro Area. ,
The second reading of the revisions to the GMQS Regulations was
approved by the Board on January 10, 1995 and the Planning Office ��:¢�
Yeceived a complete appZication for the McDade Lot Split on the �!�
same date. Staff is recommending that the Board consider +
processing this application as a pipeline case and set the " "
_ � resolution Yor adoption at the next regular meeting. ��
Suzanne Konchan, Planning Director, said that in a few weeks staff
will be back before the Board on an issue of rural and remote and �
County wide. She thinks this may be an issue that will resurface. �'
She said there is a distinction between the Board's past practice
of granting an exempted status to a case at its own discretion ��`��
a versus how the vested laws are meant to act. There are certain ''
� � cases staff will be recommending to grant pipeline status but not
as late as 5:00 on the date of second reading as it is proposed to
be interpreted here. She said she wants to get this on the record

�� OPERATIONS PLAN REVIEW FOR TIiE ABPEN RACBWAY - Tim Malloy, Planner,
� said the Board of County Commissioners conducted a review in August
j of 1994 to deteratine the legaZ status of the Aspen Raceway facility �;i
Ilocated in the Woody Creek area. The purpose of the review was to
; determine whether the property had been continuously used (no lapse &
of 12 months or more) as a raceway. The Board found that the track ��
had in fact been continuously used and that it should be considered
an approved special review use. As a result of this review, the �
i Board passed resolution 94-134 approving an "operations plan" for jt�
t the raceway use. This resolution called £or a review of the j!.
operations plan after completion of the 1994 racing season. The
� purpose of this review is to evaluate compliance with the �
� operations plan. �
Malloy said there are two issues associated with this matter. One �
� there were two complaints to the owner of the race way during the �
� 1993-94 race season regarding noise at the track, and these
complaints were resolved. He noted that there have been no �.
complaints made directly to the County.
� The other issue is that of insurance. Malloy said the information
� provided by the applicant does not include adequate information '
� regarding insurance for race events.
�
i,. � Ethridge said he does not have a problem with the raceway �
--- operation. However, he does have a problem with Aspen
� � Earthmoving's operation at this locatiqn. He asked staff to look
� into this matter to determine when this operation was to be abated.
, , Arden Weatherford, owner of the Aspen Raceway, said he is prepared
to prove that they have adequate insurance. Staff and Mr.
i Weatherford were asked to work together on some sort of log to •
� assure adequate insurance for each event. '

contains medium hazard fuels. Vegetation primarily consists of .`1:�: _
mature aspen trees, with an understory of snowberry, serviceberry, +
and various grasses. Aspen forests of this type do not readily

mitigated by the presence of a wet area or seep below the proposed �,i
� building envelope and the lacation of the driveway, which would
act as a fuelbreak in the event of a wildfire. Mr. Wright pointed
� out that there is a large amount oP down dead material on-site that �
needs to be removed. Kevin emphasized that the thinning of live �
trees is not necessary or recommended, as this would Iead to health �
� problems in the aspen stand. �

cieologic - The property contains slopes up to 30 percent. The areas .
of steep slopes are located on the southwestern portion of the
parcel. The proposed building envelope contains slopes of
approximately 15 percent and is located in the northeastern portion
of the lot, approximately 325 feet from Coal Creek Road, There are
} no other developable areas on the property with slopes less thaa �+
• ' 1 25 percent. The access driveway will not encroach on slopes in "
excess of 16 pezcent and maintains an average centerline gradient
of approximately 10 percent.
There is potential for debris flow hazard associated with a gully
in the northern portion of the property. Nick Lampiris and Jeff
Hynes of the Colorado Geological Survey generally agree in their
�_,_ _ geological evaluations of the site, except for Dr. Lampiris' .
,. recommendation that berms be built uphill of the building site. Mr.
Hynes does not fael that berms are necessary given the distance of
the building site from the debris flow path.
� Wildlife- Kevin Wright confirmed that the lot lies within elk
winter range and winter concentration area. The area primarily
above the 7400 foot elevation contains severe winter range and
critical habitat. Mr. Wright points out that the steeper terrain '
above the 740o foot elevation may contain limited elk production
� in some years but it is not significant. The iVR2S maps indicate {
there is also elk production area located across Coal Creek Road,
within 1%2 mile of the property, Mr. Wright's comraents are not
definitive wzth respect to the prohibition of dogs, yet based on
: the proximity of the subject property to periodic and mapped elk `� .

We first approached the Forest Service to sec if they were interested ia obtaining an �;�, •
easement on Coat Road that crosses our property on the basis ihat they would provide `t�
road maintenancc. They finally decided after several months that they were not
� flnancially in a position to provide maintenance on the road and so we then approached �a;;
� Pitkin County to see if they were interested tn the same p:oposal. Thear wmment was � y��
that they were interested.

_ � Lnst December we submitted to Pilkin County some suggested tecros for a proposed j
� agreement. Yesterday,March 14th,we received a lecter from the Open Space Board
6 and a letter from Pitkin Counly outlining their response to tha proposal. It looks lilce ;.
we are all in basic agreement. We would prefer to givo the road in Pea Simple to
? PiUdn County instead of just an easement as suggested wtuch should be more agreeable
to all. Therefore we are prepared to enter into a formal agrcement along the terms
� stated.Wo aze now in the process of scheduling a moeting with all of tt►e parties A
� concemed and Mark Fuller for the purpose of drafting a final agreement. .
_ Since it is our intent to give Coal Road as a charitable donation for tatc benefits,it is r �'�
imponant thaf we make the donation of the road in its entirety at ona time. The " �
mortgage on the property allows periodic releases of the land as payments are made.
The threa lots that have presently been submitted for tha 1041 approval will releasa the
'� land that abuts Coal Road. Lot closings on these 31ots are scheduled within 10 days
after final approva]of the 1041,

the back 3/4ths of the lot as a travel route to qet around the
cliff face. Mule deer use occurs primarily Spring - Fall. Black �`
- bear inhabit the area and could cause problems, especially in the
' Sprinq and Fall, if garbage and bird feeders are not properly
� cared for.
Impacts to wildlife can be minimized by the Following: �
' 1. Maintain building envelope and homesite below 7400' ,�
elevation and adjacent to the road. It may help to move
_ homesite toward road and away from toe pf ridge
2. Maintain native vegetation outside building envelope and
as much within building envelope as possible in order to
screen homesite and minimize disturbance
3. No fencing outside building envelope. AI.1 fencing be
42", 4 strand or less with a 12" kickspace between the top 2
strands. Rail fencing be 48", 3 rail or less with at least .
�a � 18" between 2 of the rails � �
� 4. No dogs. If dogs are allowed, they be restricted to 1 :
� dog with kennel restriction and kennel be constructed before �
� C.O. is issued. ;
5. Any horses be kept within building envelope. All
, � haystacks be fenced with e' fencing to prevent game damage �
to haystacks �
6. All garbage be placed within approved bear proof garbage j•
� containers. Summingbird and bird feeders may need to be i
removed if bears are observed around homesite. �
